  2. Hey everyone!! Sorry I've been away so long, had taken my eyes off the ball for a wee while...... But have found that they're at it AGAIN!!!! Since I successfully reclaimed my charges from the RBOS in 2007 I decided that I'd spend tonight reviewing my finances and checking bills and statements etc, and when going through my bank statements have found that since July 2007 they have charged me £28.00 on top of my Royalties subscription fee onto my statement a total of four times.......aaaarrrrrrrgggggggggghhhhhhhhh!!!!!!!!! Do I rant and rave or write complaining to them, where does the law stand on setting about claiming again?? Lush

Morning all and great news, I posted my LBA out as scheduled asking them to consider my case as a harship case, on Saturday I received an offer to refund the full amount of my claim including interest!!!!! I've to sign the form and I will ask them to not credit my card account but to credit my hbos bank account instead........so will wait and see how long it will take them to pay up! A great big thank you to you all for your support and help in this case!! Ppxx

Hi Manic I wonder if you could possibly help me with my claim, I was going to state a hardship case aswell for my claim agains Halifax credit card, I'm going to do in income and expenditure sheet, but am having a blank about what to say to justify my argument with them as a hardship case, do you have any ideas??? Thanks in anticipation

Can anyone tell me if there are certain categories for 'hardship' cases, I know that this will apply to single parents, people on benefits etc, but I am not a parent and have employment, and find it extremely difficult to continue getting charges on my card account..........I have a single income to pay my mortgage etc and am unsure whether I would qualify for a hardship case.....does CAG have a list of categories for this?? If so,I'd really appreciate if you could point me in the right direction.....thanks in anticipation

Well, I've left this claim slide due to personal and work commitments and circumstances but the final straw was earlier this year when they started charging me late fees again and I had been making my minimum payments of £5 and they changed the minimum payment to £10 without notifying me........so I've resurrected this claim and sent a preliminary letter asking for it back on 04 April, received a letter back from Halifax dated 8th April stating: " With reference to your recent communication about fees and charges on your account, we regret that you have found cause for complaint. We are keend to deal with your concerns as quickly as possible. I have asked for one of our Complaints Advisors to investigate the points you have raised and you will receive a response from ous within four weeks, in-line with Financial Services Authority regulations. We will of course, endeavour to replay to your complaint as soon as possible." I'm unsure if there has been any change in the way that HBOS credit card deals with these complaints since July last year (when the refused to settle), and was looking to see if I should still send an LBA on the two week anniversary of my prelim letter or wait the four weeks for HBOS to respond?? Could anyone advise please???

  12. Hi Alpha Many thanks and hope you enjoyed your break and also your money!! It's hard work spending it I tell ya!! NOT!! Still working on the HBOS for my credit card charges so they now have until the end of this month to get a response to me for my charges so still playing the waiting game!!! Watch this space!!! Have just sent an email and letter to HBoS asking for progress on my claim as I haven't heard a thing from them since their last letter....I'll post it tomorrow recorded delivery aswell just for the belt and braces effect and to continue to be a fly in their ointment. Their 8 weeks will be up on 01 August so we'll see how and when they respond!! Lush

  16. Many thanks Moneyhelp It really motivates ya when you have a positive outcome on another issue, first £2k compensation for my employer from BT, £1.7k from RBOS, here's hoping I'll get the required response from Halifax!!! Lush , Jeez, I can't wipe that smile of my gob!!!!

I received a letter today from our friend Sandy Watt offering me settlement of what I claimed (less interest of course!), "as a gesture of goodwill". I'm going to accept it, I never thought I'd get this far when I first embarked on my crusade with these guys, but boy was I wrong!!! Now just to get the cash into my bank account!!! Thanks to EVERYONE who has helped me with this thread!!! Couldn't have done it without you!!!!! Bring it on Halifax Credit card is what I say now!!!!! .......where's that celebratory wine glass??? History: Initial S.A.R submitted:23/06/06 - No response 2nd Letter to Data Controller sent: 16/08/06 Letter asking for charges back sent:05/09/06 Refusal letter from RBOS dated: 29/09/06 GAVE UP THE GHOST DUE TO PERSONAL CIRCUMSTANCES GOT MAD WHEN THEY CHARGED ME AGAIN EARLY THIS YEAR Got my 2nd wind and re-calculated my charges Request for charges back letter sent: 03/05/07 RBOS response acknowledging receipt of letter: dated: 07/05/07 Email and paper copy to S Watt of LBA submitted: 17/05/07 Further acknowledgement of claim from S Watt via email: 17/05/07 Enquiry as to how my claim was progressing via email: 06/06/07 (also threatened using FOS) Acknowledgement from S Watt via email dated: 06/06/07 Letter to S Watt informing them of complaint at FOS sent via email and recorded delivery: 15/06/07 Acknowledgement of receipt via email from S Watt on 15/06/07 Offer letter dated:21/06/07 Received: 26/06/07

  20. Still nothing from RBOS, and under a week until I send my complaint to the FOS, which is fine, I think if I don't have a response by Thursday, Mr Sandy Watt and I shall have a telephone conversation.....

So....that's the letter to Sandy Watt been posted registered mail and also emailed this afternoon....I received a very prompt response from Sandy via email to say: Dear Miss Lush Thank you for your e-mail. Please be advised that we will issue our response to your claim, within the time-scale, set by the FSA. Yours sincerely Sandy Watt By my calculations, that leaves them up until Thursday 28 June. God, I really hope I hear a positive result before then, and I hope I'm on the right tracks...time will tell I spose. Lush
  23. Yeah I also claimed for referral charges on my personal account and am waiting to hear back. The referral charges (well my understanding of them) are that this is the charge they charge onto your account if you have had a standing order or direct debit knocked back due to whatever circumstances, lack of funds, overdrawn etc. Hope it helps. Yeah the small claims totals are apparently between £750 but I've been told for anything over the £1500 mark then it's better to go the FOS route, have a look at my thread for more info on this.....as I said, I'm also new to this and if you want more guidance on it do have a look at the FAQ's etc at the top of the Royal Bank of Scotland pages, they are really really helpful. It sounds like your ready to send off your prelim letter and spreadsheet of charges though from what you've said. Remember to stick to your timetable though and be very vigilant about it!!!
