Is there any way what i have done can be left for now due to my time etc im panicking and worried i wont have the time to re scan everything thats been put away again it took me all last night to do. when i have a lot more to do as well as my health and other problems etc. Then i would have to wait for help from people on this site before having to do anything my self.. its just so over wealming i cant do it all in such a short time and will have to go into a hearing unprepared and unsure of what to do.. Please i am very new to a lot of computer stuff and need to have this up here now cause i have only till tomorrow to get the help. . and have a lot to still do to prepare.. im not sure whats going on with the scans but its the same as i usually do it and doesn't take long to add just plays up some times and wont finish or add on.. i have no idea how to change the dpi and i am running out of time i should have finished all this by now so i can work on the rest. . please can you help. its taking so long doing all this i don't have the time. And don't understand everything regarding pcs.
  3. Many thanks for your reply and help I really do appreciate any help you can give me. To answer your questions first: 1. Yes I sent Littlewoods a S.A.R. request a little while ago including the £10.00 fee required, and recently had the details back. I am very confused with this, due to the way it is set out I will add to the attachments 2 pages of examples so you can see this is what it is like through out and small amount of pages. The dates are from 01/03/2008 to 31/03/09 not my original dates I opened the account some where around 2006 and the hover was purchased around 2007 yet I only seam to have paper work dated from 01/03/2008 ? Which they sent in the S.A.R.?? 2. The statement are from no.16 to 38 then non in-between then from 135 to 149 only.?? There are no actual letters which were sent to me enclosed, I have some copy s my self and the statements seam to be computerised information. I was hoping the letters I sent to them would be included cause I cant find my copy and the phone conversations which I was told would be, but there is nothing. I needed this information to work out many things and the information needed many was back in the beginning of buying the hover approx 2007. What is the best thing to do ??? Can I do something to get the correct information?? I thought by law they had to provide me with all the paper work and everything from letters to conversations etc.??? I feel cheated. 3. Regarding the C.C.A. No one has told me send one so no I haven’t.? 4. I have spoken to the mediation service after receiving some letters from my court, and have preliminary booked 3 dates for the mediation. So now waiting on their contact. 5. But in one of the attachments/letters I am sending you, there is a short paragraph from bryn solicitors?? starting I need to attend a preliminary court hearing 29th April 2014 before my mediation dates. I am confused due to letter seams to be a copy sent from the solicitors of the other side (lowells) and not the court its self.??? They have also stated they will not be attending the 29th April, but to allow the paper work in its place.?? Not sure what to do or whats happening?? How are we supposed to talk.? 6. It would seam also I was supposed to have sent a letter 7 days before the hearing to add Littlewoods as a joint But due to my illness and personal problems with my mums heart attack etc these letters didn’t get addressed straight away and 29th is this tuesday. I phoned the court and asked them what the best thing I should do is? They replied saying to let the judge know the information on the 29th april.?? Do you know anything I should do regarding this? A previous letter was sent to court requesting this before. 7. I believe I need evidence, the main evidence I have is the letter on the 16th july 2007 with them acknowledging the fault where at present they are trying to denie any of this has taken place. e.i. Me getting in touch phone calls to complain and my letters I sent but problem is I don’t have proof my self of the letters I wrote or the conversations etc especially about the dd set up with them to pay the final amounts off which would of settled the account and not got me into debt except I would still have a hover which has never worked from the beginning correctly. If you know the best way to go with this and exactly what evidence, would help?? Im pretty confused and the problems im going through and dyslexia is not helping. So sorry to add this a bit last minute but my life is so difficult at present and im making myself ill just trying to do what I can. I would be very grateful if you could help me with any of this, my court hearing is 29th April this tuesday and im very worried, I have no one to go with me and unsure of what to really do and have a pile other hardships on my back at present to fit around everything. Because so far iv been told it was Lowell's the last ones who are taking me to court and I'm now told its littlewoods so before i send the letter monday can some one tell who would be the right ones.   6. Many thanks for all your help, I will amend the letter. Regarding the S.A.R. Littlewoods were the original owner of the claim but Lowell's are the one prosecuting me at the moment and now the owners, so I believe it would be Lowell's that I send it to. Just wasn't sure if they might think it is a payment of money towards the debt but I guess I could put it in the letter explaining. and wasn't sure how to write the name on the postal order so they could claim it. Do you think that i should be doing anything else? or for future reference preparing other work letters etc ready for later.? Many thanks again roguehunter p.s. Do you also have any comments regarding the directions letter that i need to send back in to court which is above.

