  1. Thanks Caro - I haven't signed anything with the care home as yet - I wonder what the council can do to me if I hold back payment in order to pay off previous debts first. My mum is getting the legal amount each week from me of approx £24.50 for personal use. How can the council take action to secure the funds if the client is suffering from Dementia ? is there a court order that can be issued ? I wouldnt think they would issue a CCS would you ?

Hello Caro I have started to take a harder line as some of the collection companies just dont care - Debt balance of approximately £30,000 including utilities / credit cards etc. My question is that can the council force payment if I dont meet with them until the previous debts are cleared ? and would the sue my Mum or myself even though I dont have a contract with them ?

My mother has had to go into a council care home and she has sadly run up large debts (she suffers from Dementia so forgot to pay the bills) Council want to take her small pension from here but I am left to deal with the debt agencies. Is there a way to secure her pension in order to discharge the debts that has been run up. Council have said if they don't receive the financial report they will charge her full price but how can they collect the full price if she doesnt have any money after the debts are paid from her home (which was rented)
  4. Ive been in the ESA Assessment phase for just under a year and won an ESA Tribunal at the First Tier last week which placed me in the WRAG group. I have received a letter this morning confirming the backdated payments and new amount to be paid to me. This letter also states that my ESA will stop in a months time?! What are the alternatives for me once this ESA stops?!
