  6. Hi I received my letter form Anita Hicks today at Barclays stating how sorry she was that I would not be accepting her 50% offer and basically saying where see you in court. Can anyone help with a few questions about the claim form N1: 1) The section for brief details of claim, what wording should I use. 2) Value, Should I brake it down as follows: £ Bank Charges £ Overdraft Interest £ 8% As allowed by the court £ Total 3) Where it says amount claimed do I put the total as above and they have a separate space for court fee. 4) Particulars of claim, is it ok to use the template in the library section - particulars of claim hard copy. 5) I am with the Woolwich but all my correspondence has been with Anita Hicks at Barclays, who am I taking to court The Woolwich or Barclays. I would be grateful if anyone can help with any of these questions. Thanks
  7. Hi In the letter before action it states that " Its the implied term of that contract that the bank would conduct itself lawfully and in a manner which complies with UK law". I have looked through the terms and conditions of the Woolwich my bank and cant find this statement but maybe its was on the oiginal agreement I signed. Does anyone no how I can go about finding out before I send this letter. Thanks

    Hi Barclays(The Woolwich) Have offered me 50% of what they owe me, of course I wiil not except this. Could Anyone please advice if the following letter is ok to send at this stage. Many Thanks -------------------------------------------------------------------------------------- LETTER BEFORE ACTION Dear --------------- ACCOUNT NUMBER: xxxxxxxxx I refer to your letter dated 8th March. I have noted your offer and I am not prepared to except it as the full indebtedness is £XXXX. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice. Yours faithfully,
  9. I sent the first letter to The Woolwich on the 13th February. On the 6th February I recieved a standard letter from The Woolwich saying that they are aiming to resolve this matter by the 6th March, I have today 23rd February received another letter from The Woolwich telling me that they have passed my complaint to H.O Barclays and they will contact me shortly. In the letter I sent it states that I give them 7 days to return to me all charges or I will recover in the County Court, at the end of the letter I have asked for an exhaustive list of all charges on the account over the last 6 years. My question is I cant take the bank to court if I dont no what they owe me so do I just wait until the 40 days are over and if they have not supplied the information report it to the Information Commissioner.

    Bank Statements

    If my bank decides to pay me all charges after sending them the standard letter in Bank Action Group, how do I no how much money I should be due when I wont have the statements going back over 6 years. In the letter it only asks for the statements if they refuse a refund. Could anyone help answer this question I would be gratefull. Thanks