Just another up date while I wait your help and advise, Iv tired to complete the forms to the best of my ability but would appreciate your help and guidance in the hope I am doing the forms correctly. I'v included the form to be sent back to the court and also the letter to be sent to Lowell's and also have a S.A.R. letter to be sent to Lowell's. I would need to get these copies off in the post no latter than monday, I hope I'm on the right track but would appreciate your feed back, many thanks.
  8. I can only apologise for the misunderstanding regarding the S.A.R. I thought I was to do the counter claim and defence forms first then send on the S.A.R. latter. I also have dyslexia and struggle some times with paper work that I am not used to so this has not been easy for myself and taken many hours to work out and do, I hope this explains myself a little. Thank you so much for all your help, patience and understanding regarding these matters. Just to let you know also I received a letter today from the court I will attach the letter and form that came with it for you to see. I wonder if you could help me to fill it in as I am unable to find help notes on this document only the pdf for the form and just a little information on this form but its not all clear and do not want to fill it in wrong. Can i ask also when i send my S.A.R. request off who should i make the postal order to? should i call Lowell's and ask them? Which way is best?. Many thanks again.
  9. Hi just a quick note to let you all know that I'v sent off the counterclaim and defence letter a few days ago, so now iv just got to wait and see.. I wondered if you could guide me on the next stages while I'm waiting. I know i have to write a letter requesting a S.A.R. and also inform Lowell's sending them a copy of the counter claim and defence form but can you give me a better idea on how to do this and if i should be doing anything else for the next stages. If you have any templates for letters or can redirect me to any I would be very grateful, many thanks for all your help.

  12. Just like to thank every one for all your help Iv completed the acknowledgement of service letter today and posted it recorded delivery. Iv been told to just send this in so that it can be recorded and I have till the 23/2/14 to send the counter claim and defence form back in. I am unable to send these in at this time due to also needing to send the Ex160a waiver fee form in with it, which i am unable to do due to waiting on the DWP to send me proof of benefit which must be enclosed with it. Many thanks again and i will keep you updated on the progress. Also I have had many phone calls for a number of weeks I discovered today that the call today and possibly last few weeks have been from the Lowell company harassing my self everyday, not sure exactly what they want at this stage but will log the calls in the future.   13. Okay, this is the final draft I have put together. Hope this is sufficient to send off tomorrow morning: Defence I deny the claim. I bought a Hoover on credit from Littlewoods in 2007. It did not work properly from the start and broke down completely soon afterwards. Littlewoods refused to help me and eventually told me to contact the manufacturer. They wanted £180 to carry out repairs which I could not afford. I have never used the Hoover since that time. I continued to make payments and having paid the majority of the balance, I ran into financial hardship and the account fell behind. Offers of reduced payments were rejected. Counterclaim I now understand that Littlewoods had a duty under the Sale of Goods Act. They breached their duty. The Hoover did not work from the start, Littlewoods admitted the fault in a letter dated 16th July 2007 but refused to help and referred me to the manufacture instead. I was unable to afford the £180 repair bill they quoted. I haven’t been able to use the Hoover since the first few weeks I got it. I did not know my rights and I accepted the situation and kept on paying the instalments as well as interest payments and charges. I am a single parent who has been trying to bring up two children with limited resources along with health issues and personal problems. As I was trying to pay Littlewoods their instalments, charges and interest, I could not afford another Hoover and had to clean manually with a dustpan. It was over a year before I could afford another vacuum cleaner for which I paid £70. A cleaner that was much less effective than the one supplied by Littlewoods for £244. Having to use a dustpan for over a year caused serious difficulties as it was difficult and much less effective to clean in that way. In addition to my two children, we also have a dog. At times I require the use of a