  1. I bought something on ebay, the seller sent me a paypal payment request to make sure I dont get a refund when paying this way. The seller sent the item and it was damaged. The damage was not stated in the listing. Photos were highly misleading. I emailed the seller about returning the item via ebay or paypal but no reply from the seller. The day after the email, the seller opened a false unpaid case on ebay. The item was paid via paypal the day after the auction I phoned ebay days later and had the unfair unpaid item strike removed. Yet this horrible seller was able to open a fraudulent unpaid case since the payment was sent off ebay and not through the ebay check-out. I returned the item straight away and opened a paypal case for item not as described. Paypal said no refund, and had refused to refund my money even with all the evidence and proof from the post office and the tracking numbers provided, clearly showing that the item has been sent back and it was received by the seller. Paypal coming up with any sort of excuse. Refusing to refund my money with spurious excuses, the last of these was ‘we do not refund for buyer remorse’. This was NOT buyer remorse ! The item was damaged and the seller did not state the condition of the item, simple as that. I phoned paypal again and I always get the same horrible person, part of their ‘team leaders’ revising my case and refusing the refund. At this point, I am left witn no other option to open a small court case against paypal as they have breached their contract of buyer`s protection. The item was damaged and not as described. It was returned promptly to the seller. We have full evidence from two delivery companies clearly stating it has been delivered and accepted back. I am so upset over this I am now £220 out of pocket. The seller has now the item back and my money ! and to add injury to insult paypal refuses to refund the money, breaching their so called ”money back guarantee”. No wonder paypal has such a bad reputation. Edit. I wish to clarify that I am a buyer with over 1600 excellent feedback on ebay. Now I have finally seen the real light of paypal and ebay. I am prepared to pay whatever fee is required to go ahead and persue legal action. It is a matter of principle. Their terms of service does not supersede the law. I would have known the outcome of the paypal claim, I would have probably kept the damaged item, instead I was lured into their 'money back guarantee' or ' paypal buyer protection' marketing promises and assurances.
