Hi Jules, That post was really only out of interest, i have booked my car in with them twice, and neither time they had me on record that i was coming, although they took all details by phone and said i was booked in. then i got a report from them about issues that i needed to get seen to on an r reg mondeo and nothing about it seemed right, lots of work which i wasnt sure was true, and a quote which seemed extreamly high. well, first they said £450 then £950.... hmm then i got home, next morning my tire was flat as a pancake, and drivng home from AC the night before the steering had gone all wonky, not straight at all. this was after telling them to do nothing with the car as i wanted a 2nd opinion. i know theres nothing i can do about any of it, although im questioning if it was anything to do with them, i cant prove it. but i was just asking out of curiosity if anyone else had any good or bad stories about them generally.
  2. Priorityone thats what i thought, and i did think that they only held them for one week, so i should have had it back by now i think. ill leave it a little longer before contacting them, i want them to commit an offence;)
  3. Thank you Maxi, Im not sure weather to email at the moment, or wait until they have commited an offence on 29th jan? does anyone know if an undelivered recorded letter is sent back to sender?
  4. I think thats pretty much what i am doing, trying not to give anything too personal on the public forum, and there are only 3 people who i PM about anything to do with this. Their advice has been invaluable to me. (you're one of the 3 - lol )

  6. Forgot to say, I have a folder now with all docs and letters regarding the above accounts being filed away so i have proof of things, also a place for all my recorded delivery slips. Regarding my managed loan, i beleive credit agreement would not stand in court due to a technicality that someone on here helped me discover. Appointment with solicitor for free legal advice on Jan 8th. Credit Agreement does NOT say anywhere, 'Total Charge for credit'
  7. Hi TA Thank you for keeping coming and checking on me I sent a CCA seperatly on the same day, all recorded delivery, for all accounts, including seperate requests to RC. So on one account they have addmitted they cant provide what i asked for, and effectively said i dont have to pay anymore, they know it cannot be enforced. With the other account i have had no awknowedgement of the CCA request at all, only letters telling me to pay, although they are now in default. Bring on January 29th!! Heres my list so far * i have this saved as a doc on comp that i update all the time as my brain is seivelike* Barclaycard x 2 Capital one x2 No reply at all GE Capital x2 Reply received, sent SAR 18-12-06 Littlewoods Home Shopping x2 Moorcroft No reply, Royal Mail site doesnt confirm receipt, but nothing has come back in the mail as yet to me. Halifax - Aqua No letter regarding CCA, but letter offering me a payment plan of £1pm. I have ignored Reliable Collections Number 1 Reply stating they know i dont have to pay Relaible Collections Number 2 Letter telling me im in arrears JD Williams Gus Home Shopping No reply

Hey, Thanks TA for the PM, it's all confusing stuff, but a ver very interesting read Just would like to check something - the 30 days we talk about for the CCA request, is that calender days, or one calender month, or 30 WORKING days? Clock is ticking from default on Friday 29th Dec Had a letter today from Reliable collections saying that they are giving me 7 days to make payment to my account before passing it to CRA, etc etc, all the normal stuff. Should i reply to this stating that while in default no payments will be made? This letter is regarding a different account from the one that they have already replied to CCA about. Is there a template letter for this, do i sit back and wait or should i get a letter sorted do you think? All companies listed in my last post have now defaulted, so no payments going out in January to them....

  12. Thanks very much TA for the post and the PM The letter you sent me should be sent to Cabot, am i right? And a CCA to Cabot also. Still waiting on the CCA reply from moorcroft, nothing at all as yet, but like i said in my other more general post, the mail for today has not been yet so fingers crossed there is still nothing from them, and they will be in default today I wish id known about this forum a long time ago, would have saved me many tears and heartache!!!
  13. Thank you Turnaround I am going to do as you say, sit back and do nothing regarding the above accounts, as long as im not hearing anything. GE Money have a SAR to comply with now as the CCA reply was as it's meant to be, so the fight to get charges back starts as soon as we get statements from them. Will post back if there is anything interesting in the post today - ours doesnt comes until about 12.30, its such a pain when waiting for things lol

  15. Ok Rooster, thank you I'll try calling the bank and if all else fails i'll accept ive lost that payment and make sure its re directed to new account within a month when next payment comes in.
  16. lol tbern i would never have guessed! to be honest im a little confused with what my next stage should be. ive done nothing so far apart from sending my CCA, which Moorcroft default on tomorrow. If anyone knows of a letter or anything else that i should be doing about this id be glad of it, this is starting to go over my head a little but im keen to pursue!

Im overdrawn withh hsbc right now due to their charges, which i will be claiming back in a second claim against them. however my child benefit was paid in today so its gone on the overdraft. am i too late to get it back now? i cant get into the bank as im heavily pregnant and suffering spd and the only branch near us is in the city about 30 miles away. any ideas?
  18. As far as i am aware, you allow them 12 working days, plus 2 WD for postage, for them to provide the agreement. If they dont, they are in default and you can withold payment until they come up with it. if tehy still dont a further 30 days later, the debt is unenforceable and they must go through the courts to enforce the debt. if it was me, i would stop paying now, work out your dates and wait for advice from somemone else who is more sure then me. sorry i cant help more good luck
  19. Well the remaining companies are in default tomorrow, sods law a bunch of perfect replies will come through the door tomorrow morning lol. Still waiting on Aqua, Barclaycard, Capital One, Littlewoods, Moorcroft, GUS Home Shopping, JD Williams and Reliable Collections regarding another account. What is your advice once creditors default? (Assuming they dont provide them) Should I stop payments, and NOT send any letters/ reminders?

Go get em cowboy - lmao. maybe you could either here or email me some advice as to where to start, what letters to send etc. maybe wait until i am officially informed the sell was a mistake? sorry im so useless right now, i actually think im in slow labour lol so not with it in the slightest, this is taking my mind off it great though!
  23. just updating my thread so i can keep track of what im meant to be doing no more replies to cca today, maybe post being slow over xmas, but companies still default on friday this week. was wrong before, 3 accounts in total from reliable collections, only heard about one so far. letter from aqua asking if id like to pay £1 a month for 6 months, didnt reply as no reply regarding cca yet. SAR's off to GE as they complied fully in the time limit. So looking for refund of charges.
