The landowner uses OPS to issue tickets and chase motorists for payment, but if you look at the contract you will see that he gets 100% of the PCN revenue- 9 d) All PCN proceeds collected by OPS in payment of PCNs shall be submitted directly to the Customer's bank account and the Customer shall be provided with a reconciliation detailing payments received.
  2. It's the landowner's camera and ticket machine. He (ARW) has got planning consent, but OPS haven't. Power for the camera and the machine come from his pub, The Ship Inn.
  3. The planning consent for the cameras and ticket machine can be found on the Ceredigion Council website. Type in the postcode SA44 6SL. The application number is A191011. They are 0.46m x 0.46m, ie 0.21 sq m. Planning permission is only needed for signs over 0.3 sq m.   4. This is why Frustration of Contract is a very useful point to include in your Defence. You were prevented from paying for your parking.
  5. The BPA sent their local rep to investigate this car park a couple of years ago. He found it impossible to pay, so he left the car park before he got a PCN. His report is on the Llangrannog Welfare Committee website. A bit of background: the Ship Inn and the beach car park are owned by Eastmoor Trust. Anthony Ramsey Williams was the trustee but he has now retired and his son and daughter are the Trustees. Google Campion Gardens Retirement Village in Swansea.   6. I would advise appealing to POPLA. Have a look at the British Parking Association Code of Practice and use all of the points where OPS have not complied with this in your appeal. I did post a link to a guide which helps you with a POPLA appeal but it was removed.
  7. When you logged in to their website to appeal, did you see the evidence photos? Did any of the photos show who was driving, or were there only photos of the car?
  8. All the OPS landowner contracts I have seen have a clause where the landowner has to pay OPS if they request cancellation of the PCN. This cost increases each week. So the sooner you ask the landowner to cancel, the cheaper it will be for them. After 4 weeks, the landowner usually has to pay the full cost of the PCN to OPS if it is cancelled.
  9. You are quite rightly furious because you are a victim of the PPC's scam. The only people who can cancel your PCN are the landowner (not the managing agent or the estate agent), OPS or a district judge. In my opinion it is worth appealing to POPLA because if it eventually goes to court, this demonstrates to the judge that you have been reasonable, and the parking company have been unreasonable. In 2019 private parking companies issued 6.4 million PCNs and there were 11000 court hearings about private parking tickets.
  10. OPS reject most appeals. There should be a POPLA code in your rejection letter. There is advice about appealing to POPLA : You could also find out from the Estate Agent who the landowner is. You can then contact the landowner and ask them to get the PCN cancelled.
  11. Private Parking Companies are audited by the DVLA and the GIAA (Government Internal Audit Agency). They receive ratings of Green, Yellow or Red. In the past, PPCs could be suspended or have their KADOE contract revoked, but this doesn't seem to be happening any more.
