Hi Guys I'm up the creek without a paddle for £65,000.00 its a long story but I won't bore you, all I will say is that this creditor is partly the reason I owe them the money for supplying rubbish products. My main concern is the Personal Guarantee they are trying to use against me. Here is a copy of what I signed, the missing information is not relevant Page 1 title: Heading = Suppliers Name Sub Heading = Credit Account Application Form Nothing of further relevance mainly info of address's etc Page 2 Heading = No Heading Sub Heading = No Sub Heading Signature Line and Date with text I have pasted below which is placed above the signature line Agree that : - 1. I shall be personally responsible to you for the price of all goods that you may supply to the above named company / person and that my liability to you shall be in respect of the whole of the debt without exception and for which liability is unlimited. 2. This guarantee is a continuing guarantee and security and my liability under it shall not be affected by your giving time or any other indulgence to the company / person above. I reserve the right for myself or my personal representative, to revoke in writing, this guarantee at any time as to all future dealing by the company with you after the date of such notice. I SHOULD ALSO MAKE YOU AWARE THAT AT THE TOP OF THE FORM IT HAS A HAND WRITTEN CREDIT LIMIT OF £ 1,000.00. I feel I Guys I'm really worried, I'm a good honest chap and only set this company up as I was discharged from the Army after becoming injured in Afghanistan.... I have a house with 15k equity in and I'm worried because I don't have dependant children that they may be able to take it. What can I do? Or will I successfully fight this in court... I believe the courts are fair so please advise if this is not the case.
