After presenting my letter to the Gym in question, Energie Fitness have replied with apologies and confirmed the closure of membership was completed as per contract . They state that any balance statement sent by Harlands is invalid . sounds like a result !

I would like to raise the emphasis to the fact that this conglomerate signed up along with Dave Whelan Sports and LA fitnes back in 2013 with the old OFT , to clean up this practice but it seems that they are back on the nasty step ! cheers marsh Conglomerate

What a great site ! After this read I am now rolling up my sleeves to take on Harlands Group after receiving what I can only describe as an intimidating "demand " for unfair monies , after my wife canceled her direct debit instruction with Energie Fitness for Woman gym . It appears that HG have forgotten on their agreements and subsequent undertakings with the OFT back in 2013 ! My wife has been a member of this gym since June 2013 (@ 37 pounds a month ) and enjoyed the social banter as well as the exercise. It was after a knee injury at the beginning of 2015 that she decided to ask for a reduction in monthly membership as she could no longer utilise the gym equipment, but wished to maintain the social connections with an agreed reduction to 5 pounds per month . The Direct debit was reduced to the 5 pounds as agreed and we have a copy of the amended Instruction dated April 2105 The knee injury was more complex than at first thought and after surgery it was obvious that recovery would take a good few months at least . My wife discussed the position with the Gym manager and it was agreed that they would terminate the membership and they would cease the DD which was carried out on the computer in front of my wife in mid November , I also cancelled the DD instruction myself with the bank , online soon after . Today we have just received a worrying letter from HG regarding their December DD payment having been returned from my bank as "instruction cancelled " They now state a charge of 20 pounds admin fee and asked us to call them immediately so they can collect and re-instate the DD . Then the threat if we do not call by 22nd December a further charge of 20 pounds admin will apply . Then " For my information " Q on what to do if I wish to cancel my membership . Simply pay a 1 months cancellation fee consisting of , 37 pounds Outstanding Subscription . 37 pounds Cancellation period . 20 pounds Default fee totalling to 94 pounds . Yeh right ! I have not called HG or written to them . We need a copy of the original contract from Energie Fitness before I write to them using your template respones but any further advice on dealing with this this blatant resurgence of the scheming downright robbing habits by the Gym fraternity that was supposed to have been dealt with by OFT back in 2013, would be grateful , cheers marsh
