  1. When applying for the loans they ask for monthly outgoings. I was under the impression that as they did not ask for any wage slip or bank statements or Open Banking access then there could be a claim for irresponsible lending. I read the irresponsible lending guide you posted. I could have put any numbers in the incoming/expenditure part of the application and they have done nothing to verify it.
  2. Sorry what I meant by that is when I wrote the irresponsible lending complaint, I included copies of my bank statements for the months which were leading up to the loans being accepted. This was to show how many betting transactions were involved. They did not have any bank statements or banking access before any loan was accepted. I included them in my complaint to emphasise the irresponsible lending part. Does that make sense?
  3. Hi Dx. No they have had no access to any bank statements at any time. Nor have they ever asked for any. Should I send an SAR?
  4. I’ve received a response from Lending Stream which has been sent via pdf. What’s the easiest way to redact before uploading for opinion? I have attached the response letter. It seems like a pretty weak response in my opinion. On the wages part, they never asked for any pay slip. They also never once asked for any bank statements. The wages they claim I said I was earning, I have never earned. As I said earlier, In the months leading up to the loans there were some months which had over 50 transactions relating to online betting websites. As well as that there is various transactions showing I had various other loans and credit cards at the time. If I have not removed enough info from the pdf or have not done it correctly please let me know. Any help appreciated Final Response Letter 1.pdf
  5. Asked this question on another thread but was told to start a new thread for it. Just wondering if I have claim for irresponsible lending regarding a loan from Savvy. Loan for £750 was issued in October. So far I have paid back 3 instalments of £115 but the balance still sits at £645 due to interest. At the time of the loan application I granted open banking access (think thats the correct term) to Savvy to allow them access to bank statements so they could check affordability. In the month before the loan application I had 73 transactions to an online betting company. I also had two transactions showing I had two other loans. I also had a transaction showing unarranged fees with my banking company. Do I have a claim for irresponsible lending here? Any help appreciated. Thanks
  6. Thanks dx. I have sent a letter complaining about irresponsible lending now. I also sent copies of bank statements in the months leading up to the loans being accepted. They gave me 5 loans over a 7 month period for about £2000. In the months leading up to the loans there were some months which had over 50 transactions relating to online betting websites. As well as that there is various transactions showing I had various other loans and credit cards at the time. I think I should have a right to claim here. As well as that I currently have another payday type loan which I am currently trying to pay off. This one was also given to me whilst my bank statements show the same scenario (other loans, credit cards, high number of betting transactions). This one is slightly different though as I granted open banking access to the company before they approved the loan. This would’ve shown all the things I have mentioned. Do I have a case to complain with them as well?
  7. I have four defaults showing on my credit report. They were defaulted Feb 2019, 2 in March 2018 and one in April 2018. I did have a court judgement relating to one of these defaults although I don't seem to see that in my credit report although I do still have the evidence of this happening. I have since settled that debt. I do also have a couple of late payments on my report. The Lending Stream loan was taken out in June this year.
  8. Hi everyone. I failed to pay a loan with Lending Stream this year. The debt has now been passed to a debt recovery agency. Up until now I have been ignoring all communication from them although I will probably agree to pay it up at one point in the near future. However I received this e-mail from Lending Stream this week. I am just wondering if there is any way out of this debt now due to them failing to comply with this? I would guess not but I know a lot of people are well clued up on these kind of things on here so thought it would be worth asking. Cheers
  9. Judge seemed to have had his mind made up before I stepped into the court went right through me the whole time. Tried to put across my point but wasn’t having it. Never been in that situation before and hope to never be in it again. Had to pay the original debt as well as court costs which was over £200.
  10. Yes it’s on my credit file. Taken out December 2015 Defaulted date March 2018 Not sure on when it was last used but it looks like it’s October 2017 approximately.
  11. Stated client is Arrow Global. Original creditor is MBNA. Last one was dreadful. Judge seemed to have had his mind made up before I stepped into the court and basically went right through me the whole time. Tried to put across my point but wasn’t having it. Never been in that situation before and hope to never be in it again. Had to pay the original debt as well as court costs which was over £200.
  12. Received a letter today from OPOS (a DCA) saying they have now been instructed to collect the balance owed for a credit card I had a few years back. The debt is roughly £2500. The situation is exactly the same as my previous issue I had which I posted about on here in another thread. Wasn't in a good place at the time of these credit cards being taken out. Where should I start off with this lot and are they likely to take it all the way to court like the last mob did?
  13. Case management discussion tomorrow morning dx. Any tips? I don't really have much to say in the matter other than sticking by that the charges should be removed? Is there anywhere I can read about this reading in 2006 to back me up any?
  14. Yes do you think I should go and fight my case? I always try ought if it got to this stage with an in court appearance I’d just accept defeat and pay it but after you mentioning the charges thing I think I’m going to fight my case now.
  15. Notified the court I was unavailable for the scheduled hearing on Monday but I sent them my defence as well as the letter I sent to Nolan’s and a copy of the spreadsheets. Also notified them I had contacted Nolan’s with the evidence but had received no reply. Ive now received this. Any thoughts dx? Order of the Sheriff.pdf
  16. Just over a week on and there’s been nothing from them. Safe to assume they are ignoring it and will just be hoping for a result from the court?
  17. Would there be any harm in e-mailing my response to them with the excel sheets attached to possibly speed up the response or would it be preferable to do an old fashioned letter?
  18. Going to get this letter typed in the next couple of days. Should it just be sent to Nolans? On it I should have what I am willing to pay and why that amount? Also mention about the bad gambling habit at that time which is proven throughout the various bank statements. Should I mention the change of address?
  19. It certainly is. What should be my next step? I'd quite like to get Nolans/The Court notified of these sums before the next scheduled hearing.
