  1. Sorry for the later reply. Life seems to have spiralled with everything going on. I have been relentless with Parking eye, I got a friend of mine to offer a little legal advice, mock up a letter acting on my behalf (he is a qualified solicitor but mainly deals with bankruptcy ) He asked for all documentation relating to the claim made against myself, all court paper work and evidence that this was posted to myself at the time. They were unable to provide half of what he asked for, he has since replied asking what evidence they supplied to the court if they are unable to supply me with all documentation. We are now waiting for their response on this. I have still not made any payments towards them and I have sent a letter to the court that the CCJ was issued with all correspondence between myself and parking eye. I am not sure if they will respond to this but I thought it best to cover all corners. I am being optimistic on this! Thank you all for your help. I sometimes would be lost without this forum as I have nothing but motor problems and you always offer sound advice and support.
  2. Hello, I am just after abit of advise. On 21st May I got my car serviced, this was done through a company that acted as a "3rd party" for garages. When the car was collected I told the man that when the engines turns on the car will shudder, he assured me that it will be checked during the service and if they find anything they will contact me. It gets to lunch time and I get a phone call saying my car needs a full oil reflush and top up, along with my break fluid needing to be drained and topped up - it would cost £400. I said no. That was all that was mentioned. I get my service report from the 3rd party and everything has come back as ok, my tyre PSI is 32 on all 4 tyres and under spark plugs being checked and replaced it said N/A 2 days later I ended up going to Morrissons to put air in my tyres, the PSI ranged from 22 - 25 on all 4 tyres - 1st lie from my service report. I contacted the 3rd party and told them what had happened, they had lied on my report about checking my tyres, they also never re-set my service clock. The 3rd party refunded me £65 of the original £167.08 paid. We come to Friday 5th June I was driving down the motor way doing 70mph and my car starts to shudder and loose power - Imagine air turbulence that is how it felt. my car was dropping speed, I fortunately managed to get the speed back up and made it to my final destination. Didn't drive my car again until Monday 8th June, started the engine and it shuddered and turned off. I immediately contacted the AA within 40 minutes they were out and replacing 3 spark plugs - The same spark plugs that were marked as checked and not needing replacing on my service report from 17 days earlier. I have today contacted the 3rd party again who have refunded the whole amount of the service and for the money paid to the AA ( £164.72 in total) they also informed me that the garage did not check my spark plugs as my car was under 50,000 miles - This is a lie. On Monday the AA took my milage as 50,877 I have not in 17 days driven 877 miles - My insurance tracks my miles so I know down to the mile how many I drive a day. some days I do not drive at all as I am working from home. What I want to know is, does this count as motor negligence, if the worst should have happened on Friday then the garage could have potentially had a manslaughter case on their hands. Is there a way I can take this further. I do not think £229.72 refund is acceptable for what has happened. I know many of you will think "you should be happy you're still alive" which trust me, I am! More than you will ever know! especially as I had my mum in the car and her safety is my main priority but I am sick and tired of people trying to take advantage of situations and because I didn't pay £400 for additional work they have done no work. It is not ok!
  3. I emailed the courts before writing the original post to request a copy of all paperwork. Ive been told it could be a 10 day response. I haven't moved since 1998, I've searched all my saved docs (in the past 5 years I tend to scan and save all post that is deemed important) I have either not received the original paperwork or god knows misplaced it perhaps. As I have previous said in my "confusing waffle" I didn't know I had a CCJ until checking my credit file. It was only from searching my emails I found the ones from Parking Eye threatening the action.

I dont remember receiving a claim form, they mentioned a claim form "follow the instructions provided with the claim form, wherein you may make payment or submit a defence" I am guessing this would have been posted out? Can I request a copy of this via email? I didn't know I had a CCJ until I checked my credit file, no paperwork has been received for that. When I am on my laptop I will upload what little documention I have. I've just logged into their online portal to screen shot the pictures of my car and surprisingly the images are no longer available.

I am trying to sort a mortgage out and I have been advised that although it shows on my credit file it has a slightly better impact if it is settled or satisfied instead of being a default, I can then also get the certificate from the courts when it is paid. I was hoping that there was an official organisation to lodge a complaint with, I hate that these companies think they can talk to you like s**t and get away with it. They put in an email " we refuse to correspond with you further" and the stopped all communication without actually accepting or denying my offer of 4 payments, they said that "we have failed to reach an agreement in respect to the full amount" I never questioned the full amount, so how can we have failed to reach an agreement on something when it was never the issue? If I didn't need my credit file to be in some for of respectable state then trust me, they wouldn't be getting a penny! I have better things to spend £197 on.
  6. I done both of those things. I firstly tried to fight the initial ticket as I thought it was a Manchester City Council parking space as it was 4am in the morning on a October when it was pitch black and their parking sign was not lit (in Manchester you can park free between 8pm - 8am) they rejected this. I then offered to pay the £100 in 4 installments of £25, as I said above, they rejected this. I had no job at the time due to health reasons so as I explained to them paying the £100 in one lump sum was not an option for me as I didn't have that disposable income. The 1 month has already passed to have the CCJ cleared, I can now only have it satisfied, which is better than having it as an outstanding default. Do you know who I am best putting an official complaint in too or the best way to deal with their initial ignorance to me trying to make the payment of £100?
  7. The have already issued it to a court and the CCJ was awarded, which is why I have offered the two payments in April and May to have the CCJ "satisfied" I am now back in employment so in a position to clear this off.