Nebulizer. Using a dustpan caused a great deal of dust and the continued inhalation did not help existing chest problems. Additionally, having to clean this way also affected my chest. The physical strain of having to use a dustpan to clean the house exacerbated an existing Fibromyalgia disability. This left my back, and joints throughout my body in a lot of pain. As a result of my financial problems, my account was unjustly sold onto various debt collection agencies. I have been subject to a huge number of demands for money over the years from various agencies - despite my protests and complaints to Littlewoods. Entries have been placed on my credit file - which I now realize have been placed there unlawfully because of the circumstances of the case. This breach of the Sale of Goods Act by Littlewoods, and the consequent unlawful processing of my data has caused serious distress for me as I have carried out my responsibilities as a single parent. I have also tried to cope with health problems, dealt with a family member’s terminal illness, subsequent bereavement and caring for a disabled housebound Parent. Therefore my counterclaim is for: 1. Refund of all money paid for the Hoover including price, charges and interest - £276.60 2. Loss of use of Hoover and inconvenience of having to clean house manually for 16 months - £15 per month - £240 3. Effect on health for 16 months - £20 per month £320.00 in the discretion of the court 4. Unlawful processing of personal and stress caused by being wrongfully pursued for alleged debts - £100.00 in the discretion of the court 5. Plus interest on the adjudged total pursuant to s.69 County Courts Act 1984 - £1,386.16 6. An order requiring removal of all related references from my credit file within 7 days 7. An order requiring destruction of all data relating to me in this matter
  14. Sorry for the oversight on the forms I posted. If anyone still needs them I can repost them? The amount is probably correct so I'll have to use it for now. I don't think a SAR would reveal a substantial difference anyway. I will finish the claim today and post up the final draft before I send it, together with a letter requesting a transfer to the local court. After speaking to the court I will have to send benefit proof when I get it from DWP.
  15. RE Estimated amounts. I have got to the £296 by using all the available records I have. I can prove I paid this amount and back it up with bank statements, so I thought it would be safer to stick to that amount. You mentioned amending the counterclaim after including Littlewoods; can I amend any of the amounts if it turns out from the SAR from Littlewoods that I paid £350 in total? I have a great deal of threatening letters from the various collection agencies but I think it would be safer to go with discretion of the court on that one as well as the health element. This is all quite daunting and I think I may end up taking someone along, but the more I write timelines etc, the better I know all the details to present in court. After all this, I am determined to win, if only to stick it to Littlewoods.

I am in the process of moving GP surgeries. If I required medical evidence do I need to wait and include this before sending the defence back? I’m pretty sure my GP could corroborate this but I’m not 100%. Same situation with the chest problems, it would be difficult to prove conclusively. What would you recommend? 4: Unlawful processing of personal data, stress caused by being wrongfully pursued for alleged debts £100 (Specific damage is hard to ascertain, how could I go about proving this and putting an amount on it?) 5: Total plus interest at 8% Total = £636.60 (Not included effect on health) 6 Years 8% Interest = 305.52 Total + Interest = £942.12 Defense I deny the claim.   18. Apologies for taking a while to reply but my financial records are incomplete and stored in various locations around the house. I am treating this as a priority and can assure you I am taking it all seriously. I’ve spoken to my local county court about fee waiver and to move it to the nearest one from me. Hopefully the following timeline will answer everything you require. Additional notes below. Timeline June 30 2006 - Opened Littlewoods Account July 2007 - Bought Cleaner for £244. The cleaner broke in the same week, I phoned to complain. Numerous phone complaints, Littlewoods being unhelpful. Passed on to different departments. July 16 2007 – Letter acknowledging fault from Littlewoods. Contacted Supplier as directed by Littlewoods letter. Quoted an estimated £180 for a call out. August 2007 - Letter of complaint sent to Littlewoods explaining the situation and asking for a replacement or refund. No response. August 2007 - Phoned Littlewoods, they