  1. Ok thanks HB I'll take a look. What's the success rate of individual drivers going to a small claims hearing & defending themselves, seems slightly daunting given I've no legal experience and only been in a court room once about 35 years ago! Regards

  3. Yes my vehicle is hired from the company I worked for, making me the hiree right rather than the hirer. I'll get in touch with the parking dept and try and get a copy of the original PCN which would've gone to them initially. Interesting what you said about being in arrears etc. Regards for the info

  6. sorry for the delay in replying to this one, I've attached all correspondence in relation to this parking charge to this message. Just received latest communique last week from the debt agency threatening court as the next step.   7. Yeah I think they're better at sending out threatening letters to intimidate people rather than any legal accumen! I've actually just sent a email to the hospital PALS asking if they have the power to cancel it, I really should've done that at the very beginning rather than at this stage! Let's see what they come back with anyway That's good to know Sorry out of the loop a bit with these acronyms, what's a CPR? Can I still SAR NPC at this stage? Hi FTMDave, I'm not sure exactly but it must've been just prior to the date of the parking charge because as a London cab driver we visit that hospital every week or so and I never had any problems previously and had always parked in the same spot, sometimes waited there for 15 mins or so. Also if you look at the attached Google image from street view, I've circled in yellow the area on the road where I used to stop to pickup or drop passengers and also the area where NCP has since installed the "No Waiting" sign - I'll swing by there and post up a picture of what it now looks like when I get a chance this week.   9. Lol thanks for that, a polite way of telling people to F off I find! Yeah I used the Arkell v Pressdram instruction to Smart parking for a Southend Airport PPC a few years back, always a goodie! That's very interesting what you said about the old PCN 's, some as old as 6 years, wow - I'll take heart from that! In terms of the St Thomas's hospital drop off, you'd been able to drop at the bottom of the entrance ramp for years and years no problem. All of a sudden NCP take over the parking contract and they put up "no stopping at any times" signs and cameras and have a field day no doubt charging every poor, unsuspecting Tom, Dick & Harry who drives down the ramp to drop relatives, customers or whatever. They must've made an absolute fortune because as I said people were in the habit of dropping there for decades, then it suddenly changed, and nobody realised for a while, I still see poor suckers stopping there now! I was there for literally 90 seconds dropping an alcoholic guy off for a detox clinic with his carer as a minicab driver yet they want to take me to court, ruthless bastards! I'll post up a picture of the sign that NCP put up at the time indicating no stopping. Thanks for your comment, I always find the stuff you post very helpful .   10. Morning folks I've received a claim form pertaining to a private parking charge at a London hospital after having heard nothing from them for well over a year! I thought the matter was closed since I had not heard in so long and I haven't retained their original letters trying to extort money from me. I do have the letters on Google Drive in response to them though which I have attached here, I also attach a copy of the court claim document , please advise on how I respond to this, Many thanks My Letters+Claimform .pdf
  11. Hi folks I'm fighting a parking charge on private land in my capacity as a London minicab driver. They've been sending the usual letters from them and later their attack-dog debt collectors. I've found that a subject access request tends to back these PPC's off when you eventually send one as they realize its too much trouble and expense to continue to pursue. I sent a SAR back on 16th Dec 23, one to the PPC and another to their debt agency and they totally ignored it and sent the usual letter chasing their money. I contacted the online chat help with the ICO who told me by ignoring the SAR they were essentially breaking the law and to submit a complaint to them regarding the PPC. I sent a strong letter to the PPC (attached ), a couple of weeks passed and they sent the SAR back saying an administrative oversight was responsible for them missing the original deadline. my question is, do they have a legal leg to stand on now pursuing the parking charge since missing the SAR 1 month time limit? Shall I send another letter such as the one attached I'm thinking of sending? Many thanks in advance do they have a legal leg to stand on pursuing this parking charge SAR letters.pdf
  12. That's good to know, most of these PPC's turn out to be paper tigers in the end. The only time I came unstuck was at Southend Airport a couple of years back when after much help from you guys on here, I thought I had them beat only to find a ccj had been issued without me knowing how since I didn't receive the court docs. Maybe the letter of claim went missing in the post or something I'm not really sure. Anyways I appreciate all your help and info, you certainly seem very knowledgeable on this. Regards
  13. The only thing I received was the original speculative invoice from the ppc and then letters from the attack-dog debt collectors OK many thanks, I'll get things amended and post it off with proof of postage Regards
  14. All very helpful, useful info folks thanks a lot. Couple of responses to the above from you, yes I thought it was 20 mins but as I was only in there 18 mins I guess it must be 15 mins their allowed waiting time, but it doesn't state anywhere what it is. Maybe I'll swing by there and take a photo of the sign they usually post up at their sites. It sounds like F1RST and a toothless tiger so to speak judging by the lack of cases they've pursued and I'm not moving anytime soon so there'll be no backdoor ccj they can claim an easy victory with. Noted about the appeal DX, I'll come here in all future instances before doing anything and outing myself as keeper etc. Addison Lee does have a parking dept but I've found them to be pretty useless in the past tbh and limited in what they'll do and their knowledge. I think it's better to have the knowledge oneself rather than rely on a dept or whatever to take care of it, knowledge is power and all that. Plus it's been a good while since I fought one of these so my knowledge and experience is very rusty but I'm making notes and will always come to you lot first for advice before contacting the PPC in future. In the meantime I'll post that snotty letter off, kind regards

  16. Sorry about the delay was away for a couple of weeks. No I had a clear out of lots of old correspondence related to old PCN's etc plus other documentation that's no longer needed and probably slung it out along with that other stuff. The only correspondence relating to this one is what I still get from the debt collection agency chasing it as above.   17. Hi folks not been on the site for many months due to thankfully not having any disputes recently. This one here they've been pestering me for a few months now due to overstaying the allowed 20 mins taxi-pickup time outside a block of flats in South London. Just posting to ask if this is still at the ignore stage, as you can see it's headed "letter of claim" but this is not an official court proceeding started by the PPC, rather it's just more badgering with official sounding wording courtesy of the PPC's attack-dog, debt collection agency right? Something to the effect of: "Please desist from contacting me regarding this speculative invoice, otherwise I'll see you in the small claims court - in which case please bring a cheque book as I'll be seeking full costs recovery through a recovery order. Until then I'll refer you to Arkell v Pressdram, act on that!" Good enough, to the point etc? I don't need to put in anything about being a cab driver etc trying to pick someone up or anything?
