  1. Of what I can read it says "Repayments will be by monthly pa or 5% of the outstanding balanc statements you receive will show for repayment"
  2. Hi Lantana, It states on this application that my credit limit will be notified to me within 7 days of acceptance of this application. It does give the interest rate goods and services 2.25 % and cash 2.25% but it is a bit unclear as this is the bit that was chopped off!!

Hi Lantana, The agreement is my "application for a debenhams personal account" and states "credit agreement regulated by the consumer credit act 1974" It does have my signature (although their photocopy to me only has my initial not the rest of my signature as somebody has cut if off when photocopying it). It is the agreement that I signed and filled in by myself HTH
  6. Hi everybody, I need a bit of help, I sent CL Finance my letter on 13 January 2007 and they have come back today (their letter dated 16th March with a copy of the signed agreement. I have just counted the days and I believe that they are outside the deadline, but I am a bit nervous of not paying them. Any advice?

I am very disappointed that you have seen fit to make me an ‘offer’ of payment less than the charges you have unlawfully levied on my account and as detailed in my letters of 27th June 2006 and 11th July 2006. Where somebody collects money from me in an unlawful fashion I take the matter very seriously and by you making me an ‘offer’ I feel that you are not treating this matter with the same level as seriousness as myself. I would like to make it abundantly clear that I do not accept this offer as full and final settlement of the charges unlawfully levied on my account since June 2000. However if you wish to make this partial payment of £1980 then you can do so by crediting the above account or sending me a cheque. Whilst reviewing my accounts it would appear that not only have you collected bank charges from my account in an unlawful fashion but you are still continuing to charge me interest on your unlawful charges. In February 2003 you recommended that I consolidate the overdrawn amount on my bank account and the outstanding balance of my HSBC credit card into a managed loan. This idea had already been suggested to me a few months earlier but at that time I rejected the idea due to the adverse effect this would have on my credit record. However in February 2003 after speaking to your staff and due to the increasing number of bank charges levied on my account I felt I had no other option but to use a managed loan. Since February 2003 you have charged me £771.97 interest on this managed loan, which is in essence interest on your unlawful bank charges which between June 2000 and February 2003 (only 2.5years) totalled £1,892. I am therefore looking for repayment of this interest you have charged me on your unlawful bank charges. I require payment in full of £3,099.97 (£2328 unlawful bank charges plus £771.97 interest on these charges to date) within ten days of the date of this letter. On receipt of this payment in full then I will consider this matter closed and will not pursue any further action. However if I have not received payment from you in full within ten days of the date of this letter then I will continue to pursue my claim plus costs through any legal means at my disposal. I am enclosing the original schedule of charges on my account already supplied to you, I have now updated this to include the interest charged to me through the managed loan to date.
  10. Hi there You can claim the interest back on the managed loan if the reason you took out the managed loan was because of the unlawful charges. We did this with my husbands HSBC claim and they repaid the interest on his loan without any questions. I will see if I can find my original thread
  11. Strange that they won't accept that these are penalties, because when I spoke to a lady at HSBC service centre she admitted that these charges were to deter people going overdrawn, so they ARE penalties.
  12. Battleaxe, I have just seen that!!! Blxxdy cow!!!! her response to unfair charges "just keep more money in your account, or arrange an overdraft" yeah right!!!!!
  13. Abbey have sent me a letter telling me to confirm to the courts that the claim has been settled. I thought you might like to see my letter to the Judge... Thought I would stick the knife in the Banks back, just one more time!!!! lol They will get a copy of this letter _______________________________________________ 13 January 2007 District Judge Dudley Southend County Court Tylers House Tylers Avenue Southend on Sea Essex SS1 2AW Dear Sir, Tigs33 V ABBEY NATIONAL PLC CLAIM NO 6 QZ 49715 Further to the hearing on 13 December 2006. I can confirm that the claim has now been settled. However I would point out to the Court that although Abbey National advised you that the claim had been settled on 13 December 2006 the money was deposited in my bank account on 20 December 2006 (by way of a cheque) but did not clear their system until 27 December 2006. So for Abbey to say they had settled the debt on 13 December 2006 was inaccurate and I believe a further delaying tactic for the bank to settle the claim. To take 14 days for the bank to credit this money to me I believe is unacceptable and should be brought to the Courts attention bearing in mind similar cases being heard by the Courts. I would like to take this opportunity to thank you for your time on 13 December. Yours faithfully, Tigs33

  15. Thanks everybody well the money has been well spent, some of it has paid for a new bathroom suite and the rest has been invested into premium bonds!! lol

I know what you mean Armsoft, after appearing in the court for the case management meeting and meeting the judge, I SO wanted Abbey to not pay me before the 16th Jan (when the case was adjourned to). I still have my account opened with them and there was money in that account so it is looking rather healthy at the moment. I don't have an overdraft with that account as I tried about 3 years ago to get one and they said they wouldn't give us an overdraft until the account had been in the black for 6 months, that was a bit difficult with their charges!!! robbing banks!!!

  20. Wooohooooo they have paid the money (a cheque ) into my account £3,567.32 it will clear on the 27 December, just in time for the sales Donation to the CAG will be made on the day it clears!!!!!
  21. WOOOOHOOOOO money is now in my account Off to make a donation to the CAG!!!
  22. Spoke to Abbey today (I received their letter dated 11 December today ) and told them they have until Thursday to pay this money into my account. I will wait until then and if I do not receive the money I will write to the courts and just send them a copy of my letter. The lady I spoke to was very flustered that I had not received my money!!! lol told her I was more than happy to refer this back to the courts and the judge wasn't very happy with them......

Karnevil, I was sort of hoping that they banks would drag their feet with the payment and that it would go back to Court, it makes me wonder what the Judge would do if they haven't paid me by the 16 January (the Judge only gave the bank a month to pay me) The letter the Judge sent me said that we have now settled the claim, well to date they haven't. I phoned the Solicitors yesterday and left a message, I will phone the bank on Monday and speak to somebody.
