  1. Hey Guys, Just to let you know where I am at.... Mcol for full amount (aroun £1300) went in on the 17th October and acknowledged on the 20th October. Haven't heard a peep from them yet and starting to get impatient as others are paid out around me. Finger nails dissappearing each night.... Quick question - do Cap 1 contact you directly or do they go via lawyers (this is what happened with my HSBC claim)????? LittleMissFoolish
  2. Eventually I recieved my statements and sent my first letter on the 12th September. My LBA was due to be sent on 26th September, but I have been out of the country for the last week, so haven't had a chance yet. When I got home last night there was a letter waiting for me with the standard 'we believe are fees are fair', 'you signed the contract' but 'here is the difference between £20 and £12 for your claim offer'. I have claimed for £1050 and they are offering £414. I am nervous about all the cases going to the Mercentile Court and worry that if I don't accept this I may risk not getting anything for along time. So what do I do now? 1 - write my LBA and include a paragraph acknowledging their offer but only accepting as a partial settlement (is there a standard paragraph for this). or 2 - accept the amount offered and whilst substantially less, it means there is no chance of the case going to moneyclaim and then being transferred to the Mercentile Court and me not getting for a long time and after a lot of hassle? I am not a total wimp at this (I was succesful for a considerably larger claim against HSBC recently) but htis new turn of events is really worrying me. Cheers, LMF:confused:
  3. Having a little panic attack. I recieved all my money in a cheque from HSBC at the end of August, which I have now cashed and basically spent. I was sent a form from the court which I was suppose to fax back to DG Solicitors and the Court to say I had recieved the money. I think I was suppose to do this by the 18th September. I totally forgot to do this!!!!! The case is still showing on MCOL as 'defended' not 'settled'. Should I now fax the form back anyway (can't do this until tomorrow as it is at home) and should I ring DG Solicitors or the court today to tell them I am doing so. Is there any chance I have stuffed this up so badly that they will want their money back???? Feeling really sick in the stomach about htis and beating myself up for being so silly as to forget. Any replies most appreciated!
  4. Well my 40 days are up on Friday and I have not yet recieved my statements from Cap 1. I recieved a holding letter acknowledging my request about a week after sending it, but no action yet. What do I do if they have not sent my statements within the 40 days. I am really keen to get them and start!!!!!!!!!!!!
  5. Hey Everyone, Bit of an update. I actually wrote this before I went on holiday two weeks ago but for some reason it didn't post....probably my not-so-ace IT skills! After filing the MCOL, I recieved a letter from DG Solicitors requesting a breakdown of charges. I faxed this straight back to them and two days latter on the 16th August I recieved an offer for the full amount including interest and MCOL fees. I faxed back a letter accepting this and requesting a payment by cheque. They had absolutely no queries about this and I recieved a cheque from HSBC the following week. In the meantime HSBC deposited the amount into my account automatically as well but then on the same day withdrew it again. The interesting thing about the cheque from HSBC was that it was filled in by hand with a biro. The first time ever I have seen a sign of 'manual intervention' from HSBC! Oh the irony.... Anyway, loving the cash. Paying off bills and a couple of small treats for me too. Have told all and sundry about the site and donation on its way. Now starting my claim against Capital One.   6. Well I recieved a letter from DG on Friday (11 August but dated 9 August) requesting a breakdown of charges. I faxed a reply this morning (which I will also pop in the post at lunch) with a copy of my schedule of charges and noted that I had already sent these to HSBC twice before. Also told them I would be out of the country after this Friday (19 August) and that they could send letters to me via email as well to expediate communication. Oh this is so dragging out! Fingers crossed it will all happen this week - I would love to have it sorted before I go away on Friday.

  8. Quick update. HSBC acknowledged the claim on the 4th (just after I last posted on here). The courts sent a letter on teh 8th saying that HSBC intend to defend and they now have 28 days. Getting totally stressed about getting an offer soon as I am going on holiday for two weeks at the end of next week. Ideally I wanted this all sorted by then as I won't be around to negotiate and don't want to miss their letters. Especially as I want to request the refund to be by cheque. I thought I saw a post which had a nicely worded letter to DG Solicitors saying that were not going to be contactable for a period of time. Does anyone know where this is? Oh I do wish they would offer soon - the suspense is absolutely killing me!
  9. Congratulations!!!!!!!!!!!!!!!!!!!!!!!!!!!! That is fantastic news. I am claiming almost the same amount and started before you....so now I am hoping that I too will get a letter soon. I haven't even had a sniff of a partial offer so I am feeling like stealing your crown of the 'unluckiest person in the world'
  10. Hi Weezypoos, I have been following your thread with interest as we are all on a similar timeframe. My MCOL was deemed served on the 1st August and it was acknowledged by HSBC on the 4th. I recieved a letter from the court on the 8th saying that HSBC intend to defend. I have not heard anything directly from either DG Solicitors or HSBC. I am starting to stress a little now about the timeframes as I am going on holiday for two weeks next Friday (the 18th) and I would have hoped to hear something by then. I want to get a cheque for my refund, so the sooner I can start negotiating htis the better... Stress.Wait. Stress.Wait.Stress.Wait. ......arghhhh! But it will be worth it in the end I'm sure.
  11. Just a quick update.... My claim was issued on the 27th July and deemed to be served by 1st August. This means HSBC has unti lthe 15th August to reply. I have not heard a peep out of them and the MCOL site is not showing if they have acknowledged the claim yet. I am getting impatient/nervous about how long they are taking to acknowledge this claim. Seems that most peoples cases I have read on this forum have their claims acknowledged within a couple of days of serving the MCOL. How is this acknowledgement made? Do you get a letter or does it just show on the MCOL site? HOw long does this MCOL process usually take with HSBC? Any insights or answers most gratefully recieved!

  13. Hi SAR and Barney, Sorry I can't offer any wisdom or experience on this. I submitted my MCOL for a similar amount yesterday and also want to be paid by cheque. Feel very strongly that it is my money and that I should be able to control who I pay back and how much (and if I want to treat myself with a little bit of it too then that is also my decision). Good luck with your negotiations. I just wanted to let you know I will be watching this thread with keen interest and that your wisdom and experience on this is invaluable! LittleMissFoolish
  14. Just sent off for all my Cap One bankstatements. I have had a credit card with a tiny limit on it for years and it has been over the limit due to £40 charges every month for years. Keen to see what it all adds up to......
  15. Rachnaid, Being brave and optimistic, I am fully expecting an offer from DG Solicitors for my full amount as a result of the MCOL. I am planning to write back at this stage and accept the full amount but conditional to it being paid by cheque. I will also cross out any confidentiality agreements. (Hope Mr Langdale and DG are reading this post so they know I am determined to stick it out to the end!). From what I have read of the other poster having probs getting paid by cheque, he did not specify in writing at the time of accepting the offer by DG that he wanted the payment by cheque. He had to fight for this afterwards and ended up settling for having a loan paid for more than he was claiming for (hope I have read and remembering this story right). I will keep you informed of how I go with it. These boards are fab for reassuring people in similar situations!
