  4. Dx, Thank you again - I am now getting the point you are making. In my post 3 I have stated the amounts I pay the creditors. Should I be reducing this to a minimum and if so what minimum and those who have a CCA can they raise a CCJ against me? Many thank
  5. Hi Dx, Thannk you for your reply. My rational is that I believe Cabot have reissued a default when they purchased the debt from NRAM. NRAM have not got any details, as they now do not exist, but I do not understand how Cabot can buy the debt and then issue a new default. Given it has been incorrectly it is my intention to offer a F and F at the same time as telling them they have put a default on incorrectly and use it as a bargaining tool with the hope they will remove the Defaults! Thoughts? Also, I cannot see in the library which one is appropriate for me to use? Thank you
  6. Hi, I know this may go against the grain but I do want to offer some of my creditors a F and F payment initially at 10% of the outstanding amount. Is there a template on here? I know the wording needs to be pretty prescriptive, so that is where the help is needed. Also can I email the letters to the institutes as a pdf or would you advise to be sent by post. Hi - Ive had agreements with all since Pre 2010, but most have been sold on and even re,re sold Cabot previously Northern Rock unsecured loan - CCA request returned because I hadnt completed Postal Order - Defaulted Jul 13 (when sold on at a guess) I pay £20 per month Cabot previously Northern Rock unsecured loan - CCA request returned because I hadnt completed Postal Order - Defaulted Feb 12 (when sold on at a guess) I pay £40 per month Cabot previously Northern Rock unsecured loan - CCA request returned because I hadnt completed Postal Order - Defaulted Feb 12 (when sold on at a guess) I pay £35 per month Moorgate previously MBNA Credit Card - CCA request returned with 'unable to supply' said they would default if I didnt continue payments - UNSURE if previously Defaulted?? Not on Credit file I pay £91 per month Cabot via Apex previously Egg Credit Card - CCA request and have provided signed agreement - UNSURE if Defaulted?? Not on Credit file I pay £70 per month Cabot via Apex previously Egg Credit Card - CCA request and have provided signed agreement - UNSURE if Defaulted?? Not on Credit file I pay £55 per month Halifax Credit Card - was paying Blair Oliver and Scott - CCA request to Halifax, returned saying they have not been able to find original agreement - not on credit file - unsure if Defaulted? I pay £45 Cabot previously Goldfish Credit Card - CCA request returned because I hadnt completed Postal Order - Unsure if Defaulted? I pay £50 per month Halifax Bank Account - Overdraft - Defaulted on Jun 11, no idea why it took so long to default. I pay £15 Mint Credit Card - CCA requested original signature, I never supplied as thought it was wrong thing to do - Not sure if ever defaulted - I Pay £70 Royal Bank of Scotland Credit Card - CCA requested original signature, I never supplied as thought it was wrong thing to do - Not sure if ever defaulted - I Pay £70 I want to pay them off the minimum payment - I'm not sure if those not showing as a default have ever defaulted and do not want to take any action to cause this. I was hoping by 'satisfying' those on my Credit scoring it would increase my credit score as I want to get a mortgage. Thank you
  8. Hi, Thank you for all the advice from reading the forum. I was hoping for some help though given Im certain I have been cash cowed, I believe the phrase is, for many years. My CRA shows 5 defaults, I am unsure if my other creditors have defaulted or just not defaulted and they have purely accepted my arrangement - I do not want them to suddenly appear as defaults when I ask for F&F. Also one debt was 3 of the defaults were sold on to Cabot who have registered them as defaults when they took them on, would they not have been registered as defaults previously by the original creditor? Hoew can I find this out there is nothing on my credit report which I have only recently requested. Also is there at emplate for requesting F&F and what is the recommended % of outstanding debt I should request. Thank you in advance

  11. Hi, Find attached the remaining docs in the attached PDFs I also now realise what they mean by a signed statement of account. For the two CCAs that have been supplied the first page appears at the back of the document. Advice and assistance appreciated. Thank you

  13. Hi Dx, So would your advice be to just stop paying and ignore or do you think I need to make it clear why I'm stopping payments. What if it was a genuine error that they never included the 'Signed Statement of Account'? Thank you

  15. Hi Havinastella, Apologies, I have just noticed the 'expand' button next to the defaults and each one has an individual default date of around 2012/13 the 15 Mar date is an update which will be when Cabot took on the debt. I will continue and wait for the CCA request response
  16. The date for all the default is 15 March 15 so I would say they are 'new' defaults post them purchasing the debt!
  17. Hello, I have just checked my Credit file and I have 3 new defaults on my file from Cabot. Cabot have only just brought all 3 of these debts from Northern Rock. If the same debts were defaulted by NR before they sold them on are Cabot allowed to do this? I am unsure if they were defaulted but believe they would have been. The debts (loans) were taken out in approx: Aug 2006 Aug 2007 Aug 2008 All have recently Mar 15 been sold to Cabot who have then placed a default on my file? CCA requests have been sent for all 3 debts. Is there any other way other than a SAR to find out if they had been defaults previously with NR. Thank you

  19. Hello All, Hopefully I have now uploaded so it can be viewed clearly. I have had the Credit Card at least since 2003. I wrote to Halifax in Approx 2007 and said I was in financial difficulty and needed to pay them a token payment which I have been since and consequently unable to use the card. I only recently last month checked my credit file and it is not showing as a default for Halifax, all though from memory, I am sure I had letters to say that I had been defaulted in the past. I believe the default has come off my credit file because it has been defaulted over the 6 years. I am confident I never paid any PPI and if so the date for this since I did is also over 6 years. The letter attached that Halifax have replied with says that they have enclosed the Signed Statement of Account - there was 'NO' enclosure titled 'Signed Statement of Account' enclosed, just the second two enclosures. The account was at one stage passed to Blair Oliver and Scott but appears now to be back with Halifax as that is who my statements come from. As mentioned previously the other two enclosures they refer to each contain a past address of mine, but do not contain any dates or signature of mine. It is also confusing that they refer to the Regulation that says they do not need a signature. Greatful for your advice on what I should do next? If the outstanding amount is still enforceable and if I need to stop payments and write to them. Also are they still in a position to apply a CCJ on me? Thank you

  23. Hello All, I have received the first response of my request for CCA and would be grateful for your advice and direction as a result. The request was for section 78 and I used the template provided on this site. I have attached a copy of the letter. There was 'No' Signed Statement of Account enclosed. Of the other two stated enclosures Nos 2 & 3 there is no signature and the signature box is empty; however I am confused as to why they have quoted regulation 3(2)(b). For background the card was originally applied for in approx 2003. If you need enclosures 2 and 3 attaching please let me know. Any guidance is appreciated.

Dx I will take your advice and post when responses are received - spent the evening doing the letters for the CCAs, got the postal orders today at a cost of 50pon top of the £1 for each postal order - the cheek of the PO. Ive even made a record of which postal order has gone in with which letter (10 in total) Will keep you updated under a separate thread and apologies again H for jumping on yours.
  25. Thank you H, My situation is one that I have been paying a moderate amount to many (10) Loan and credit card companies under an arrangement since about 2008 now. Had I gone IVA hopefully it would have now disappeared. I decided to do my own self help and agreed a monthly sum to each prorata that I could afford. I'm on the opinion that I have probably now paid off the original amount I borrowed albeit without the interest and so think enough is enough and if I could stop paying them as a result of them not providing a CCA then given my arrangement has been in place for over 7 years I would say my concious is clear if I didnt have to pay them anymore. Wish I had discovered this site years ago
