after a meeting with the the govan law centre,mike dailly who has kindly taken up my plight informed me that you can only ask for 5 years back statements in scotland.

in scotland you can only reclaim 5 years.

i have posted a letter to both PROVIDIAN and CABOT asking for the relevant information relating to my charges. i will probably claim both anyway

i had an account with providian credit card and i missed a couple of payments and the debt was sold on to CABOT FINANCIAL. my debt when it was sold was £266(febuary 2003) ,the first time cabot contacted me was october 2003 ,8 nearly 9 months later and my debt had risen to £951. i sent off a letter to complain to no avail and was forced to pay back this amount at an agreed rate or face court action. i have since payed off the debt but ...which ****..sorry company should i try and reclaim from....BOTH?.

i'll find out more when i see the govan law centre next thursday.....i'll post the outcome of my meeting and what steps i/we should take.

i won't do anything until i take advice next week......if i'm successful with this i'm going after a few more(MBNA/PROVIDIAN) i'll let everybody know what happens next week

i received an offer of £250 as a gesture of goodwill if "i accept the sum of £250.00 as a full and final settlement of all claims i have relating to charges". up until now i had sent my first letter to them asking for full repayment,my LBA letter was sent yesterday. fortunately i stay in the G51 postcode so i contacted the govan law centre who advised me not to sign anything until i have seen them. i have an appointment with one of their solicitors next thursday morning. TOTAL MONEY CLAIMED....£1345 MODERATED post moved ... please keep to your original thread .This is in the best interest of everyone following your claim

what's my next step? can i claim for referrals and charges for going over my overdraught limit? i have £1345 charges split between a 2 year period,i take it i can only claim firstly for £750.
