  1. As expected the charge was granted. Their solicitor collared me outside in the waiting room and made it known I had no chance so I went in and said I had paid for the court case so thought I would attend anyway to tell the judge they had lied about me. Waste of time really.

  3. Thank you. I don't know why the courts allow these people to get away with things when they don't tell the truth. Lets hope court isn't too bad!
  4. Thank you. Is this still the case when they are saying I haven't paid but I have? And can I now object to the CCJ because of the dates? I have no doubt they will grant the order today but I want to make clear they are telling lies about me.
  5. I didn't defend the claim because I didn't feel I could (I had not responded to their letter).. The charge was made before my first payment for the CCJ was due? It is a single mortgage. Thank you.
  6. I have a court hearing this afternoon regarding a charge being put against my property. Previous to the charge a CCJ was issued.. From the beginning: 10th June 2014 I received a letter from Restons to say I had 14 days to pay. . on the same date they requested the CCJ (date on blue form) I was required to make first payment for CCJ on 29th August. Charge against property was requested on 8th August.. In addition to this I have had Restons not informing me of court dates.. Can anyone offer any advice please? (I am sorry this is rushed I am at work and trying to prepare anything I can to take top court with me)

The value is over £7000 now that they have added CCJ costs and the costs for registerting the charge with Land Registry etc. I am not sure how these people sleep at night. I have many other creditors who I regularly pay and they have not sought a charge on my property. If they will grant the charge anyway I am not sure it is even worth me attending the hearing, I may as well admit defeat and try to pay the debt as quickly as possible.
  9. Thank you for taking the time to respond to me. The debt is in my name and I am the sole owner of the property. Doesnt look like I have a leg to stand on.I intend to try and put my case forward, although I am not sure how I can do this. I also need to try to transfer the hearing to a local court as it is currently due to take place miles away. Do you know if I need to send a letter explaining my case or if I need to do this in court? I will be on my own as I cant afford a solicitor.
  10. I had a debt with Welcome Finance. It was passed to Cabot financial then to Reston's solicitors. I was issued a CCJ in July and my first instalment was due to be paid on 29 August (I paid this). However, I have received a court letter saying Reston's have put an interim charge on my property due to missed payments? In addition they signed the legal forms on 8th August well before my first payment was due. Is there anything I can do? I have offered to pay an increased amount each month but they rejected my offer. Any advice would be appreciated.
