  1. Hi Andy Thanks for taking the time to review. They have never used a correct address for anything!! As you will see, Egg sent a letter to 1 address stating that account passed to Capquest, and Capquest then sent their account passed letter to a different address, within a matter of days!!! They have said in the statement that they have posted a notice of default, but, as they had registered nothing on my credit file, am I right in assuming this could just have been a letter? Do they need to prove where/when they sent this? I am fairly hopeful that I can get the judgment set aside, but as I am not a well-read solicitor (or trainee in this instance), I am obviously concerned that things may not go in my favour in court. What do you think is the appropriate course of action? Thanks again
  2. Hi mike. They sent a witness statement and payment schedule but I can't check bank statements nor do they have any written correspondence of me admitting the debt to Egg. Any ideas what to do are appreciated
  3. Sorry for the late reply, things have been a bit of a downer for me lately. I have today received a statement from Capquest (ahead of the court hearing) saying that I was paying them for a debt they purchased from Egg (in 2005 when it defaulted) up until 2011. I have no recollection of this, and can not access my bank statements from this far back, any ideas what can I do please?

  5. Quick update, I have called and written to both Egg and Barclays (as advised that they may have purchased Egg accounts). Neither company has a record of me?!?! I have now applied to the CCJ to be set aside so will update when I have a reply. Thx again for all help

  7. Hi Andy It may be me being over cautious, but by me calling Egg, would that cause any potential issues with the claim/CCJ etc? Also, I don't have any account info/reference numbers so if my case has been passed on by Egg, how could I obtain the info? Thx again

  9. I will contact the court tomorrow for the claim form, however, how can I find out default dates if egg and Drydens are ignoring me? They've now had my current address for over 6 months and have made no attempt to contact me!!! Thx

  12. yes, there is a CCJ, but no record of an outstanding/unpaid/defaulted debt, whom it is owed to, or when defaults occurred etc.?! what i am trying to establish is do I have to pay the £155 if it as an unfair CCJ that i have received no contact about? thx
  13. thanks andy, it is from september 2014 at an address which i left in january 2014 there is nothing on my CRA file about any owed debt though?! hence the confusion!! thx
  14. thanks dx since finding the ccj, I have asked for proof of me owing the alleged debt, but have not received a reply/proof. how am I able to prove I don't owe it/it is SB'd? also, if they weren't a creditor, and I had not had contact from them for many years, how/why should I inform them? there is no outstanding debt on my Experian record, nor had there been. thanks again for your help
  15. Hi all, As I am soon to be applying for a mortgage with my wife I have been doing some 'housekeeping' with my credit file. Experian say my record is excellent, I have no missed payments, am on the electoral roll, a low amount of debt and percentage used of available credit - however, there is a surprise CCJ on my file, from of which I am not liable to pay. It is for a debt that is easily 10 years old, so I figured would be statute barred, as I had no contact about it for many years. It was sent to my old address around a year after moving out, (I had not informed anyone, as had received no contact regarding the alleged debt), I had setup a royal mail redirect, yet received nothing during the 6 month redirect period. I understand i need to complete a N244 form, but as I wish to remove the CCJ, am I liable to pay for court fees, as I am concerned I would have to if the CCJ is unfair? Many thanks in advance for help with this
  16. *UPDATE* So Egg say they can't provide (guessing they have none) any details. As they are unable and Drydens are unwilling, am I liable to pay the £155 set aside costs? Thanks
  17. Thanks dx I have no idea on account numbers or anything as it is all so long ago, are they able to look up my info and provide details over the phone?
  18. Would that then be classed as contact regarding the account and therefore open me up to the CCJ etc.? Thanks
  19. Hi dx Thanks for your reply. There is nothing on my credit report, with noddle or Experian showing that I have made payment or indeed had any contact whatsoever with Egg - ever?! I am very keen to either remove/set aside the CCJ as I will need to apply for a mortgage soon and I know this will have big implications. Thanks again for your help.
  20. Update. No word back from Drydens and it is 14 working days since receipt. Am I now entitled to go ahead with removing the CCJ? Thanks

  22. Thanks dx, will do both recorded today. If it does take over 30 days will I still be able to remove the CCJ if I prove it statute barred?
