  4. The only response i had from Lowell said -We have raised your disputes with our client and will contact you once we have a response. Please send us any evidence, including correspondance between you and bt. -this account is a telecommunications account and not regulated by the CCA, our client is not required to retain a copy of the agreement or default notice -Notice of assignment is enclosed -we have requested a copy of the statement of account from BT Still need to phone back the mediation people and agree or decline mediation, really not sure what i should do from here. I here you Andy, can i find more info on what would happen next. Thank you

  6. ok thank you, wanted to be somewhat prepared haha. Spoke to them they suggested mediation and offered a date, I said I think mediation will fail, and they said its optional, and a chance to reach agreement, wasnt sure whether to reject mediation (in which case i think they said would be a court date) or agree to it ?? I said I would phone back as didnt want to commit to either without a little advice. Thank you again !
  7. Have just had a call from the small claims mediation service, asking me to call them back. Not sure if their going to ask any hard questions or if theres anything i should be ready to say? Thanks if so.
  8. Ok I will complete the N180 in its entirety, and print another 2 copies to fill out and keep/send. 'Am i asking the courts permission to use the written evidence of an expert?' and 'How many witnesses, including myself, will give evidence on my behalf?' Thanks!

Yes, its attached to the Notice of Proposed Allocation to the small claims track. it says; 1 - This is now a defended claim - defendant has filed a defence. then they have put a line through 'a copy of which is enclosed' 2 - it appears that this case is suitable for allocation to the small claims track. - If i believe that this is not appropriate, complete box C1 on N180 and explain why. 3- complete by 2 February 2018 (late I know =/ ) Should I agree it is the appropriate track for the claim or not. Thank you !!
  11. Sorry for the delay! The lowell love letters havent stopped. I have had: - a Directions questionnaire (small claims track) dated - 09/01/2018 - a confirmation of receipt of my defence (also states '..this account is a telecommunications account and therefore it is not regulated by the consumer credit act. Consequently our client is not required to retain a copy of the agreement or default notice.') dated - 15 Jan 2018 - a notice of proposed allocation to the small claims track, dated - 16th Jan 2018 Will scan and upload all or all the relevant correspondence (retaining my anonymity) thought i would update while doing so. Thanks for all the help so far.

  13. Yup I did, I did that in plenty of time so sure thats not the issue. Just couldnt log back in for some reason (probably getting password wrong, stupid I know, and their forgotten password process doesnt work) Thanks warpath

  15. Defence was sent to MCOL by email. I couldnt log in after creating my account spoke to help desk, they couldnt reset so told me to email it. Not sure what the status is as cant log in yet.
