  1. Will this now get allocated a court date as CLI have exhibited evidence? Or will the court review the evidence first?

Hi guys, As the judge requested CLI should submit further evidence before the 2nd December or it shall stand struck, CLI have just sent me a PARCEL with all the same evidence they have been sending me previously! The judge requested the a copy of the original contract on which the claim is based bearing the signatures or consent of the parties intending to be bound by it. AGAIN CLI had exhibited with a copy of the contract for the Migration Agents fees which we all signed stating that the Sponser is 100% responsible for the invoice (Sponser being DONGARA MARINE). This is not a contract between me and Dongara Marine, this is the invoice from the migration agent and this invoice is in the agents company letter head. So hopefully the court will get this? CLI have sent the deed of assignment which they have. CLI have sent a copy of the notice of assignment CLI have sent the default notice. ( This is a copy of the final notice before court proceedings) CLI have exhibited a copy of the certified statement which is a letter with the balance due with DONGARA MARINE bank details on. This amount is £9426.41 dated 09/06/20 and is a different amount to the deed of assignment which is £8872.88 dated 21/07/20. Hope the court see right through CLI as I don't think they fully understand the process between me and Dongara Marine as there isn't a contract between me and Dongara Marine hence me being here fighting this case.

  4. Hi guys, I have a reminder in my calender for tomorrow that if CLI don't respond to my defence by tomorrow (28 days) the case becomes stayed. Is this still relevant as they responded with the N180 form? Thanks in advance, Ginni.

  6. Ahhh ok. It does state that it's been referred to the allocated court and on receipt, the file will be referred to a procedural judge who will allocate the claim track and give case management directions. Does this mean on receipt from CLI do you think?
  7. Hi guys, Just received Notice of Transfer of Proceedings from the county court. Does this mean it's definitely going to court now? Cheers, Ginni.
  8. @Andyorchnot what I have seen as all parties have signed for Sponser to be100% liable for fees. @dx100ukthats what I thought it sounds like to be fair.
  9. Nothing! This is the thing I haven't signed anything about paying the money back to Dongara or the agent. All they have provided is my visa application basically. (Step by step)

Hi guys, So just received a huge pack from CLI, I presume all this pack is from my request of information (CPR 31.14) So the pack basically contains: 1) My visa application with all my supporting evidence. (It's a lot) 2) My successful trade recognition and the amount $1000 (I paid this myself) 3) The immigration agents contract. Which clearly states that - the entity responsible for the invoice is Sponser: 100% of the fees in this agreement, as requested by the Sponser. (The Sponser being DONGARA MARINE PTY LTD as it states on the same application) 3) Invoices that Dongara Marine have paid the immigration agent. The front page to all this information is a letter from CLI dated 15/10/20 which states 'I trust that this provides you with the information that you require. If you need anything further from me, please let me know. It would be in both parties interest to try to come to an amicable resolution without having to resort to further action in court.'
  11. Here is the list of letters with dates & amounts. Hope it all makes sense; 1) Email Invoice 26/03/2019 - $14,725.00 2) Pre Protocol Letter 19/06/20 - £9426.41. the GBP rate in the letter is £1 = $1.667AUD so this amount is $15,713.83 3) Deed of Assignment 21/07/20 - $14,725.00 4) Claim Form 11/09/20 - Particulars Claim £8,046.45 <--- this says by deed of assignment. If I use the rate stated in the letter pre protocol £1= £1.667AUD this = $13,413.43 This bit states daily Interest rate up to the date of judgement or earlier payment at a daily rate of £1.76. At the bottom of the page there is a box with the following: Amount Claimed - £8988.21(if I change that to the AUS Dollar using the rate stated £1 = $1.667AUD the amount would be $14,983.34). Court Fee - £410 Total Amount - £9398.21 Hope

  14. I possibly binned it previously. Now I am started filing everything. So it looks like this pack that has come through is with everything attached again Is the letter of claim the claim form?

  16. I have just noticed the date is where the staple was and the date for that is 09/06/20 I will upload the others now. DQ = Directions Questionnaire? (Shall I remove the claimants details with upload?)

  18. Brilliant, I haven't signed theirs. Also, CLIs N180 form has been ticked yes to agree this case being referred to the small claims mediation service. I ticked No to this? Is that fine? Do they want to try and settle it through mediation instead of taking it to court basically?
  19. No, nothing! Just keep an eye on letters that state about court as you may need to respond. I am sure other professionals will be able to advise you on here. I am on here for advise too but I have ignored all letters about visiting my house etc etc. Hope this helps? just received 2 packs through the post from CLI. The first pack contains: - Deed of assignment (Just the OZ employers signatures on) - A letter, details of debt with 2 bank accounts to pay to, one in UK and one in Ireland. This also states the daily interest rate that I am being charged. (I can attach if needs be). - Signed copy of CLIs N180 form. (Section A - Settlement/Mediation - They have ticked yes to agree this case being referred to the small claims mediation service). Pack 2 contains pre action protocol which gives this breakdown of the debt with the way to pay and this is direct to Dongara Marine My N180 forms are ready and being posted to the court and one to CLI in the next hour. ( Shall I not sign the CLI in case they can forge a signature) Cheers, Ginni
