  1. i sent off a letter explaining details about my sons health and financial situation, i also included a financial statement... the first payment of £50 is supposed to be paid by today and as of yet i have not received anything form the court regarding my request to reduce payments for my son. i have tried to phone the courts but all i keep getting is either line busy or automated messages that hang up after a certain time. just wondering what i can do now as my son is getting extremely worried as he is unable to pay the £50 in full. any help would be appreciated thank you

  3. thanks for the reply. my son is 22, he moved into the care home april this year, this was due to his deterioration in his mental health, although he has had problems all his life as far as i know this ccj was for a pay day loan he took out whilst still living with us. I have recently found out that he may have taken out a number of these prior to moving out of the home. due to his learning disability he isn't really able to manage money properly which got him into this mess in the first place but because of his age we didn't realize the extent to his borrowing as he has control of all his finances. i am going to try and check his credit rating later today when he calls up. what would be the next step? thanks
  4. Today i got a letter for my son he no longer lives at our address and has not for some time. He has had a lot of mental health issues and is diagnosed Autism, learning disabilities and also depression. At present he resides in a care home with his only income DLA and ESA. out of that money he has to make part payment each week towards his stay in the home. He has to pay £100 per week towards his care which he pays out of the money he receives. he called around today to get his post and in there were a couple of letters one from the court and one from cohen cramer... the court letter stated that he had not replied to the form and therefore it was judged that he owed just under £500 and should pay £50 per month starting the 14th November. .. the other letter from cohen cramer said the payments should be made to lucas credit services. all his post is delivered to our address and we give it him whenever he calls up. he is adamant he never received the claim form and as far as we know nothing ever came in the post. the fact is the court made a decision but unfortunately due to is financial situation and the fact he didn't receive the form is there anything we can do to sort this out. there is no way after paying out everything he owes he can afford the sum asked for per month and also as he does not live here what can we do regarding the order. any help would be greatly appreciated thank you for looking
  5. i have sent off a letter to hold off any action for at least 30 days stating i am seeking financial help and building up a financial statement. the thing is i have already checked my financial situation and my incoming is less than my outgoing meaning there is nothing to pay my non priority debts. would my next step be to send them a letter asking for them to consider writing off the debt and then if that fails asking them to reconsider their decision, if they still say no then just offer a £1 token payment
  6. i know how much Lowell and their solicitors like to file county court claims by the ton if there is a remote chance they could get something out of any. the thing is if i write to them asking to hold off on any action until i receive documents i requested in the form of the SAR to shop direct, and also to enable me to seek legal advice, would they hold off or still try and put in a claim? if i did write to them would it be a good idea to include certain things like financial difficulties and stress these difficulties are causing me just so that it is on record if they do file the claim.. . also if they did put in a claim after i had asked them to put a hold on it would, that go against them if they did file the claim with the factors i had outlined in my letter? after doing a budget planner i have an extremely small amount to offer all my creditors. I may have to go down the route of token payments in the future anyway but until that time i would like to get as much info as possible . thanks for all your advice
  7. the one page statement printout has a shop direct logo in the top right corner. both myself and my partner decided to take a look on noddle to check our credit scores... seems Lowell has been busy buying up debts. there are 4 entries between us both showing up as we owe Lowell sums of money. i think maybe our only solution is to get a financial statement off to them and offer a token payment
  8. i am guessing some of the items may have been on buy now pay later but looking on the statement provided nothing is shown regarding which items these were.
  9. today i received another letter form Cohen Cramer, with it was enclosed a 4 sheet credit agreement also another copy of the letter of assignment plus a basic statement showing the totals for goods, interest, delivery and charges and also payments i made. On the statement it also shows goods ordered in the last 3 years and payments during that period also. On the list for goods ordered there are 2 items that under description have a '?' i am guessing that they do not have the items on the system and maybe on a basic search they are unable to link it to an item (the items with no description totaled around £150) the original goods were for a total of around £800 (which was my credit limit) after interest which was added just before the debt was sold on, delivery and charges for missed payments/letters/etc.. the total was raised to over £1,300 i can remember writing to shop direct explaining my situation and asking for all charges and interest to be frozen as i was having financial difficulties but they refused stating that unless it was done through either the CAB or stepchange or similar they would not be able to do that. again the letter states from Cohen Cramer if not contacted within 14 days legal proceedings will be taken any advice would be helpful
  10. is it a good idea to respond to the last Cohen Cramer letter that says if i don't respond within 14 days they will continue with court action just to hold action so I get all info from Shop Direct?
