  1. Last contact with Zinc was on the 26th September. It has been 2 months and I haven't heard anything from them or anyone else. Perhaps this is the end, but as it was demonstrated last time, never say never with harlands. What do you think is next?
  2. By ref number you mean my debit card number? What if they try taking out their alleged "debt"?
  3. I'm moving into a new apartment on Saturday. I'm going to update everyone on my credit file about my relocation. Should I also tell Harlands/CRS and Zinc? CRS have backed off but Zinc have been sending me a couple of phone calls. Ofc I keep ignoring them.
  4. Hello again guys. After another 3 weeks of silence I received a phone call from Zinc group today. I told them IWO and hung up.
  5. I'm moving out of my apartment and back into my parents house for two months. I'll be moving into a different apartment in September. Should I inform Harlands/CRS about this just incase they send mail to my old apartment? Or is a postal redirect better.
  6. This has been going on for 6 months and it doesn't look like they're going to stop anytime soon even though they went silent for 2 months. Received an email from Harlands/CRS on 08/06/2018. It is the one threatening legal action or passing onto Zinc. Received the exact same email on the 27/02/2018. Word for word. Also received phone call today and on 06/06/2018. Ofc I did not answer. Text messages on 18/06/2018, 08/06/2018, 29/05/2018. This is getting particularly annoying now. Is there anything I can do to stop them from contacting me ?
  7. I realized after I uploaded the letter I forgot to edit the address out. But it won't let me delete the document. Can you delete it for me please?
  8. Hello, You were right. They had stopped sending emails but it has been brought to my attention that they sent a letter to my family's house on the 9th of May (the address I provided to the gym when I signed up). Despite telling them my current address in my original letter. It also seems they can't get their legal babble correct. It says in the T&C they only accept cancellations online. Here it says cancellations in writing only. I assume I should just treat this as begging letter and ignore it, right?
  9. They last contacted me on the 20th of march threating to pass my case onto zinc if I didn't pay by the 27th. I didn't pay and its well past the 27th of march. radio silence since... nothing by email, text or writing. Maybe zinc rejected their case or they just gave up. I think this is over for good
  10. Gyms can't mark your credit file without a CCJ. To get a CCJ they have to go to court and their arguments will not stand in front of a judge. They will be laughed at.
  11. If you write a letter demanding for communications in writing only and they do not comply, i.e. by still emailing/phoning/texting, is that evidence of harassment ?
  12. Its been over 2 weeks since I've sent the letter. I've got a certificate of posting saying it was sent on the 21st of February at 17:42. It looks like they completely ignored it or they never received it, I'm still getting text messages from the CRS/Harlands asking for the usual. Texts are being forwarded to 7726. I find their emails funny to read so I probs won't block them haha. But my offer has now expired.
  13. forgive me but my legal vocabulary isn't very good. by counterclaim, i meant a defense in a country court. i see. reading carefully they say 'we may' not 'we will'. i'll block and bounce all emails from harlands and crs, and then eventually zinc. what happens after zinc? does it go back to harlands or is it dropped entirely?
  14. That's great. I assume there's no need to inform my solicitor about the legal action threat? It would be quite time-consuming if I have to create a counterclaim.
  15. Good morning, I still haven't had a written reply from CRS/Harlands. However, I received another email today with the usual: legal action or we'll pass onto another debt collector.
  16. Just arrived back from a vacation, sent the letter off yesterday. Received another phone call 2 days ago telling me I have to reinstate the DD, pay £201.47 and then use the online form. I told him to suck my pecker and hung up. Is it just me or does anyone else think their letters are incredibly unprofessional? "You want to continue your membership - The club want nothing more than for you to get the full benefits of your membership. You simply need to pay your arrears and either set up a new Direct debit with us for your remaining months or rejoin Xercise 4 Less if your membership has expired." Why would a debt collection company care about me getting the 'full benefits' of training at a gym? Are they really dull enough to think I'd continue my membership after their horrendous customer service? I'm never going to train at a budget gym again. Its clear how they can afford to have so much equipment and a big building but only charge £9.99-£19.99/month. Because they have an income stream tricking ex-members into thinking they have hundreds of pounds of debt. Red underlined bolded text? Really... My little 8 year old cousin can write scary letters aswell. God, they really annoyed me. I wish I could ruin their business.
  17. Harlands are laughable. They must have some sort of computer program that reopens old cases from years ago. No one with even a pea of a brain with bother with pursuing a 3 year old gym cancellation.
  18. Listen to slick and dx. Send the letter and make sure they only communicate with you in writing only. A CCJ won't happen. Any judge will be able to see right through their ridiculous cancellation policies. Why do you think they offer gesture's of good will when they ask you to pay the admin fees? Its not because they care about you, its because it isn't even real debt. If it were real debt they wouldn't accept anything less than what is owed.
  19. Unfortunately gyms do this on purpose. They want people signing up and not coming so they can take as much money as possible from inactive members. All of them have a business model like this but xercise4less takes it to the extreme (given the number of x4l threads on this website)
  20. Actually the guy who called me yesterday said he was from X4L. Furthermore I don't think someone working at harlands would speak in such a rude and condescending manner over the phone. He said 'I'll give you one last chance to pay up...' One thing led to another, I got mad and told him to .. and pass it onto the debt collectors. Regardless, here is the letter I'm going to send: (Credits to you; I found it from one of your other posts from October) Its addressed to Harlands: Is that right or is it meant to be addressed to the X4L head office?
  21. Only evidence would be CCTV but I doubt records go far that long
  22. Yeah if they send another email demanding admin fees I'll write a letter to them offering only 1 months payment. Do you think its worth seeing a solicitor/lawyer about the getting locked in thing?
  23. when I was a membership the staff at X4L accidentally locked me in the gym. I was putting my pants on in the changing room and the lights went out. As soon I put my jacket on to leave the room I realized there was no one there and the steel shutters were down. This resulted me having to leave through the fire exit which caused the alarm to go off at 10 o'clock at night. The staff apologized to me and I carried on training there for two months. Come september I leave the gym to relocate to my university city. I cancelled the membership through my bank because I have read stories about them continuing to take money after cancelling through their online form. A few months and 5 harlands emails later I have received an intimidating phone call from an X4L head office person demanding me pay £125 to cancel my membership. The thing is when I signed up I picked the membership option that allows me to cancel anytime I want as you pay £10/month extra for no minimum 1 year time frame. Now they are lucky I didn't take legal action when they locked me in the gym (what if I was blind like my friend????) now I am being harassed on a bi-weekly basis over phone and text messages to pay 'administration fees'. I have had it! What are my rights and would my case stand a chance in court if I were to press legal action?
