  1. But the county court have still let the creditor pursue the matter? I am intending on attending court next week to fight this, any advice?
  2. I did a £1 CCA request I have never receieved a default notice. Last payment mid August 2007.
  3. They won't close the account as saying not SB... I do not have a default dated letter nor have ever had notice of a default and they have not sent me a copy with a recent CCA request.
  4. It was a Credit card debt, now I am confused! Six years from last payment or from when a default is added?! Edited to add: Lowell have said it is not SB as a default was added 04/08.
  5. Hello and thank you. The debt is around £500. I am going to court to file my defence. A CCA request to Lowell was incomplete, no default letter and a few missing figures but last payment showing 08/07. They are insisting as a default was added six months after this that it is not SB until then but I am led to believe it is SB from last payment or signed admittance. Edited to add: I have filed my defence to the court - I am due in court with Lowell so get the claim sorted.
  6. Hello, I have an old debt that is statute barred (last payment made 08/07) and no correspondence from me in between. Lowell have taken me to court and I am due to see them there next week. I have written telling them it is SB but they are saying it did not default until some six months later so is still enforceable. I thought SB related to payments and correspondence and a default can be added anytime so is not relevant. Please can somebody give me the facts urgently! Thank you for your time.
