If you are a member of the gym you turn up and park, then as you walk in the front doors there is a terminal you input your vehicle registration details on and then that registers your car for the day or whatever time limit it is. I put in my other vehicle registration number in instead of the one I was using for that session.
  2. Okay, so I'm going to spend the day writing a script and then calling them. If that fails then I will write them an email and send them a letter first class with proof of delivery & continue to try and get through to someone on the phone. The car park was just a small carpark outside of my old local gym which was called Fitness Station. I will attach a photo of a sign that was put up in the car park. sign.pdf

  4. Okay, I'll get on it right away! What do you suggest I say to CEL? Shall I say that I am writing to inform them of my intention to apply for the CCJ to be set aside. Then list my reasons why? The fact that me making a mistake when typing the registration number into the terminal makes it a de mininus in court. The PCN being out of time (2 months after incident) The gym/car park owner writing to ask the PCN to be cancelled but you denied it. The gym/car park owner willing to put in writing of their wish for the PCN to be cancelled. Mention the British Parking Association's (which CEL are a part of) new revised code of practice which overturns fines for registration errors - this was revised 6th January 2020. The fact that I did not receive the Letter Of Claim due to moving address but if I would've received it and applied I would have won. Anything else I should add/remove from my letter?
  5. Yes it should be but according to CEL 'they cannot cancel the PCN as I have appealed to POPLA and had my appeal denied' Which is such a BS answer to be honest. Yes the gym owner has had no contact with CEL regarding my PCN since the CCJ, we are just commenting on his communication with them from the start when I first received the PCN.

I contacted the gym and he said that he no longer has the email that he sent to them about the cancellation, which is strange because he had the response email from them? but maybe he had this saved to send to me before but forgot. they (the gym owner) could definitely back me up saying that they have asked CEL to cancel and are willing to cancel the PCN on their end. Do you think what 'lookinforinfo' suggested would be a good idea? If I contact CEL with all this information stating that the Gym owner has written to them asking to cancel and is willing to cancel the PCN. I had accidently put in the wrong registration number when entering the gym but I was a fully paying member of that gym which is a de mininus in court. The PCN was late.
  7. Apologies, I should've said. This was at the very start when I appealed and since it got denied I didn't think it would be relevant. I will ask the gym owner for the initial email he sent and get back to you here. CEL didn't send me any photos of the car at all. As it has gone as far as the courts, will CEL still back down?

  9. Yes I did, I will put it on my PC and upload it now. Yes, I have contacted the Gym owner today, this is how I have found out that they told him they cannot cancel the PCN. The gym owner forgot to tell me about this when he spoke to them over a year ago. PCN.pdf
  10. Sorry I should have worded it better. He told me to leave the PCN to him and he would get it cancelled and then CEL got back to him and told him that they couldn't cancel it because I appealed to POPLA. But the gym owner forgot to tell me this when they told him this over a year ago now. When I first got the PCN I tried to appeal to CEL and to POPLA stating that I had put in the wrong REG as a mistake and both appeals got denied. I received the debt letters today at my old address (not my new one). I haven't responded yet. He employed CEL as there were lots of non-gym members parking in the car park. When you walk into the gym, you fill out your REG number on a screen and this is where I put the wrong one in by mistake. Do you think my best option is to pay the £296.83 to CEL as requested by Northampton County Court or to try and go for a £255 'set aside'? As I said before, I am currently a student so if the set aside may turn out costly, this is something I may not be able to afford.
  11. I contacted the gym owner/land owner and he told me that he contacted CEL to cancel the ticket but they had told him that as I appealed through POPLA they could not cancel the PCN. He had 'forgotten' to tell me that, which is really annoying considering my last contact with him, he said to leave it with him and he will definitely get it cancelled. I appealed to POPLA when I first got the ticket explaining my situation that I made a mistake but they denied the appeal. I have the letter of claim, my father searched for it and found it, he is quite old so he must have missed it which is unfortunate for me. The letter of claim was dated 8th Feb.
  12. I've just spoken to my father and unfortunately he has found the claim form dated the 8th Feb. He's quite old so he must have missed it which is unfortunate for me. I've also been sent two more threatening letters from CEL which have both arrived today at my old address, explaining the consequences of ignoring the CCJ.
  13. I am no longer a member as I am a student so have moved away from the location where the gym was. I do still have a contact number so I will call him and find out. I will get him to check to see if he can find it. It's strange that he didn't open the letter of claim if it came in the same type of envelope. Maybe there is a chance that a claim form wasn't actually sent or didn't arrive for one reason or another? If that is the case, do I have a chance of fighting this without having to pay the £255 set aside fees? I am also a student with no other income other than my student loan, so I have heard about a potential help with fees scheme that the courts do. Maybe I would be entitled to this.
  14. Yeah that's what I thought. So annoying that had I actually received the claims form this could be over by now but unfortunately I haven't been able to go retrieve my post from my old address because of the COVID lockdown and my father didn't want to open up any of my post (he only opened this one as he said he thought it looked important, good job he did!) It's also my own fault for not updating my address with the DVLA I guess, but as I no longer own a car it slipped my mind.