  11. the catalogue debt was from possibly 3 years ago... at the time i was struggling to make payments and was in quite a bit of financial difficulty caused by being off work sick. i did notice the days leading up to selling the debt on shop direct added an enormous amount of interest to the amount that was owing to them. Around £360+ was added onto the balance
  12. around 11 months ago Lowell started sending letters claiming money owed to them for a debt they bought from shop direct. the amount they claimed was ridiculously high when i received a letter i simply just binned it. on the 26th April 2016 i received a letter from Cohen Cramer saying that because i have ignored all previous letters from Lowell and Lucas Credit Services (client agent) if i did not contact them within 14 days they would issue a claim in the County Court. I decided to write to both Lowell and Cohen Cramer. I sent Lowell a CCA request I wrote to Cohen Cramer explaining that i had requested the info from Lowell as to ascertain where this debt and the amount claimed had come from. I asked Cohen Cramer to hold court action until i got the info. After i sent both letter dated 3rd May 2016 i received a reply from Cohen Cramer dated 10th May 2016, stating that they had received my letter and that their client has given them a minimum period of 45 days from the date to send the documents which i presume they was referring to my CCA request. I then received a letter yesterday, dated 16th July 2016, attached to the letter was a double sided photocopy of a letter of assignment, but no credit agreement (not even the standard 1 page photocopy with no signature). This was not what i asked for from my CCA request to Lowell. They have now stated that if no reasonable proposal is forthcoming within 14 days then legal proceedings will be instituted. Just wondering if anyone could help and give some advice as i am unsure of what to do next. I was wanting to contact Cohen Cramer again but i am not sure what to put in my letter. any help would be greatly received, thank you for your time Letters From Cohen.pdf

[ATTACH=CONFIG]60233[/ATTACH] i sent a SAR request to provident late august with the standard £10 cheque... stupidly it was not sent recorded... it did have proof of postage but the receipt has been lost. i have not heard anything back from provident and the cheque has not been cashed since the 4th august when i received a letter from lowel saying there was no need to contact them and they was putting the account on hold, i have had 4-5 letters still saying the debt is still unpaid and they haven't heard back from me!!! today i received another letter from lowell with the header 'Pre-Legal Assessment' i am going to have to cancel the cheque i originally sent to provident and send off another with a new SAR request, this time recorded!!! what should i do with regards to the latest letter lowell sent me? should i write to them telling them to hold off any action until i get the info i requested from provident... although the letter i received in august states they are putting my account on hold... they really need to make up their mind. as always any help is appreciated thank you
  14. after requesting the statements a number of times from Lowell i have received a number of letters back, here is a timeline of them... 22nd July Acknowledge letter i sent asking for full set of statements, lowell states they have requested statements and that they will be sent to me upon receipt 4th August Letter states they have ordered statements, states account will be put on hold, states in the meantime there is no need to contact them again. 14th September Letter states despite previous correspondents they have not received payment or valid reason for non payment... Failure to resound... etc... Yet they told me in previous letter there was no need to contact them again!!! 21st september Claiming they have provided me with info i requested... If i don't contact them within 7 days... etc.. yet i have still not received all the information i requested in the original CCA request in 2014! The only things that i received, apart from their constant letters and numerous ignored phone calls on my home and mobile numbers, were the 2 badly photocopied front pages of the credit agreements. just wondering what my next step should be with regards to Lowell as they still do not seem to have complied fully with my original 2014 CCA request, also saying they would put the account on hold and now ignoring that and starting the 'pay up or else' letters again. as always any help would be appreciated. thanks for your time
  15. well after all the problems with this company when it came to going to court they decided to discontinue the claim... i received the letter from bryan carter with the letter that was sent to the court. a few months on and Lowell have started to send me letters again regarding their claimed 'unpaid debt' they purchased from welcome finance. the letters as always states... contact us by a certain date and the account will not be transferred to a debt collection agency... this debt is statute barred and this was stated as a defense when they first put in a claim to the court. is there anything i can do or should i just simply ignore these letters?
  16. how do i get Lowell to back off until i manage to get the info from provident.. . each time they have sent me a copied credit agreement a few days later i have received a letter telling me they have supplied the information requested and i need to contact them within 7 days with an offer of repayment or else they will pass this onto their collections department.. . 7 days have already passed since their last letter
  17. i don't have any statements and i cant remember if i was ever sent any. As it was a doorstep collector i paid the money to i had payment cards that were filled in by the agent each week but i am unsure where even they are now a couple of years on
  18. i originally got a letter from Lowell introducing themselves and with it was a letter on provident headed paper saying they have sold the debt onto Lowell. on my credit file Lowell is listed a couple of times with the amounts they claim are owed on the 2 agreements. both 'accounts' are listed as 'default' status, the default dated January 2013.   19. one thing i have been unsure of is when lowell has contacted me via letter they have always quoted their 'reference number' for the debt but also an 'original account number' for provident personal credit limited. Is this number simply assigned by provident to allow easy access to borrowers details on their systems as this number is not on either of the credit agreements sent. and is completely different than the provident 'customer number' on both agreements.
  20. just received the second credit agreement now... i am guessing now they have supplied both agreements i am going to have to make them a offer of what i am able to afford to pay back now, which after a rough look at incomings and outgoings may amount to a pound... if they are lucky. at present i am in a bad cycle where i do not have enough money each month to pay everything, which leads to me borrow money from friends and family, after paying them back i then need to borrow more again the following month. can anyone please advise me on what i should do now as the constant money problems are causing me a lot of worry each month. also i would be grateful if someone could point me in the direction of an in depth budget planner that that contains most incomings and outgoings and one that can include payments that are weekly, fortnightly, etc... and adds it up as you input figures thanks
  21. when i sent a CCA request to lowell i just sent the standard CCA template letter. on the fist letter i received from lowell they claimed the total sum of money was made up of 2 different agreements... they listed 2 different account numbers each one had a different date of agreements, one agreement in 2010 one in 2011, there is a 9 month gap between each agreement. That was why i decided to send the CCA request in the first place. The agreement they sent me was one dated 2010 which i would have thought would been the lesser of the 2 agreements as it must have been paid frequently between then and the one dated 2011.
  22. is there anything i can do about having to wait over 7 months from the original request to actually receiving an agreement.. . and only then sending only one when they claim the sum of money is derived from two agreements? seven months is a long time to wait for a CCA request. .. it took them over 2 months before the letter stating they was closing the case because the agreement was no longer available. .. then over 4 months after that they send me one agreement. today i also received a statement of account from lowell that is obviously showing the amount that is claimed when they purchased the debt.. . it had an original provident number on it but does not mention either of the 2 agreement numbers lowell stated this sum is for and how that figure was arrived at. should i give then a time frame as to supply all the agreements and statements?
