  3. ianmc, that's interesting that they phoned with an offer, I sent BOS my LBA yesterday for £940, (first of a few claims through scottish system) Good Luck Maggie, we are on the same timeline so I shall watch your progress with interest. T

It's now getting a flow to it, every few days I have something else to update then a lull then it's action stations again ...... time will soon pass quick enough, and maybe they will be bombarded with so many they realise their numbers are up ..... okay time to wake up, but it was a nice dream T

  7. well LBA sent as I've heard not a thing from them, funnily enough though they've sent an acknowledgement to hubby's claim. T
  8. I got an acknowledgement from HBOS from my prelim letter within 4 days and then nothing ...... have just sent off my LBA today so 14 days and counting or it's the Sheriff Courts we go ...... T

Good Luck Caz I am still waiting on my statements from HBOS and am not holding my breath, thankfully I have 18 months worth of statements here so am pursuing them for this timeframe whilst I am waiting ... There was a question mark over when we can claim the 8% and the mods were working on it over the weekend, I haven't read any outcome on this yet though. T
  10. Fiona, As you are in Scotland you'll need to break your claim down into batches of £750 via Small Claims or £1500 via Summary Cause. Our limits up here are pitiful compared to our English friends ...... Good Luck T

Hopefully someone more experienced than myself with come along, but if it was me in the same position (and I am not sooo different, as I have commenced my first claim whilst waiting on the remaining dates coming through via my DPA) I would insist on the removal of the full and final clause ...... it is of course your call .....   13. The advice given to others with similar offers is to write accepting the £731 as an interim payment whilst you continue to pursue them for the balance of the amount outstanding. They would not accept you paying as full and final on a loan from them a paltry 10% of the loan amount would they?! Why should you? I do understand though that you could certainly use the money I know I could, but I will be hanging off for every last penny from them. Just my 2p worth. T
  14. Just throwing in another question into the mix, did I not read though that HBOS state in their T&Cs that Scottish Law will govern over any proceedings by or against them? T

Have been spreading the word about the great help on here, I know mine is going to be a long process but I have all the time in the world .... I am not going anywhere until I have every penny I am due back. Thanks for the encouragement. T
  16. fruitycar, we are on the very same path aren't we !! lyndaalex I would say try the lba for the full amount if you get no satisfaction then when drawing up your court papers break up your claim into smaller bite size chunks of no more than £750.00 This was the advice given to me, and to search this forum for other threads on "severing" your claim. hope this is correct, recheck FAQ's to be 100% honey T
  17. got my acknowledgement from HBOS, from Gurvinder Gill, who has sent me a standard letter but with spelling errors which have not be checked ..... apparently I unhappy about the level of bnaking charges on my account .... okay, at least even if the format is standard they have actually typed it up manually .... oh and of course telling me I will receive a reply in no more than 4 weeks ......priceless. T
  18. whilst I understand your frustrations, you have to understand that all advice and morale boosting on this board does not replace research and,where appropriate, official legal counsel.... as mentioned above all is not lost, but please do not shoot everyone down in flames when there is a setback .... i wish you well and hope you are successful in your claim.   20. Hi Guys I think the time has come for me to start my own thread on my saga (which I am sure it will become in the course of time) in reclaiming my penalties. I have 2 live easycash accounts which I have 18 months of statements saved. 03/7/06 Data Protection Act to BOS for the previous statements back to 04/7/01 on both accounts and 5 years statements on a bill payment account which is now closed. 04/7/06 Prelim letter requesting £940 back from account 1 for 18 month period I have statements for. If we go to court then the penalties split nicely into overdrawn penalty and returned DD's so that I can claim under £750 each time. (Am pending account 2 until full settlement of account 1 for this period is up, then I shall be applying for the remainder as normal. I just feel in the 40 days allowed to get the statements in we can be well down the road with the existing statements procedure. As long as I do not agree to a full and final settlement on the account, I will be able to reclaim time and again until all charges levied on me in the 5 years have been reimbursed to me .... ) Correct?? I have read and reread the FAQ's and discussed at great length with another member on the board to make sure I have this straight as far as scottish courts work. Any feedback or advice will be warmly welcomed T
  21. Give Me It Back, that's what I was thinking, surely the onus is on the Bank to prove the charges are reasonable and right not us to prove they are not? Perhaps the initial DPA response will show no manual intervention and as such all charges were applied by an automated service, which could not possibly cost £39 for each letter .....?? T

  23. Decided to get the ball rolling with the statements I have here on the 2 accounts, as your say Give Me It Back, I will have a long slow process claiming back at £750 a time so be as well starting now. So first letter request now sent recorded delivery. Thanks for your help. T