Okay, I have called The Northampton County Court Business Centre and they have sent over the particulars of claim and other details about the Judgement For Claimant (in default) form I was sent. I will fill out the form you sent me and post it here: Name of the Claimant ? Civil Enforcement Limited Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to. I didn't receive a claim form. It must have been sent to my old address. I was only sent a picture of the 'Judgement For Claimant (in default)' form This is dated the 8th March 2021 - It says on the form that I have a month to send the £296.63 Fees to Civil Enforcement Limited. The original parking charge claim was 13/12/2019. Particulars of Claim What is the claim for – the reason they have issued the claim? No, I was instructed by the land owner that he had cancelled the parking charge, I scrapped the car that was involved in the charge and no longer have a car so completely forgot about this and updating my address on my driving license.   16. Most likely, it was my fathers car so he did it. I can ask him to see if he has the certificate. Would this help my claim?
  17. Thank you for your help. The car was scrapped before I moved so there was no need to update the V5C. I haven't updated the DVLA on my new address because I no longer own a car so I forgot to do that. But I will do that immediately. I have the CCJ number so I will call them first thing tomorrow and then I will fill out that link. Thank you for your help.
  18. Hello All, Back in 2019 I parked at my Gym (which I was a member of) and accidently made a mistake when putting in my vehicle registration number. I received a parking fine from Civil Enforcement Ltd for £100 or £60 if I paid within 14 days, I spoke to the owner of the gym and he said that its not problem and he can get it cleared I forgot about it. I then started receiving letters from debt collection agencies saying I owe money I spoke to the owner of the gym and he said to ignore them as they are just trying to scare me, I did. Since then I have forgotten about it, moved address and the car that got the fine has been scrapped. I have just received a picture (from the new occupant of the house) of a letter from The County Court Business titled 'Judgement for Claimant (by default)' Dated for the 8th March 2021 stating that I have to pay £296.83. I am currently a student so I can't really afford to pay the £296.83 fine but I also can't really afford the pay the £255 set aside costs which is worrying me. What are my options? Thanks in advance.

