Hi Dave, I’ll get back to you with that asap. Regarding suing NCP for ignoring the SAR, isn’t my case rather weak unless I find the proof of postage? I’ve just received an email direct from BWLegal: —————————— Dear Sir Claim number: *claim number* Hearing on: 29 November 2021 We refer to the above matter. As per the court order dated 09 August 2021 the Claimant is to arrange the telephone hearing. Please can you confirm that the telephone number of *My mobile number* is the correct number to use for the purposes of the hearing. Yours faithfully Nabeela Ahmed Paralegal bwlegal® —————————— Is this normal? It has also come to my work email, I have no idea how they would have my work email address! Or any email for me for that matter. I would never give a company like this my work email address.

Hi FTMDave, Thanks so much for taking the time to write all that. Apologies for the delayed reply, the email notifications have started landing in my junk for some reason. 1. I really cannot remember. The car I was in was hired from Thrifty and it was so long ago I can't be sure. They may have written me in as I was the 'lead' hirer in the company or I may have to dodge Thrifty's administration cost charges. I did do a SAR to NCP and they never responded. I've put the postage receipt somewhere safe and not cannot find it. 2. Yes you do have to put your reg in.

Been trying to log in all weekend but it didn't seem to like my mobile so sorry for not responding sooner guys and thank you for your replies. I assume this is something that has been coming up since covid struck? Am I able to fire back a 1 line rejected or will they need something more? There's no further guidance in the court documents. Off to scour other forums too!

"By 4pm on 6 September 2021 must notify the court in writing or by email whether they agree to the small claim being determined by a judge on the basis of their documentary evidence and written submissions, without attending a hearing at court. If both parties agree, the court will then notify the parties that the small claim is to be determined on the papers and give further discussions" - BW Have written to say they agree to a paper hearing. The claimant must pay the fee by 1st Nov. Witness statements and documents to the court and each other 28 days before final hearing - so 1st Nov.

So firstly I must explain, that i believe I failed to send off a SAR to NCP when I was dealing with BW before. In the time between now and the previous postings: The mediation call took place. I stated in the mediation that I did not believe I filled in the paperwork to name myself as the driver and that the hire company that own the car did that (even though its hired by my employer not me personally), nobody in my company would have done this either. However, in the interests of a quick resolution I said I was not admitting anything but I am prepared to pay a reasonable settlement. They only came back with a ridiculous offer and mediation ended with it progressing to court and now the court docs have come from my local court. I have just printed a SAR for NCP and I'm going now to mail that Special Delivery.

What an idiot I am! I went back to get these images of the sign the very next day but then got caught up in life and forgot to upload them here. I've today also received a response from BWLegal which i will upload too after editing out personal details. 14050A9C-D941-40FB-AFCD-DC98E32A7038-converted-compressed.pdf

I'm not planning on backing out now. Just wanted to be upfront and accurate with members on here. Let's play their game. From reading as much possible so far, am I correct in thinking that with some robust points, even if they were to be victorious in court, it is likely that they would have their frivolous "Unicorn Food Tax" charges reigned in? That's the impression I'm getting from other posts. Again, thank you all so much for your assistance thus far, it's sincerely appreciated!

Around the time I used that carpark quite frequently and would always pay on the App. I don't often carry change and the pay machines there were notorious for not connecting for card payments - NCP always blamed Vodafone's coverage. If my dates are correct, I had a new staff member with me on that day and we were headed for lunch. I was also in a hire car. As the hire car wasn't registered to the parking App I think it's highly likely I intended to pay for the parking when sat down for lunch but ultimately failed to do so.
