  3. Got another set of accounts from them through the post, as clear as mud. These accounts are terrible to understand and the few i have been sent all have differences, I have had to write again explaining i need a true up to date statement of account they claim is owed to them. Dont want to complain about something they have removed in their final response.
  4. Posted again to new address, now the waiting begins. Will look into mis-selling in the meantime.
  5. Thanks for that, will check with court regarding sist, they did say would be requested on the day though, we do however have emails confirming sist will be requested. Will appear on the day in question to find out. Maybe i could ask for it to be struck out due to address? Would only reissue but would be funny.

Sent SAR and cca request, the next day we received a whole lot of stuff including credit agreement, copy of their final offer from Nov last year and another revised final offer giving us 6 months to accept or reject their latest final offer or go to FOS. Today we got in the post our requests returned to us as "addressee gone away" the address we sent them to was the address that is on their court papers sent to us for later this month. So surely that address if not used anymore shouldn't be on the court papers served to us? The address was blemain finance ltd, bracken house, charles street, manchester, m17bd. Interestingly we also received a call from someone who knew we had an account with Blemain finance and were asking if we were mis-sold the loan! Wife called them to ask about the address and was told it changed in September 2012!

Just read your thread from the start, i am in the same position as you regarding my loan being paid but then found out i had charges, telephone calls, block insurance payments, all with interest added. I am probably 3 months behind you as first court date has just been sisted. Good luck and I will follow your progress.

Hi Caro, interesting point as the original amount borrowed also included a payment they made direct to my mortgage arrears of over £1100 so hardly checked affordability, was all rushed through Ocean Finance who were the broker in this loan. Broker fees and loan arrangement fees, title fees, you name it they charged it. I spoke with blemain today (head of complaints) and asked why now they wanted to have another look at our complaint was it because we had contacted the FOS. The reply was that in Oct 2008 changes through the CCA meant handling of charges were changed and any charges prior to that date may be removed. I did touch on the final ruling that WP3 was talking about and their reply was that it has no bearing on this account (as expected)

  11. Hi all, it has been a while since i updated and this is because they do take a while to respond. I eventually complained to Blemain for the level and amount of charges applied to the account and they gave a final reply in Dec past by saying we will remove £800 from the total! I wrote back saying this was not acceptable and their reply was the same. My wife then contacted the FOS and gave them a brief explanation of what had been going on and they said they would investigate our complaint further, this was around 3 weeks ago so all was quiet until this morning when we received court papers to appear and fight a repossession order next month!!! My wife contacted Blemain and informed them that our complaint was now in the hands of the FOS and that she would be notifying them of the impending court action. She contacted FOS who then immediately spoke with Blemain and got back to her saying the court case was to be Postponed. My wife wasn't too sure with this being told over the phone so called the court to confirm and found the court didn't know anything about the case being postponed. She again contacted Blemain and explained we were not happy that a court case was raised whilst our complaint was in the hands of the FOS and for them to then try to request the case to be sisted was not something we were happy about and if it was not dropped then we would appear on the day in question to object to that. Long and short of it all is the case is to go to court and they will ask for it to be sisted. Interesting to note that after Blemain were contacted by the FOS their interest in our complaint almost seemed genuine and they have asked to be allowed another look at the complaint before the FOS deals with it. WP3, Going to start reading up on that.
  12. hi cheesed_off thanks for that, i will do exactly that, asked for statements and got a basic breakdown of what they say is now owed. The loan is paid off but there are outstanding interest and charges. Deep breath-----------COSTS AND CHARGES £6,799.53 and DEFAULT INTEREST AT £4,430.51 TOTAL settlement figure of £11,230.04

Hi everybody, starting a thread regarding Blemain finance, took a loan out for £5k over 5 years secured on my house, had problems keeping up repayments for reasons that Blemain were informed off. Just managed to clear the loan and the arrears on the account but they have taken advantage of my unfortunate situation with crippling charges and legal costs. I am now going to send a SAR and fight them if i can for the charges to be either cancelled or reduced if possible. As it was a joint loan with my wife we have received in some months 5 letters each at £35 each making them a tidy £350p/m. Update when I get more info. Thank for reading

  18. Still no payment despite sending them a reminder to sett le, when you calll them your told by a lovely automated service you are on hold for anything between 40 and 75 minutes, i done this once then got cut off after half an hour, grrrrrrrrr.

  20. Hi Kenny, long time no hear m8 had a crap year and be glad to see the back of it hope urs has been better lol. Just to update this the family member involved has been offered a full refund and returned the document to them. Said would be paid within 30 days mind you, 34 and counting so far. Thx for all the friendly advice given.
  21. Hi Paul you have paid for something you didnt want so you could obtain a loan. That is wrong and you are due back what you have paid plus interest, so your complaint regarding PPI has been registered over the phone, i would follow that up with a letter also m8 just in case. Your not the money grabber they are and remember that.

Thx chiswicklass i have sent it back, i said the person had previous medical condition and that if a claim was made which related to that illness it would fail, also he now has cancer, been off work for quite some time but does get full pay, therefore showing there was never a need for the ppi, that and he was told the loan came with ppi and had already been approved. he did tell them he got full pay and that PPI wasnt needed but was told it was part of the loan. FINGERS CROSSED
  23. Hi again, you were right Stew they got the questionnaire as expected and ive started filling it in for them, is there anything I should be aware of at this stage?
  24. Thx Stew will keep it short and sweet and download the questionnaire. They are paying £290 pm and only have 9 payments left on a 48 month payment plan, more than double what they actually got due to this PPI and its interest, never missed a payment but im now wondering if they should put the account in dispute for now until they find out whats happening.