Hello, I am incredibly sorry for not replying back in January, I have been poorly so dealing with this matter was not a priority but as I am now in isolation I thought what better time than to deal with all outstanding problems.   9. Hello, I am just after a bit of advice. Last year I received a parking ticket from Parking eye, I disputed this at the time and it was rejected as I have read they very rarely admit defeat and cancel parking tickets. I received a "settlement" offer from them for £100 I explained at the time that I had just been made redundant and I was unable to pay the £100 in one lump sum but I was more than happy to pay over 4 months of £25 to have this matter taken care of, their emails back were shockingly rude and they denied the offer, they even included in one email the below sentence. Despite my previous emails accepting the charge and wanting to pay it off. "We can confirm that we maintain our position that the full amount of the Parking Charge remains outstanding and that we have been unable to reach an agreement in respect of the same via the Reply Form." They then decided to stop communicating with me all together to settle this matter, the never responded to my last email leaving me in a "limbo" position. They then decided to take it to court and issue a CCJ. I have contacted them today to arrange to pay the £197 in two payment and have this cleared by May. Has anyone put in an official complaint to anyone regarding Parking eye, if so who and how? I understand they legally did not have to accept my offer of 4 payments, I had lost my job due to health reasons, I was willing to send them copies of my P45 and final payslip so they could see my financial position but they rejected it all and dealt with my emails in a manner that I would never dream of doing. If I am being honest I am a little miffed that they have put me in a worse position despite my efforts to work with them. Thanks in advance for any help.

  11. I am unable to remove all my personal information from the PDF doc, I am not comfortable posting all my personal details online for the world to see. I can however screen shot the agreement from the finance company. I have also found and email that I sent to the dealership as they wanted to keep the full £300 to cover costs of drivers, box fittings ect. the email details what was discussed with them on the phone.
  12. The finance company have said that the £300 was paid to the dealership, which is why the partial refund came from the dealership and not the finance company. When the £150 was refunded I did question the dealership and they said they were keeping the £150 to cover the costs of the pick up of the car and to cover the wages of the sales staff that worked on my agreement for me then to decide I didn't want the car, it was viewed as wasted time on their part. This is why I have asked about the claims part, shouldn't the dealership have made me sign something for me paying them a deposit, some form of receipt detailing T&Cs of refunds should have been given to me? I handed over £300 and received nothing from them and then they keep £150 stating its to cover costs that have not been outlined anywhere in any agreement. I asked for an invoice for the costs that the £150 covered and I never received it, they refused to communicate with me via email once the £150 had been refunded, it was like they didn't want anything detailing on "paper" only verbally.
  13. With it showing on my finance agreement I thought it had been paid to them. There was never anything documeting that it had been paid to the dealership. They processed the £150 refund but i assumed at the time it was on behalf of the finance company. Shouldnt there have been something that said it was paid to the dealership, a receipt maybe?
  14. I contacted the finance company and recieved the below response, the £300 deposit does show on my finance agreement with them.
  15. I did ask the dealer for the deposit back, they returned £150 and said the other £150 is to cover the cost of the dealership having to go and collect the car. They are adamant I cant have it back, I asked for invoices ect for the costs that were incurred to collect the car, these were never provided. I have no signed agreement with the dealership. Which is where my confusion lies, if the deposit was paid to the finance company, are the dealer legally allowed to keep half as it was never intended for them. The £300 deposit shows on my finance agreement. Would I be wasting my time filing a court claim against the dealership.
  16. I "purchased" the car at the dealer but they said I HAD to sign the agreement with the finanace company before they would transferred the car from another store. The car was not on site at the time of the signing the finance agreement. They are a cowboy finanace and car dealership, which now I have spoken to a few other people and they have been screwed over in one way or another by the dealership. I know I am an idiot for signing the agreement without seeing the car but the finanace company had the 14 cooling off period in the contract so I assumed id be safe if the car arrived and it wasnt for me as the contract and deposit were paid to the finanace company NOT the dealership.
  17. I shall keep an incredibly long stort very short. I am just after some advice before I lodge a county court claim. August last year i went to purchase a car, paid £300 deposit to the "finance company" - it shows on my finance agreement. The following day I cancelled as the cost to run the car was far too much. The finance company were 100% happy with this as they hadn't paid out for the car yet. The dealer on the other hand had a meltdown, told me they would only refund £150 of my deposit the rest went to "cover costs" of recovering the car and staff that processed my paperwork. Now if the deposit was paid to the finanace company, as per my agreement. Are the dealer allowed to keep half? They never gave me any documentation stating the costs should I withdraw, which after reading around they should have. I never signed an agreement with the dealer, just the finance company. Legally are they allowed to withhold the £150 when it technically was a deposit for the finance and no agreement was signed with the dealer. The below was not provided by the dealer.

