  1. in my opinion you have been let off this time. usually people will be prosecuted for incidents like this. That is the LAW if you like it or not!
  2. Hello there i was summoned to court for using my friends 18+ oyster card. Point C is just how this prosecution can affect my future in employment. the need to have a clear DBS is what I wrote to them. But the key thing is to be apologetical and remorsefull and then you have to write what I posted!!
  3. hello there what i did was i read their prosecution policy and took out points that support my case. but I did apologise and was remorsefull. I have pasted what I wrote to them 'Though I admit my mistake and ready to apologise, I would like you to kindly consider my case under TFL Revenue Enforcement and Prosecution Policy (10) as I am a student and a first time offender ( no penalty fare) and it will affect my career prospects especially in DBS checking. TFL Revenue Enforcement and Prosecution Policy (10) as follows for your kind consideration; Where the offence involves fare evasion TfL may decide to issue an offender with a Warning Letter in lieu of prosecution, where it is deemed appropriate and one or more of the following conditions are met: a. The offender admits the irregular travel and; b. The risk of re-offending is considered minimal and; c. The offender has provided TfL with exceptional mitigation against prosecution or in the opinion of the Prosecutions Manager it is not in the public interest to prosecute and; d. The offender agrees to pay the administrative costs incurred in the processing of the case file. As per above given TFL Revenue Enforcement and Prosecution Policy (10) conditions (a) to (d) are met in my case. Condition (a) is met as I admitted that it was an irregular travel and was the first time I did in my life. (Please Check Exhibit SA/01 as Evidence) Condition (b) is met as my Oyster Card History which is attached as Exhibit SA/01 where you can find I travel regularly with my own Oyster card, even the day before I was caught; I used my own Oyster Card. Moreover, I admitted, apologised and promised that I am not going to do this wrongdoing again in my life.'
  4. well I wouldn't look at it that way DX. It worked for me. I wrote them a letter with those points. I know circumstances are different though but can give it a try

As you have said this is a one off offence, you can read their prosecution policy and write or email them with these 3 crucial points. 1.The offender admits the irregular travel and; 2.The risk of re-offending is considered minimal and; (I will never even in think of doing this again even if it is in my dream!!!) 3.The offender agrees to pay the administrative costs incurred in the processing of the case file. Make sure you have evidence that this is a one off!!!
  6. Hello seekinghelp101 I was in a similar situation this year as you are. I used my friends discounted oyster card (I only used it once) and got caught. My friend also reported the card was stolen the next minute I informed him about his card. I still managed to settle out of court and TFL didn't even get back to me or my friend regarding the oyster being reported as stolen. So just don't say anything they don't know, but do tell them IF they bring it up All the best
  7. In my opinion just accept the settlement of £100. you are digging yourself a deeper hole if your son pleads not guilty.

Hello I think it will be harder to get an out of court settlement if you say you did it by mistake...cos remember tfl would have heard that excuse a number of times...I am not accusing you of anytin...it is just my observation reading various threads on here....OH BTW..do you have an oyster of your own..you can show your Oyster history...and write to them that it was an honest mistake..it is very essential to back your claims with evidence... I was in the same situation as you were....mine was that i used my friends student oyster card....and got into trouble..i managed to settle out of court by writing a letter with these points that i took from their PROSECUTION POLICY...the points are: 1.The offender admits the irregular travel and; 2.The risk of re-offending is considered minimal and; (I will never even in think of doing this again even if it is in my dream!!!) 3.The offender agrees to pay the administrative costs incurred in the processing of the case file. now you have said that you only used the card only once...so you might have a chance...but the only problem is that the card you used was a freedom pass...but anyways right to them with the points that i have mentioned above...I only had to write one letter BTW after i got my court summons...IT is very important what you PUT on the letter... all the best wishes sam
