I am in exactly the same boat they have until wednesday to enter defence or acknowledge.... bit scary but very exciting there is no other outcome other than nice holiday for me and a new claim for 1995 - 2001.... I am going to try and go back in 6 year chunks since i started work 18 years ago.... Maybe they will take me to court or something I hope they do,
  5. most of my communication with egg and capital one has been via email keep copies of what you have sent and dates as I do on a word document on a pen drive just incase they do not let you into their site anymore as abbey have done with me...once you file a moneyclaim it appears they no longer respond via email anyway or at least that has been the case with me...

    they are changing tactics due to volume I think as they posted mine and charged my egg card the £10 within 10 days received 5 years from 2001, last year is online... dont give in!!!

  10. I have got a 3k claim and I am considering it, see how far they are prepared to take it.... would have to take legal advice... But for all the messing and heartache this bank has caused me over the years.... I would like to air it all... I am also keen to see how far we can actually claim back as when I was student i wasted sooooo much on huge charges every month it was incredible... but this site didnt exist then unfortunately....

  12. some people are trying to claim back further but if you claim back for 6 years and it is less than 5K then this is ideal.... then maybe there will be evidence of claiming back further and you could co for the rest.... keeps everything nice and easy for now.... spend some time reading some posts

I think there is 2 ways this will go.... the masses will start this reclaim and they will just capitulate and pay up immediately and make there money in other ways... or they will try eventually to win a case in court ( this would be unlikely unless OFT did a massive u turn, this would lead to a revolt so extremely unlikely) .... at last a little bit of justice, not something we seem to see very often in the UK...

Abbey National PLC Abbey National House 2 Triton Square Regent’s Place London NW1 3AN Hi this is the address I used, DPA request first allowing 40 days, then prelim letter 14 days then letter before action 14 days, then moneyclaim... be prepared for a fight as abbey have tried every trick in the book to delay... lets hope the trevor macdonald programme last night speeds things up and not slows things down???? good luck!!!!!
  18. just got £384 from a £697 claim, sent mail today giving them 7 days for rest moneyclaim if not.... my first result 5 more to go, I have started my own thread but just thought I would share with this thread.... yehaaaaa power to the people what should we start on next, strength of number is powerful, come the revolution......

I have just logged into my account today to find capital one credit card have just refunded £384 from a claim for £697 so a success in small part here is the email I have just sent: I can see them squirm as we speak can a mod respond if this seems a good cause of action?????? Hi I have noticed today you have credited £384 out of my claim for £697. Please note if the balance of the charges including this months late fee of £20 ( total £333) is not returned, my course of action remains the same and my county court claim will continue, I have postponed my claim until 13th June allowing you 7 additional days to respond in a satisfactory way your sincerely

  22. hi not sure I think they are doing well stalling because of statements for 6 years, check out my letter in parkes thread... I am happy to go all the way with my estimate, it will only cost me £80 ....if it all goes wrong which i doubt!!!!!! did you try calling them for these charges to be returned as they usually would for this amount????

  25. hi not sure if this is the right way to go but I requested 6 years from barclaycard and got 2 years, i worked out how much they had charged me in 2 years and multiplied by 3. here is the prelim letter i sent, i assumed if they where to argue and wanted to go to court then they would have to provide the six years information anyway as they had breached dpa, and I would be happy if it was less as long as it was what i had been charged. I highlighted that it was estimate due to lack of statements they were able to provide.... maybe moderator can see if this is a good way to go I will keep you up to date LBA due out on 7th june....then moneyclaim 14 days later.... DONT MIND TELLING JUDGE IT WAS ESTIMATE AS BARCLAYCARD DISREGARDED THE DPA 1998... copied this from parkes v barclaycard this is what I am trying see what happens??? I always request email from them to say they have received letters so I have copy if it does go to court.. Customer complaints department Barclaycard 1234 Pavilion Drive Northampton NN4 7SG 24/05/06 Dear Sir/Madam, CARD/ACCOUNT NUMBER: I now understand that the regime of fees which you have been applying to my account in relation to late fees and over limit charges are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. *I estimate that you have taken £1680 plus £134.40 which you have charged me in interest for the sums which you have taken. Total £1814.40 Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account. *The reason I am estimating these charges is that you say you can only provide 2years information (may 04 until may 06) under the data protection act. I find this to be untrue and unlawful and a separate letter will be sent to the information commissioner to report these actions. I am willing to be advised if this amount is incorrect of the true amount, once this information is received and then can be adjusted accordingly. In addition to full payment of the sum mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. I require repayment in full of this money and removal of the default notice.
