  6. tbh i started dealing with this debt before i knew about this forum or theres no way on earth i would have done what i did, this forum changes teh way you look at things, for the better. anyway, the debt was vodafone..... i thought about sending them a letter saying we agreed on a settlement, ive paid it, debt closed bye. do you think they would leave it there or have a case for purusing it?

Sent them a cca which they default on 28th dec if no reply, however had a letter today offering that i pay £1pm for 6 months, no mention of cca. think last payment was a couple of pounds less then required due to so being wrong, payments were about £8 a month. why do you think this sudden offer? is it likely theres no agreement they can provide me with?
  8. i won my first lot of charges back from hsbc, but since have been charged £100 which came out before i got the chance to send lba (offer had been made and accepted), then £25 for bounced ML to themselves, then £25 due out on xmas day, so i am planning on sending my 2nd claim to them tomorrow. how many times has anyone experianced claiming before they close the account? im not worried about it as been using another bank now since i was about 2 weeks into first claim, i was only asking out of interest?
  9. bugger, first apt i could get was jan 8th with it being the holidays coming up. i wonder if theres a letter i can send requesting the managed loan account go on hold whilst seeking legal advice?
  10. im sorry i cant give you any definate answers, but im pretty sure that they have 14 working days from you posting the cca request to cough up the correct docs or they are in default. then a further calender month to rectify the default before they have commited an illegal offence. the correspondance they have sent you looks to me like delaying tactics, which i would ignore and carry on letting their little time limit tick away. what makes me smile is that when they are hunting you down they dont bother asking you for old addresses while demanding money, but as soon as they are asked for something they make out they care about nothing more then the safetly of your data etc. thats only my guess, but i think im right, ive done a LOT of reading here the past week lol. im having probs with wescot too, ill follow your thread and i hope you kick some ass
  11. thanks gizmo, will wait and see if its the same for me - have 2 accounts with them, only heard back from one account so far..... we have a problem with wescot, but i posted seperatly about that. no more cca replies today, one week today they have left
  12. hiya all i posted on another thread a few ays ago about a settlement figure problem id had with wescot, where they accepted it in 3 parts, then when paying final one they said this wont be settlement it was meant to be one lump sum. so made me pay rest of debt in full. debt started as £650, settlement was £350 and now im left with £120. tried to pay it a couple of weeks ago but my card declined as the bank took my refund back out in order to send me a cheque. so i have just had a letter telling me to pay within 7 days, the £120. do you have any advice for something i could write to them, as they accepted settlement then rejected it when i paid the remainder? i hate these people as i see a lot of you do!! any advice appreciated as always
  13. thats what i thought it might be, but someone from this site told me that somewhere it should say total charge for credit as well as the interest, so im getting legal advice and will deffo post back!

  16. one of my creditors sent me something saying this is what it would look like, and was signed by no one at all. in the same letter they said all they would do if i paid nothing more was register a default which id be stuck with for 6 years as they were aware that the debt was unenforceable.
  17. i have a feeling doorstep recovery is only their company name, done on purpose to mislead you to thinking that they will come to your house, when in actual fact my guess is that they are operating from the same place and are actually just another dept of the same company....?
  18. Does anyone else have their loan agreement still from taking out a managed loan with hsbc? With the help from someone on this site *im sorry i dont know his user name only full real name* i have found out that a credit agreement should tell you 'total charge for credit'. my loan agreement is 4 pages long, and not once have i seen that sentance on it, and i have checked over and over again. shall be making an appointment with a solicitor for a free consultation to check things out and i'll post back, but if im right, and LUCKY lol this agreement will be rendered unenforceable;)
  19. ok i failed to pay the loan, my mum was going into hospital for an mri scan and to be honest i forgot about everything else. so now im behind a payment and have suffered another £25 illegal charge. so..... here comes claim number 2, £150 altogether in past couple of weeks. £25 of which is due out xmas day!! thing is im not sure weather to make it claim number 2, or as threatened in my last letter to them, carry on with number 1 as they ignored my request to refund the last £100 on my account. had they done that the loan money would have come out fine.
  20. That letter i was given on this thread was sent off yesterday first class so lets see what response comes of that! Just missed a payment on my managed loan account, BUT have also realised that there is a technicalilty on the loan agreement that i need to see somene legal about in order to pursue. so im not payng that, or the fee they have illegally levied on my account as a bounced standing order charge! my second claim letter should be in the post tomorrow morning. still awaiting the other cca requests, time is ticking, one week left till they default!!!
  21. what are the differences in law and validity when the ticket is dealt with by the police? mine was normal parking ticket with payment due to strathclyde police, glasgow:mad:

  23. hi there, welcome to this forum, you will get all the help and support you need here. if you dont mind me asking, how are they getting the managed loan payments now? only i think my account will be closed soon after i file all the complaints i need to against them lol and wondered how they go about getting the payments if the current account is shut?
  24. its DEFINATLY not a problem to loose this account, opened a parachutte account with my partner and we just decided to start using it right away to avoid money for xmas etc from being taken in charges which we may well get back but doesnt help at the time u need shopping lol. i will get my mum to pay the money to my loan tomorrow and ill give her the cash, that means that the bank has no reason to winge, and ill start thinking how to word my letter regarding not doing as i asked when i accepted the lower amount. im so angry i cant think straight writing to them! its one thing after another with the stupid place!
