So this... 1 The Claimant's claim was issued on 24/11/2015. 2 The Claimant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the limitation acticon 1980. If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant. 3 The Claimant's claim to be entitled to payment of £10,984.35 or any other sum, or relief of any kind is denied.   3. Yes eventually ha dx. I'm a nurse so work odd shifts sorry for being so slow! I've not filed the defence yet on mco- just stated I'm going to be defending it. I'm not really sure of the wording I should use. I've not don't the cca request which I know will weaken my case a bit.

What is the value of the claim? 10,984.35 Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? credit card When did you enter into the original agreement before or after 2007? 1995 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Link Were you aware the account had been assigned – did you receive a Notice of Assignment? I knew they were chasing but can't remember having a letter of assignment, that doesn't mean I didn't Did you receive a Default Notice from the original creditor? think so Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? not that i'm aware Why did you cease payments? at the time i wasn't aware there were payments to be made, it was an ex husband who ran it up and was hiding it. then a case of head in the sand What was the date of your last payment? april 2008 Was there a dispute with the original creditor that remains unresolved? no Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt managementicon plan? no

  8. OK I've just filled in the claim form and stated that I'm defending the judgement... So I have 28 days.
  9. How would I find that out? Would downloading my ccredit report help? I'm pretty positive that no payment has been made since 2008

  11. Can anyone help me with this. I've received claim forms today about a debt from 2008. It was an MBNA card that my ex husband run up and I'm going to be honest here, I've buried my head in the sand with a lot of it. It's in my name so that's not really a defence. I know I should've sorted it ages ago as maybe I'd not be sat here now sick with worry. Do I just send the court forms back and try to arrange a payment plan or is there anything I can do to reduce the interest? I'm so worried I'm going to lose my house over this.