  21. Hello everyone, On the 13th December 2019 I had visited my local gym and parked in the carpark as I usually do. (The gym has a camera parking system set up so that only people that are using the facilities can park there otherwise you will be issued a fine by the Private Parking Company (Civil Enforcement Ltd) This time, when visiting the gym I used my father's car instead of my own. When you enter the gym, you must type in your car registration number on the keypad inside the gym as you are not allowed to park at the gym unless you are using the facilities. Unfortunately for me, this time I had made a mistake and entered the registration details of the car I usually use rather than my father's registration number for his car. (I had only used the facilities for 30 minutes as well!) On the 19th December 2019 my father received a PCN stating that I must pay £100 or £60 within 14 days. I immediately visited my gym to let them know my mistake and to see if there was anything the owner could do. The owner of the gym & the car park told me that he can cancel PCN's but the PPC only let him cancel up to 5 per month and he had already used his 5 for the month already so he said to try and appeal it and then if that fails then he will cancel it the following month. I quickly appealed the parking charge letting them know what had happened and that I was the one using the car so that the PCN should be addressed to me and not my father. On the 22nd February 2020 I received a letter sent to me this time instead of my father stating that my appeal had been unsuccessful On the 25th February 2020 I received another PCN for the exact same offence but this time it was in my name rather than my father's name. My next step was to make an appeal via POPLA. I made the appeal explaining my situation and giving them the same information that I had given to Civil Enforcement LTD. I understand that we are in the middle of a pandemic so that I expect things to move at a slow pace but I didn't receive an answer from POPLA about my appeal until the 24th April 2020 and they had denied my appeal. In the appeal they stated that POPLA’s role is to assess if the PCN was issued correctly only. POPLA cannot allow an appeal based on mitigating circumstances. Even if the appellant provided evidence to show they are a gym member and to show the conversation with the gym owner, this would not invalidate the PCN. The appellant would be required to provide evidence that shows they did not breach the terms and conditions and the appellant has confirmed they entered the wrong vehicle registration. When entering onto a private car park such as this one, any motorist forms a contract with the operator by remaining on the land for a reasonable period. The signage in place sets out the terms and conditions of this contract. Ultimately, it is the motorist’s responsibility to comply with the terms and conditions of the car park. Upon consideration of the evidence, the appellant failed to register their vehicle details, and therefore did not comply with the terms and conditions. As such, I conclude that the PCN has been issued correctly. Accordingly, I must refuse this appeal." After this I could not contact the owner of the gym to see if he could help me out as he had closed the gym and I could not find another way of getting hold of him. I did not hear anything else about the PCN until the 26th June 2020 when I received a letter from ZZPS Limited (A debt collection agency) After I received this I managed to get hold of the gym/car park owner and explained to him the situation and he said he would contact the PPC to get it sorted for me. Later on that day I received a message from him saying that the PCN had gone too far and he couldn't get it cancelled for me. His contact for the PPC sent him this message: 'We are unable to cancel this PCN as it was appealed to POPLA. POPLA is the independent parking arbitrator and once a driver appeals to them we cannot intervene or override their decision. POPLA have reviewed the case from both sides and made a judgement in our favour - this decision must be abided by both parties'. The owner of the gym/car park said to me to just ignore it and don't pay it because he doesn't think they would do anything (probably not the best advice haha). I tried contacting POPLA, Civil Enforcement LTD & ZZPS explaining my situation again, stating that the owner of the car park has said he is happy to cancel the PCN and that I can get him to contact to prove this but I received no response from any of the 3 companies. I decided to ignore the letter from ZZPS, not the best idea but its what I was advised to do. I didn't hear anything more about this until the 12th August 2020 when I received a letter from a new company this time. - QDR Solicitors. As you can see this cost has now risen to £182 and I am determined to not have to pay this. I tried to contact QDR Solicitors explaining my situation yet again but received no response. I continued to ignore this and didn't hear anything again until the 9th October 2020 when I received a letter this time from the original PCN company Civil Enforcement LTD. This letter says it is a Claim for Debt letter. this is where I am at now with it. I am stressing out a bit and I'm not sure what I can do going forward. I have moved out of the house that I lived in with my father as I have no gone to university, however he still lives at the address. I am also no longer included on the insurance for my father's car and he now owns it fully and is the only person insured on it now. I don't want debt collectors turning up to my old house and taking my father's car away from him and/or other personal belongings when the debt is my issue. There was quite a few bits of paper included in this letter - How can I upload pictures of all the letters I have received? Thanks in advance!
