  4. Hi, After reading here, in the debt forum and after a recent SAR I did for someone I am helping it appears that MBNA are advising people to obtain further credit to settle their debt with MBNA. This is a big no no and should be reported to the OFT (someone give me a link to the form I will put it here and edit this). If you have been in this situation I would advise complaining, it doesn't take long and if enough complain the OFT may decide to take action. A show of hands would be a good start.

  7. Just like to add, that the shopping question is usually asked by most councils. If you do shopping for someone and it only has to be once you can be classed as living together. Can I have some more details? How many times did you stay a week? Did you bath or have tea there? It's really important and you will be asked these questions at court. Just for your info the "3 nights a week" rule is fiction. It's all based on circumstances and whether the court agrees you were living as partners.
  8. I agree with this, sound advice. They can reconstruct one to satisfy the CCA but will have to produce the original in court.
  9. There's been some good advice here. Don't be afraid to ask us anything else either. You mentioned insurance on the loan. I would possibly post in the PPI section to see if it was mis-sold. It would at least ease the pressure a bit. Also ask her what her payment history was like, you may be able to recover at least a little bit. These situations are never nice, I feel for you and hope you get to sort it out. Like I said though we are always here if you need us.

  11. I would do this too. If anyone has evidence of anyone circumventing the legal process they should let everyone know. If certain companies are abusing the system by going straight for a charging order somehow it's extremely naughty.

  13. Hold up, I'm helping a friend with Abbey/MBNA at the moment. Guess what the first thing they told her to do was? And it was phone only. I did an SAR for her and they included the details about advising her to get a loan. OFT here we come.

  15. Hi, Paul is saying that a charging order is a long way down the process. You would have already have had to of had a CCJ. Once a CCJ is defaulted on then the creditor applies for the charging order.
  16. Going for fast track is a scare tactic. You can say that you believe it is straightforward and stay on small claims. They go for fast track because of the costs awarded if you lose.

  18. LOL, Nitrous Oxide is laughing gas! Think dentist or pain relief in hospital (gas and air). It's also used to increase the power of engines Anyway 8% seems good, although you probably paid contractual. You'll probably find they will pay up on 8%.

  20. If the police were not involved and it's not proven theft I'd be tempted to say the judge will dismiss it. And yes, I would be asking why their insurance didn't get involved. I'd also ask for proof of ownership.
  21. The "theft" would have needed to be proved, and proof is on the claimant. This would be easy to defend but would mean giving up your address.
