Co-Op offer partial settlement but what about Credit History?

I submitted a claim on 6th June against the Co-Op for £300 in bank charges. I claimed for the charges and [highlight]removal of negative entries with credit reference agencies[/highlight] They acknowledged the claim indicating an intention to defend all of the claim on 16th June. I received this on the 17th June. They sent me a letter dated 15th June (arriving on the 17th) with a cheque of £300. This letter dated 15th June said the following: My question is this: they have sent a cheque for £300 but have not mentioned the removal of default entry. Do I cash the cheque and tell the court, and proceed with the action to get the default removed? Do I not cash the cheque but tell the court they've offered to pay (as per their letter?) Or do I send their cheque back saying i want the default removed as well. I'd normally do the latter one but their letter says "you must inform the County Court, upon receipt of this letter, that the Bank has made payment in full to you". Do they know something I dont? The letter was from the co-op bank customer services department, not their solicitors.

I'd still to the DPA on Egg. You'll get the guy's note on your file that it's all automated.

I'm not sure you did settled. You settled on the condition that the default would be removed and the debt written off. I assume this hasn't happened. The debt was £416.42 made up of credit card charges. You paid £100 so you have £316.42 as an unsettled debt on the credit reference file. Just file a claim for i) 316.42 to be written off ii) £100 back, and iii) a removal of the default entry. You have lots of accounts with natwest and might have been charged illegal fees in your other dealings with them. Do a DPA and find out!

Presuming you have only sent them the 'preliminary approach for repayment', I would write back saying "Many thanks for your letter dated 11th June. I am happy to accept £1400 as an installment of the £1603.05 you owe me. Yours Faithfully, Whoever" Don't sign their letter (and sign away all your rights)! Send your letter in response to their offer and stick to the original timetable you detailed in your first letter. Then LBA > 14 days > file your claim. They'll probably write back with an improved offer. Just like Deal or No Deal, isn't it! *** Not heard anyone having their account closed by HSBC. From other forum posts, the legalities of them doing this seem a bit murky.

My girlfriend got this letter, offering £300 less than she was claiming. She wanted to take the money but I didn't let her. If someone had stolen £1603.50 from you and then offered to give it you back £1450.00. Would you take their offer, or insist they give you all of it back? We rejected it and proceeded with court action, at which stage we won £700 more than they offered thanks to interest and costs. Also, the date of the letter we got from HSBC offering £300 less than our claim was dated EXACTLY 14 days after the date on the preliminary letter we sent.

Hi, This goes for pretty much everyone thinking about getting an MOT. You can get the council to do it for you. If there's a serious fault, fix it and return it to them (at a cost).
