I'm just about to take the halifax to court for the second time but I thought i would give them one last chance and I phoned them up, they just told me that last time I made a claim I signed a paper saying I had excepted their last payment as a full and final settlement and I cannot claim again. So basically they said fine take them to court. Also since I started the second process of claiming my bank charges are still adding up, can I add these to my total before I file my claim? or would I have to start from scratch? Cheers.

Hi, At the start of the year I set about reclaiming my bank charges over the last six year period, after going through all the motions and the halifax fighting tooth and nail all the way to court the finally paid up. I am now in another position where I would like to claim back more charges from them that have happened since my last action. Do I just send them the same letter as before or do I amment the part that states 'all charges made on this account in the last six years' to the last 8 months. Cheers.
  5. Thanks, Just remind me what an LBA is. You can read my whole drawn out case in my previous posts, but in short: I sent a letter giving 14 days to refund full ammount. They sent letter whith a form for me to sign to accept half the money back, and to shut up and go away forever.. I sent another letter saying NO THANKS and gave them seven days or court action to follow. Seven days later court action submitted. Thirteendays later payment made into my account!! (halifax)( even though I asked for a cheque! so I could pay it in to my new bank account(natwest)) day seventeen snotty letter from Halifax. day twenty, letter from court, halifax have entred a deffence ( this is what I do not understand) Hope that helped.
  6. I turned down the part payment the halifax offered me and started legal action after seven days Claiming for the full ammount plus interest and costs. Thirteen days after I had made the claim I went to the claim website to see if they had done anything yet and they had accnoledged the claim, I was hoping they were not going to do anything! I then checked my bank statement later that day and two cash payments had been made totaling the full ammount they owed me! So I went to the bank to find out where the money had come from and it had come from halifax customer support. Two days later I got a snotty letter from them telling me the usuall crap and that it is cheaper to pay me off that send a barrister to court blah blah blah...manage your account better ect.. Anyway, I have the money now, but what do I do about the legal proccedings as they have now entred a defence! and why would they do that. do I just ring up or write and cancell the action?

Hello all, I'm In a bit of a dilema over what to do with my latest letter from the halifax, I will try to keep it short and simple as there have been more than a few similar situations occoured in other threads: - I totaled up around £500 of charges at christmas, these were taken out after giving seven days notice and seem as though I get paid monthly when they took the money out the money was not there so they took it anyway and charged me again! - I was seriously annoyed to say the least so I phoned them, went in to see them and asked for the charges to be returned and all I got was p****d off. - Then I found this site and i have started to get somewhere..I sent them the letter from the libary asking for the charges back and for a list of my charges from the last six years, one to my branch and on to head office. - After a few weeks I started to get phone calls from the branch saying they can't refund them and to manage my account better ect. - Day 36 after sending the letter, I managed to get the phone number for customer relations (01422 333465) and they informed me that they had sent a letter out that day. -Day 37, Letter arrived: Quote 'we are commited to complying with the banking code, which sets standards of good banking practice for banks and building societies to follow when dealing with personal customers' That part just made me laugh.. -they also sent me a list of my charges from the past six years with a total of £1189 along with an 'ACCEPTANCE FORM' that they asked me to sign 'IN FULL AND FINAL SETTLEMENT' for the ammount of £414. - I do not want to accept this amount as I want the full £1189 back as it is mine, I plan on sending them a letter giving them seven days to settle the amount in full or I will start legal action, but I'm not sure of things I need to state or include in this letter. As you can probably tell letter writting is not my strong point, Is there anyone else who has had to send a similar letter that I could use? Or just a list of things I need to say or include would be most helpfull. -Do I just ignore the 'acceptance form' And yes I will be using a spell check before I send them a letter... A quick thanks to the moderators of this site, I would not have had a clue of where to start without this site.
