Hello This is my first post and hope I am posting in the correct section. I would like to ask if anybody has experience or knowledge of the validity of a deed of easement signed and sealed, pursuant to S.68 of the CROW Act 2000 (a statutory easement). The compensation sum was paid before S.68 was repealed. I was working abroad at the time and was only able to sign the deed 5 months later. I did not know that S.68 had been repealed on 1.10.2006, although I am sure that the other party (local authority) would have known. The deed contains a restrictive covenant which wouldn't apply if I had simply applied for a prescriptive easement following the repeal of S.68. I am hoping that the deed is void/redundant, and any help would be gratefully received.