It has not left the dealership, I am hoping that because they have not yet invoiced the finance company and I have an email from the dealer saying that a new agreement will be signed when I collect the car will make this a little easier. I don't think they are going to be easy work. I have had a read of the credit consumer act so I can reference it if needed. You have put my mind at ease a little,thank you so much!

I am also going to send a letter signed for so that they have had it in writing as well, I have never seen this in a finance agreement before so I am a little concerned as to if I will be liable to pay for the car. I also thought the 14 day cooling off period was to withdraw from the financial agreement and to hand the products back. If that is not the case then I have fully misunderstood the 14 day cooling period. and it states this as the start of the contract, The type of credit. Hire Purchase Agreement regulated by the Consumer Credit Act 1974
  20. Your Right of Withdrawal entitles you to withdraw from the credit agreement by paying the amount of credit and the daily interest rate during the qualifying time period. Your Right of Withdrawal does not entitle you to hand the car back to us or to ask for the car sale to be cancelled. That is the part of the contract that I should also of added into the original post
  21. Which I have done, I have sent the email cancelling but my question is in relation to the part where it says I can withdraw from the agreement but I am not allowed to hand the car back and I will be liable to pay for it.
  22. Hey, I am after some advice. On Tuesday I signed a new agreement for a car with CLS finance (UCan car credit) I have not received the car due it needing a new MOT and 6 things repairing. The car was delivered to the dealership today. I have been told in email from the dealership that because the car was in for work they have not invoiced the finance company there for my repayments will not start from the date I collect the car (tomorrow) and a new agreement is signed. I have since sent an email of withdrawal to CLS as it is not financially right for me to take the car at this moment in time (my monthly outgoings will increase by almost £200 ) Looking through the contract I came across the below and I am wondering how legally binding it is with me not yet having the car, the fact they have not been invoiced and the dealership have said I will sign a new contract on collection. Any help would be amazing as I feel I may have a little bit of a battle on my hands with this one. Right of withdrawal You have the right to withdraw from this agreement, without giving a reason, in accordance with the provisions below. You must give us oral or written notice of your intention to withdraw froo the credit agreement before the end of 14 days beginning with the day after the day on which the agreement is made. Once you have given us notice of your intention to withdraw from this agreement, you must pay to us at our address shown in the agreement, without delay and no later than 30 calendar days beginning with the day after the day you gave us notice of withdrawal, the amount of credit provided under the agreement together with interest from the date the credit was provided to the day we receive full payment in cleared funds
  23. Hello, I just need abit of advice to put my mind at ease. 6 weeks ago I handed my notice in at my current employment as I had been offered a new, higher paying job. The week prior I had my appraisal and was told by my manager and director that I had preformed amazingly last year and they could not fault my work. Inline with my appraisal I was given a 5% pay rise(£18,000 - £18,900), this also fell in line with the support staff being given a 5% taking them up to almost 18,000 (all office staff were given a minimum of 5% to keep us above support staff) I yesterday found out my job was advertised at £19,000 - £24,000 dependent on experience. I read over what they had posted and NOTHING on the job spec is different to what I had been doing, in fact I was doing more in my job role, my job role was advertised as 2 separate roles yet when I started they combined them into one. They have just employed a male to replace me who has no prior experience doing what my job role requires, he is coming in on £22,000. I sat in on the interview with him so I know what he has done prior he is currently studying for a qualification that would benefit him in the future should the job role expand but looking at what is advertised, what I done and what he is being paid I feel like I have been massively kicked in the teeth. When I handed my notice in I told my director that I had been offered £22,000 and I need the money. He replied with £22,000 is a really good offer, good luck, I was then later told by my manager that she had tried to negotiate my wage and he said it wasn't worth it for my job role. Am I being completely unreasonable to feel slightly annoyed by this? I feel I wasted 2 years being under paid by almost £4,000.
  24. It was outside a tram station so I am hoping they would have operating cameras that caught some of what happened. I normally leave a safe amount of distance between myself and the car infront. The fact that I was going over a hill and he slammed on as i reached the peak it was hard to avoid hitting him. I hope a camera will have caught the 3rd car. Thank you for your help.
