  1. Update… though delayed in this update. I decided in the end to take the points etc… I just had too many other things going on in my life to add this to the equation.. bitter pill to take but done and moved on. Thank you for all help and assistance
  2. Just back from the Magistrates court. The case was made that I was speeding and that I paid the fine but didn't submit the paper form and they asked for costs to be applied. I said that I paid the fine and did send the form of which I had a copy. I added that I was sorry if they couldn't find the form or if they were short staffed but that I did send it. The magistrates accepted this to be the case immediately and didn't ask to see my copy of the form. They ordered the original 3 points and the £100 fine but added £40 as a surcharge... which I tried to argue against as I had fulfilled my side of the requirements and have had to take time from work for no fault of my own but they said they are required by law to add it. Miffed about that on principal but guess I should count it as a win. Hopefully I will never be in this situation a gain but lessons learnt are to send everything with POP and photocopy/print and save forms and correspondence . Thank you to everyone who contributed to helping me on this matter
  3. Good morning Man in the Middle, Yes I did request they change my plea from not guilty to guilty and this time i got proof of postage... But the flipping computer I did the letter on crashed so I cant print off a copy. Hopefully if they cant find that one they will accept that I wouldn't send an empty envelop with proof of postage I received their summons on referral to court which says a magistrate has decided should be referred to a full court hearing for a case management hearing. Why oh why they couldn't have just sent me a letter or email saying they couldn't find it .... I'd have sent them a copy of the form. That would save all this money and me from having to take time from my already struggling business ( Hospitality ) Hearing is 1 for 1.30 today.. i'll let you know how I get on.   4. Good morning… just a quick update. I have had a refund of the £100 into my bank account and there is a court hearing this coming Thursday.. I’m not looking forward to that!! Any advice or pointers greatly appreciated! Whilst going through some paperwork I have found that I did take a copy of the completed form which is completed correctly and I definitely sent to them …. though I accept that’s not proof of postage or of them having received the form

  6. Hi on the third page in very small print it says: conditional offer - paid but licence details not received by HMCTS I have no way of proving that I filled in their form and sent it back. Their postal address is a PO Box in Bradford and so recorded delivery cannot be sent. Indeed this SJP I received last week states the form can be filled in on line or sent into the address provided - though I cannot find any address provided on the form…. Also why they have waited 5.5 months to raise this ‘alledged oversight’ with me
  7. Hi people, thanks for your replies. yes I am 99% sure. I paid the penalty £100 online & then filled the form in & sent it back with my driving licence number on it. (Wish I’d taken a photocopy first,,) The reason I am so sure is that I have forgot to send my licence back in the past .. about 10 years ago & I got a letter reminding me to send it in. On this occasion I rember thinking how much more sensible it is to simply give them my driving licence number. When I got the SJP last week I was totally confused (holiday packing!) I thought it was actually a new format NIP I didn’t know about. So I responded to it (considering deadlines) & indicated I wanted to go to court on the basis that it was 5.5 months after an alleged offence. At this stage I didn’t marry it up to conditional offer of speeding fine Iand 3 points I acknowledged and paid on 18/4/23

  9. Hi, I got a Nip 18/4/23 36/30 West Yorkshire. I am 95% sure the form required licence details but not the actual licence. Last week I received a single justice procedure for failing to provide the licence. I do appreciate that they are entitled to do this … however …. I am SURE they changed procedures meaning they could endorse from the submitted licence number abolishing the need to submit the physical licence .. Does anyone have recent experience / knowledge of this change in particular for West Yorkshire as it might be a force specific role out
  10. Mmmm not one hundred percent sure! I remember it was very very windy. I remember seeing the speed van and checking my speed and then thinking is it a dual carriage way and 50 mph in which case I am guilty!!! They are claiming I was doing 81 in a 70 in which case I would have thought I was guilty regardless and this is why I wanted to see the evidence. They have since written to me as requested and confirmed that they will not show the evidence unless i take the risk of going to court
  11. Hi Folks, Thank you for your help and advice. I notified them that I was the driver immediately. I will probably just pay the fine and have the points (I had a speed awareness course 2-3 years ago) It really doesn’t seem fair or right though that they have the evidence yet won’t provide it unless I go to court and risk paying larger amounts.   14. Hi folks, I wonder if you can help. I received a NIP. I remember the day in question as it was very windy And I was returning from the coast with my friends children. I am very sure I was not speeding. NiP did not give the option to view video or stills evidence with their paperwork. I phoned to ask where I can view it and they told me that they had the evidence but that I could only view it if I went to court. I said that can’t be fair re pre action protocol, fair on me to allow me time to consider the evidence or good use of tax payers money. They said that’s their policy now and so I asked them to put that in writing. It would seem I will have to go to court to view the evidence then ask for another date to allow me consideration time ..... your thoughts people?

  19. Oh No! Have I done it again?? I thought I was updating on my original post. I did see the posts by survival but don't remember that being my user name. I made a note in my phone of my user name (heathertippex) and password. That's not to say I could have forgotten my original user name and pass word. How can we delete the 'survival' account because the post is definitely mine so the account must be !!!
  20. Hi, Update....... So the situation to date is that the council have upheld their PCN and my appeal to their PCN. I have now appealed to the Traffic Penalty Tribunal. The local paper has run a story on how crazy the situation is and the shopping center management think the restriction is crazy as do the center users. East Riding Council Highways dont take calls or communicate but have said that the developer Wykeland make all decisions with regard to parking restrictions. I have contacted Wykeland for comment. So basically there is a recessed area for making deliveries to a restaurant on the outside edge of the shopping center. I guess they created this becasue the loading bays underneath are too far away to be safe or practicable on the other side of the center. The double yellow lines have pips on, the disabled bays are disabled bays and the taxi bays are taxi bays. The only way a delivery can be made to this side of the center if you don't have a commercial vehicle is to either hire one or use the delivery bay the HGV's use in the loading area (which seems more unsafe to me!) and walk all the way across with the goods (which seems crazy to me!) The issue is that they are punishing me NOT for making the deliveries but for the type of car I am making them in as they stipulate vehicles are to be made by commercial vehicles only in this location. There is no obvious reasonable or viable reason for this restriction. I dont think I have legal grounds for the appeal but I am hoping common sense will prevail. I have sent in as evidence a copy of the delivery note (Thought the delivering is not the issue) and stated that my car is insured for commercial use and is used for deliveries. Lets see.........

  22. Thank you DX100UK. I have been able to locate the TRO but only the amended one. I noticed last week that they are looking to amend the use of the bay to including a waiting time and taxis during certain hours. I can not see the original TRO. My concern is that they are restricting deliveries to 'Good Vehicles' and this means every time I deliver there I risk getting a ticket. I cannot understand why they are doing this as its not an overly busy delivery location. I have never struggled to pull up there. There are plenty of disabled parking spaces and shoppers parking spaces in the multi story car park. In addition to this even for service vehicles the time is restricted to 6- 12 midday - Hope no one gets stuck in traffic as they will end up with a ticket!! There will be a service delivery loading bay somewhere as its a new shopping centre. The only entrance for my client is at this point so I have no choice to use it. Which I think they understand by allowing service vehicles. Maybe because I am not knowledgeable in this area I am missing something obvious but I fail to understand why I can not do the same job in the same way in the same location because my vehicle is different? What do they gain by restricting to service vehicles because I loose a lot.