denied receiving the letter. I asked again for a replacement or refund, Littlewoods refused and directed me to again contact supplier. With £44 left to pay, I phoned Littlewoods to explain personal and financial problems. Littlewoods refused a lower payment offer and I was pressured into setting up two Direct Debits of £22 to clear the balance. As far as I was knew at the time they were paid. January 16 2008 - Account was passed over to Nationwide Debt Recovery Ltd. I continued struggling to keep up payments to Littlewoods but charges and interest became unmanageable. Made three last payments - 16 January £21 - 18 February £52.60 - 25 February £44 Default logged on my Credit Score by Littlewoods on 14 March 2009 for £54.00 April 2009 to Present – Account passed around to Lowells, Hamiltons Legal, Red, Scotcall, Mackenzie Hall and Advantis Credit. 21 January 2014 – County Court Claim Issued by Lowells. Additional Notes And Questions Earliest record of Littlewoods I have is June 30 2006 through my bank at that time. I have done my best to get all the dates accurate to the best of my knowledge. What did you do for a vacuum cleaner? I had to use a dustpan and brush as I could not afford to replace the cleaner. As a single Mum with two kids and a dog to clean up after, this was time consuming and inconvenient. What damage or inconvenience have you suffered? Inconvenience and time taken to try and sort the issue. Financial damage trapped into interest and charges I couldn’t keep up with. Paid much more than the price of the Hoover. Damage to my credit file. Physical inconvenience of using a manual brush, exacerbating my condition (Fibromyalgia) Chest problems brought on by increased dust. Requiring the use of Nebulisers Upset and stress caused by Littlewoods and Collection agencies at a time of severe personal distress. Stepfather dying, full time caring for disabled Mum. My own health problems (Fibromyalgia) and depression. Do you still have the cleaner? Yes, it was put away in a cupboard Do you have another one? I had to buy a replacement cleaner when I could afford to. I bought one around November 2008 and paid £70 Hoover fault details Pet attachment fell apart in my hands and was unusable from the start. Constant blocks after very short use. Purchased specifically for pet hair removal which the Hoover was unable to do. Hoover overheated after short use causing electrical supply to cut out.

  21. Hi, and thanks for all the quick responses. I really wish I had dealt with this earlier but didn’t expect it to escalate to a county court case. I’ve been doing my best to find all the paperwork connected with Littlewoods but I think there are some parts missing so I’ve been trying to fill in the blanks. To answer your questions: Date of Issue on the court document is 21st Jan 2014. See attached for the of the case with personal details blanked out. I think I opened the account around June 28 2006, that’s the earliest payment I can find on my bank statements anyway. I bought several items before the Hoover, so it’s hard to remember exactly when. Details of the faults with the Hoover are that it would not pick anything up. I have a letter dated July 16 2007 from Littlewoods acknowledging a fault. I couldn’t afford to fix it and in the end it stayed broken. I lost count of the times I phoned to complain and the whole situation was left to one side while I dealt with personal problems. Hope that answers all the questions and thanks again for everyone’s help.
  22. I ordered a Hoover from Littlewoods costing around £244 in July 2007. Within the first few weeks it developed faults and became unusable. After numerous complaints, I received a letter from Littlewoods acknowledging the fault with the Hoover. They quoted me around £180 for a callout to fix it, which I was unable to afford, a nd so was left with a broken Hoover having paid £200 already. Left with £44 to pay I phoned Littlewoods and explained the issue. I was pressured into agreeing to two Direct Debits to clear the balance over two months. I had a lot of personal problems around that time and was unable to deal with my finances for some time. When I did, I realized the DDs had not been taken and Littlewoods had added loads of charges/interest, defaulted me and sold it onto Lowells. I have always maintained that they owe me a Hoover or I owe them £44 but nobody has listened to me. I got a Claim Form from Northampton County Court on Tuesday giving me 14 days to reply. The amount has gone from £44 to become £387! Please can someone help me as I am on benefits and don’t have any real money coming in to pay this. I never even got a Hoover, am stuck with a massively inflated bill and have no idea what my next step is. Thanks in advance.
