Hi Louise, I am also due in court tomorrow at 10am, and called the court this morning to find out if they had received anything from SC&M - they told me that they had been informed today that they would be settling the claim in full and not attenidng. I called SC&M to confirm this and they said that they were not obliged to notify me in writing, only the court. I am now faxing through a letter to the court confirming this conversation, but drawing their attention to the fact that I have received no official confirmation of this and reserve the right to resume the case if necessary in the future.   3. Hi - I'm due in court 13th Feb - all my papers have been filed but predictably, SCM have missed the Tuesday deadline for submission of evidence. I rang them to chase and the guy said: 'That's assuming we need to submit any evidence, we might not want to.' Anyway, there has been no mention of settlement as yet, and just nothing but attitude and aggression from SCM - feeling very daunted! As I don't have a Lloyds Bank account, settlement would need to be in the form of a cheque, and i'm really worried that even if they do settle, I won't receive anything in time to call off the court date? Any ideas? I'm printing out the first letter as above and faxing it through this afternoon. Many thanks, Sarah
  4. Thanks both, GaryH - thanks for your note - I hadn't honestly realised the extent of info I needed to send in so am going to sort through it all this week. I do have one problem though - when Lloyds sent me through my schedule of charges, they only included two pages of statement (for an account I had with them for approx 2 years) for a 6-week period which includes two of the four charges I am claiming for - All the charges are listed on the schedule of charges they sent me, but there are no accompanying statement sheets for the second two charges. I didn't question this at the time as I had successfully claimed with HSBC and Natwest without these (using a schedule of charges) and now i'm wondering if I might have caused a problem by not pursuing it? Like I said, they only sent me two sheets of A4 pages for a 6-week period so i'm not sure what to do about this? Any ideas? Will the schedule of charges be enough with the information they have provided me with?? Thanks, Sarah
  5. Hi all, I hope you all had a very merry Christmas! I have received a letter from the county court scheduling the case for Feb 13th. Eeek! From what I can gather, Lloyds seem to hold off settlement until the very last minute, and then have been depositing the funds into customer accounts. Thing is, I haven't been a Lloyds customer for many years so don't have an account with them - should they pay out (fingers crossed!) do they send out a cheque or something? Have had a look through a lot of threads but can only see settlements from current customers - sorry if this is a dud question! Thanks, Sarah
  6. Hi there, I submitted my claim against Lloyds to MCOL on 10 Nov, and on 14th they completed an acknowledgement of service. I have received the copy of this, and have sent in my schedule of charges etc as required. But today I received a leter from Lloyds saying: 'Thank you for getting in touch with us. I am sorry that you are unhappy with our response to date. We see from your letter that you have already issued a court claim for repayment of these fees and that our solicitors are dealing with it. As that is the case, apart from explaining our position, I don't think I can do more to help you at this stage.' Has anybody else received such a letter? I'm not sure why they've written it, or if they're just trying to be a bit threatening?? Any ideas? Thanks, Sarah
  7. Hi there, I'm trying to complete my MCOL claim for charges from Lloyds TSB. I have completed the claim as far as it directs on the thread: http://www.consumeractiongroup.co.uk/forum/bank-templates-library/34887-5-money-claim-line.html But I have a few problems: a) I did not ask my bank to repay the interest charges in my original LBA etc so should I leave it out here to? b) If I SHOULD be claiming the contractual interest, despite reading through the spreadsheets etc, I can't work out dates from/to the interest should be charged (I am claiming on an account that was closed 3/4 years ago) c) Where do I enter the £10 charge I paid to Lloyds for release of my data (statements etc?) d) At what point do I outline the contact I have had with the bank re. this case? e) Do I need to send copies of my statement of charges etc and copies of correspondence to the courts, and if so, when? Can anyone help me? I am getting really frustrated and going round in circles! Thanks in advance, Sarah
  8. HI there, Thanks for that - the letter I received after my preliminary request was a lot less personal than yours - far more generic and came from customer services. I just want to compare this with other to ensure one of the points is the same regarding the banks interpretaion of 'default' charges. I know a lot of people received this letter and I just wanted to compare mine with others. It contains the paragraph starting: 'Of course, it is only fair too that we're completely open about any charged-for services before you take them up. Etc....' Any suggestions? Thanks, Sarah

  11. Thanks again Empire - it seems quite a daunting prospect I guess, so i'm a bit nervous about it, though as you say - loads of you have done it, and with great success so that's reassuring! Interesting how they try to drag it out, though I guess that works in the claimants' favour as the interest simply adds up??!
  12. Thanks Thailand!! Lol!!! I didn't meant to sound complacent about the figure - to me, that is a lot of money (I am unemployed) but I meant in comparison to some of the other larger claims that seem to be mentioned here.
  13. Empire Strikes Back - thanks for your advice, My account with Lloyds has been closed for a few years now, but i'm still within the 6-year limit with these charges. By gone to court, I meant filing a claim at county court etc - apologies for the confusion - and Bookworm - I think you need to sort your attitude out. Sarah
  14. Hi there, From what i've read here so far, a lot of LLods TSB cases regarding bank charges reclamation seem to go to court? My charges are only £112.50 and i've claimed back similar amounts from Natwest and HSBC with little effort, but I am concerned about the possible costs of this one with Lloyds should it get as far as court - what do people here think?? I know it's a risk involved with any claim, but as the amount seems quite low in comparison to many others, i'm not sure what to do, though on principle, I don't want them to keep charging people like this and want to win!! Any suggestions? Sarah x
  15. Hi there, I'm new here and currently trying to claim back unfair bank charges from the last six years (for example, one instance - £112 in charges for being overdrawn by £4 for ten days!!!). In tallying up the total costs, there are several hundred pounds worth of additional charges for using cashpoints that aren't my banks 'own'. These are predominantly from 2000-2002 but it comes to quite an amount. But i'm not sure if it is possible to claim these back? Does anyone know? I don't expect it is but i'm just trying to make sure I get everything right first time!! Thanks, Sarah
