  1. Well not sure if I won it really or they just played dead So anyway I sent my S.A.R - (Subject Access Request) letter in, and a letter arrived promising action, then another saying it had been delayed. Finally a chunky envelope arrived with my statements and a letter. Now bearing in mind i had not asked for a penny yet i was shocked to find the letter said the usual yadda yadda yadda about charges being fair and legal so I prepared myself for the next stage. Then at the bottom of the letter was a comment saying that as I had raised this matter they would make a goodwill payment of £399 direct onto my account OK - so wheres the catch - no letter to sign , to fights no more letters to write - I almost felt cheated So i'm not sure if this was won or the other side didn't turn up but its shows they must be running scared. Oh I did add up the charges and they came to £419 so I am going to ask for the extra 20 quid as they would not let me off £20 quid so why should I let them off it But i'm making sure I have the £399 1st ! Is this usual behaviour for either A&L or mbna ? Now to sort out a donation for this wonderfull site Rich101 A&L £399 First Direct £2700 Outstand First Direct £528 to go Don't mourn - ORGANISE (Joe Hill)
  2. I'd write back saying you accept on the basis of a cheque being paid to you I am sure i've seen others do this and get the cheque but can't reference anything Or tell them the full story that you cannot have it paid to them as there is an agreement to pay and preferential creditor thingy etc. so it is not acceptable to pay it off the debt Good luck Rich
  3. Go for it.... I got my offer of a refund today Isn't it funny though you managed to open an account with FD'd parent company after they shut you down - ironic really Rich
  4. OK so they are saying they will not pay 'recall fees' This seems to be in relation to direct debits Is this normal - should I have claimed them ? Have others had these claims rejected I also claimed £340 in interest, I didn't find the sheet on the website before my claim so I worked the interest out on a very generous (to FD) rate of 5% per annum not compounded , was I right to do this ? Thanks for any help Rich
  5. Looks like they got to us on the same day - just been offered £2700 Don't blame you for accepting, its our money in the end and its great to get it back So congratulations Rich
  6. Yee Haa........ offer from First Direct of £2700, but I claimed 3800 So 400 or so of that was interest, but even ignoring that it leaves me 700 quid out of pocket Excuse is usual one - management costs etc. and no admission of liability No confidentiality clause either So i'm gonna check my claim now and then write back accepting it as part payment I think Oh and got my advanced statement where they stuff me for another £150 of charges so i'll need to claim that too as a separate action I guess So any advice and experiences from this point onwards ? Cheers Rich
  7. Still no reply to the 1st letter let alone the 2nd, and now only 5 post deliveries to go But i am getting threats about my overdraft again (funny how these started after I initiated action isn't it) I think I read somewhere that they are not allowed to take action against you once the account is 'in dispute', - was i imagining it or is that true as I need to write back to them explaining that the account is subject to ongoing action and this seems like retribution for that action. Thanks for any advice Rich
  8. Same issue as me then - no answers yet apart from acknowledgement letters and then ap apologies for not replying in time Just keep going - send the LBA - I did mine last wednesday so I'm a week or so ahead of you Good luck Rich
  9. I have no legal knowledge of this but assuming a fairly logical process as this seems to be then there should be no reason for you not to claim, you have still been charged illegally which may have contributed to your bankrupcy so even if the money goes to pay outstanding debts its still worthwhile doing Rich
  10. Got a letter today appologising for not replying within the required timescales in response to the 1st letter They'd better get a move on as they've already got the LBA so they are in the next 14 day time period already And I received a reply from them on my SAR for my 1st direct credit card with the cheque returned so that seems to be going to form Rich
  11. Job Done - Letter before Action done to mail tomorrow and also the SAR for my 1st Direct gold visa and also SAR for my other Credit card too (alliance & leicester) Thanks bookmark for the encouraging words, i'm more mad than worried - I will not be ignored Rich
  12. Well i hav't had a reply either , ive had the promise of a reply though - just go to stage 2, i'm doing it tonight while watching CSI (sad I know...)
  13. Well no reply within the deadline given so on to the next step this evening I have had a threatening letter about being over my overdraft limit and I must take action with 7 days though so maybe thats my response Shields up Mr Sulu and bring phasers online - we're going into battle Rich
  14. Got my reply saying they'd get back to me with 10 working days at most Happy Christmas all Rich
  15. Launched my battle yesterday with a special delivery letter so it should have got there today. Claiming nearly 4k Shocked at how much i'd been debited when i worked it all out, felt a little stupid that i had allowed it to happen, but it seems to be a self fufilling prophesy - as soon as they start charging you, you are in trouble as it generates more charges. This group has already given me alot of hope and confidence that it'll work - no worries about taking it all the way if nessesary, so thanks for the confidence you've all given me by lurking and reading others posts Going to do my first direct credit card now, and my alliance & leicester one and my business account with abbey, if a battles worth fighting..... Opened a back up account with Smile just in case and had that accepted, was shocked to see so many problems for the smile/co-op bank customers as i thought they were an ethical banking group, oh well. I'll post more as soon as I hear from FD Happy Christmas and hopefully a good new year Rich
