Hi Guys, So I sent the email to Xercise 4 Less and didn't hear anything back, and have now come back from holiday to the following letter: Dear xx We’ve been employed by Exercise 4 Less as your membership remains in arrears despite previous letters being sent to you. As a result of this, our fees totalling #102.50 have been added. Therefore, your account balance now stands at £207.47 WE WANT TO REACH AN AMICABLE RESOLUTION WITH YOU In order that we can do this, please ring our non-premium rate number - 01444 119165 WHAT ARE THE OPTIONS? You want to continue with your membership - The club want nothing more than for you to get the full benefits of your membership. Providing you can pay your arrears and set up a new Direct Debit with us for your future payments, then they’re happy to welcome you back in. You may also be entitled to a discount if you are able to settle your account balance in one payment. 2. You believe you’ve cancelled your membership -We understand the numerous reasons why people stop going. We’ll listen to your reasons and do everything we can to resolve your account in line with the terms of your membership. 3. You’re experiencing financial difficulties - We know times can be tough and therefore have a variety of possible solutions to assist you, including monthly payment plans that you can afford and recommending independent organisations that may be able to assist you in severe circumstances. I'm wondering about how to proceed next? The figures and charges seem completely arbitrary. I also looked up Harlands FCA website and their status is showing up as "lapsed" since May 2015, not sure what this means or if it of any relevance?
  2. I don't think the guy on the phone really knew what he was talking about. I'm not going to answer any of their calls. I've also just been through my bank statements and I made a payment in July as well, so they haven't even got those details correct!!!! I've sent the email so I'll let you know what they respond, Thanks!
  3. Thanks for such a swift response! Yesterday I received the following text message: Dear Member. Your account has gone into default due to you cancelling your direct debit. To prevent further charges being added please call us on 01132038602. I called the number and the man on the other end of the phone told me that I would have to pay £79.99 to clear the areas on the account which included the £20 admin fee. I was particularly annoyed that they hadn't contacted me sooner. He told me that the contract was like a mobile phone contract so I would have to pay it even though I hadn't used the gym. They said they would have written to me and but they only had my old address on file which I moved from a year ago. I told him I would look into it and hung up. I then received the email with the t&c's attached and the exact wording was: "hi there I have attached a copy of the terms and conditions on this email, the breakdown to close your account and clear charges with Harland's is 5x 9.99 for the months you have missed since June and there is a 20 admin to clear default charged with Harland's -- Kind Regards, Membership Support Team Xercise4less Head Office 0113 203 8602 I had a look through the the t&c's and there's no mention of a £20 fee, just a £25 default fee. I've had a missed call from the number today. None of it seemed very legitimate, the person sending the email can't even start a sentence with a capital!!
  4. Hi, I have a pretty similar problem and was wondering if you could help me as well?! I took out a £9.99 membership in June 2014. In June 2015 I cancelled the direct debit (having moved house) without really thinking about it and assumed I would be able to cancel like that after a year. I have just had a phone call from the membership support team saying that because I didn't cancel my membership I need to pay them for 5 months plus a £20 admin fee. They told me I am not allowed to give the 30 days notice until I have made these payments, and that they have written to me but I haven't received them as I didn't update my change of address. I asked them to email me the details and they sent this with a copy of the t&c's: "hi there I have attached a copy of the terms and conditions on this email, the breakdown to close your account and clear charges with Harland's is 5x 9.99 for the months you have missed since June and there is a 20 admin to clear default charged with Harland's " I am not averse to paying the 5 payments as I probably should have read the t&c's, but I don't want to pay the admin change . I'm also not worried about them hassling me but I don't want any of this to impact on my credit rating. Thanks!!
