  1. ZOOTSCOOT, May I ask why if the Banks are waiting for the OFT to adjudicate are they still stealing bank charges? It seems an absolute ridiculous set up, I alone have had £180 stolen this week. They should NOT be allowed to have it both ways, i.e. NOT settle fairly and TAKE charges. I would have thought they should have been asked to stop until the OFT settled on an amount
  2. Hi everyone I have had replies to my second letters, obviously they state they are waiting for the outcome of the oft case, yet they still take my money, which is totally unfair. What do I do now? We used to file under money claims online, do we still do it that way? I reading what everyone else has said, they will stay it anyway ? or do i file at my local court? and i presume they will stay it to ? Thanks a million everyone, dirty rotten banks Sarah
  3. Can anyone advise please; With the OFT test case pending, incidently has adate been set? I am owed money for charges by Nationwide and Halifax. Do I get the ball rolling by writing to them as before with the 2 letters? How far do I take it, I mean after they refuse to settle ,,, is their any point applying to the court as they are staying them in my area. Thanks Sarah

Hi I hope someone can advise me please I filed a claim after giving GE Capiatal a chance to settle as per the proformas They didn't, applied to moneyclaim on line, it accepted, and transfererd to local court where the judge stayed it. I wrote back politely explaining it was only bank charges that were stayed not mortgage charges and he has lifted the stay as I requested. It is now set for trial early November this year, What do I need to do please? HELP !! Sarah
  6. I know GE capital is a bank apparently. However I have my mortgage with them. They have done the usual and charged me over £800. I have gone through the 2 letters, issued a court via money claim online The question is The case has been transferref to my local county court. Today i received a letter saying that the matter has been stayed ??until 16 hrs on 30 sept 2008 It says i can apply to have the stay removedbut must provuide reasons. After 30/908 it will be struck off So what do I do now? Please help Sarah xXx

  9. ah you see they trying to blind me with science. I was just trying to be fair, guess no point in being fair Are all cases stayed, even those against credit card companies, mortgage companies?
  10. :p Hi All, Can anyone offer some adviuce please. I asked for Data Protection Act and got this when I totalled up everything it came to £800. They wrote back and offered me £270. In interest of fairness and due to OFT stating£12 was a fair sum, i deducted all the £12 off and came to £500. I wrote to them with this fair offer and got told "for the last time" £270 is all they will give me back. Is this correct? What should I do accept or move onto Court stage? Thanks Sarah x:shock:

  12. :) First time poster here so please be gentle. Okay I have previously had successful claims against the following just for your figures etc Halifax £4900 Halifax £800 Nationwide £750 Royal Bank of Scotland Credit card £3000 However the Halifax this time have confused me good and proper, they settled on some, and paid it into my account. So I sent them letter pointing out they still owe me £150. No reply. So not I have started the legal process to the next stage - WARRANT. But what does does this mean? How long have they got before I send the bailiffs in ? Is this a first Henry (not real name )
