Hi all. lost my case. I can not remember all the legalese from their BARRISTER, but the essence of it is that the judge ( whilst expressing sympathy with my case ) did not agree that airports act supremacy ( upon which I relied ), applied, and VCS were justified in issuing a notice to me, due to their contract with the airport. Her reasoning was that it remained a private road, unless it were a road like the M25 going through the middle of the airport, which is clearly a public road, and that airports can not have people stopping or parking where they like, or it would cause chaos. Not happy, but have now paid the charge and costs

Hi all. Court hearing today. Logged onto video link, having taken another day off of work. Judge could not locate either defence or prosecution bundle because of Covid ?????? Adjourned to a date yet to be notified !! Ridiculous!!!!

Great news. mine was adjourned in January with a new date to be arranged ? maybe they won’t bother

Received an email today. Tomorrow’s court date has been adjourned - “Unfortunately, we are having to vacate this hearing due to a lack of judicial time. We have not been provided a judge by the Judicial Secretariat to sit on the hearing.”

Hi I received an order from the court today stating that my case will now be heard by video link ( which I am struggling to set up on my iphone It says that the Applicant must submit a paginated, tabbed, and indexed electronic bundle to the court. I have already submitted my bundle to the court ! The order is in PDF form below. SO Am I the applicant ? Do I need to submit by email a paginated indexed and tabbed electronic bundle as the defendant ? The order mentions that the parties shall seek to agree this bundle ! Hi Dave Yes I am sure the access road fits the legal definition of a public road and highway. I have today received by email VCS' Claimants bundle. I have attached the VCS service agreement with the airport in PDF Format - redacted. I cant see anywhere in there that VCS are permitted to form a contract. I will be sending them my bundle tomorrow, by email, as I have covid, and am not allowed out to post it properly. I got this authorised by the court too. Any observations overnight would be appreciated for any last minute tweaks to my statement. Hi all Things are progressing !! I checked with my local court, and VCS paid their hearing fee in time, so it looks like we are set to go to court ! I have typed a draft witness statement which I will attach below ( redacted). Hi All Received a notice of allocation from my local County Court, for January 2021. I am beginning to think about my witness statement, and upon looking at the original NTK , note that the alleged contravention was actually Rule 47 ( Bus stop / Stand) 1. What exactly is that contravention of ? Rule 47 of what ? ??? It is not specified on the notice to keeper. 2. Will this make any difference to my claim ? 3. A year ago now, so I cannot remember a bus stop, and the pictures on the NTK do not help, and its likely to have changed since then even if i go to take pictures. Any advice ? Thanks

Hi all, I have today received a N149A Notice of proposed allocation to the Small Claims Track. It asks me to complete a form N180 - Directions Questionnaire, and to return it by 03/08/20. I assume that I refuse mediation and refer the claim to the small claims track ? Then return it to the court asking for a hearing at my local court ? ALSO Should I send a hard copy to VCS Solicitor by recorded delivery so that it has been served upon them ? Thanks

Received acknowledgement of defence submission from court. VCS now have the option of continuing their claim or not. Watch this space !!!!
