  1. Not sure of exact dates, but would the onus be on them to prove those dates? It's a big worry I didn't need after so many years. Shall I send a SAR to SLC? Been reading some old posts on here and they seem pretty regular with issuing court claims. Do the SLC still have all the paperwork from 20 years ago? Many thanks for all your help.
  2. Many thanks for your replies. I haven't contacted the SLC since my referral of 2011 and have never contacted Thesis. I was living in Scotland whilst a student there and must have used that address for correspondence. If I just ignore them are they likely to take me to court or is this letter very common with them? I'm very surprised that they have not defaulted me before now.
  3. I wondered about that but although they didn't accept the referral I'm sure that they would accept the letter as acknowledgement of debt. I did wonder if it being taken out in Scotland would it be the five years? I'm from England however.
  4. Hello I have two Student Loans dating from 1995 and 1996 that I took out whilst at Aberdeen University. For many years I deferred them with the SLC with no problems until 2011. In 2011 whilst self-employed they refused my deferral due to the chap that I was sub-contracting for not writing the letter regarding my income on headed notepaper. I probably had some communications from them which I ignored as this was during a spell of depression and ignoring my debts. Back to present time, and this week I have received a letter from a company called Thesis Servicing (only has the 1995 account number on the paperwork) advising me of there intention to register defaults for over £3800. (this must be both loans combined.) There is also a letter that appears to be a default notice. I am still on quite a low income, what shall I do? I was hoping that after 20 years the sums may be written off. I really don't want a CCJ, is it best to see if they will accept a low monthly payment? Many thanks in advance for any advice given.

  6. Hello Back in October I switched jobs from a weekly paid position to a monthly paid one which required me to move my Direct Debits forward by three weeks. Not a huge problem you wouldn't think as I am not behind with any payments. Moneybarn wanted a list of incomings and outgoings and with the rude manner of their advisor I decided to VT the car as I was only one payment away from being able to do so. I subsequently found out that by moving my payment three weeks and paying on an agreed date they posted a late payment on my credit file - this has caused me to make a complaint to the ombudsman which is ongoing. Car hand-over to a company called SMA went ok. Odd minor scratch and a stone-chip on the front bumper, it was after all a seven year old car, (five years old when I purchased it, with the bumper stone-chip already on it). Moneybarn sent me a bill shortly afterwards for £140 to re-spray front bumper due to paint defect. I refused to pay it, as was already on there when I bought the car and was fair wear and tear anyhow. Today I've received a default notice for £168 from them which will cost me lots of money over the next six years. Is there anything I can go about this? It seems awful that these companies use a Default as a way of punishing people because they will not pay out over "disputed" damage. (It's a seven year old 4x4 with a two pence sized paint defect on front bumper). Any advice is gratefully received. Many thanks, Paul
  7. Unfortunately Brigadier I have about eight debts with Lowell, which total quite a lot more than the £750. I also have two large debts which are about seven weeks from being statute barred, that aren't with Lowell.

  9. Hello, just wondering if somebody has any advice or experience regarding Lowell and mobile phone contracts. I have two accounts that are now with Lowell, one that was a Three contract for which they are after £246 and another from 02 for £540. On the Three account the original debt was £87 (according to Noddle), Lowell wrote to me so I offered £100 which they declined, I told them I did not acknowledge the debt (I know it is mine) but would pay this to have the debt removed from my credit record. I have no details of the original Three account so was wondering if I should send Lowell a prove it letter and use the details to send an SAR to Three for the original balance. Just wondering are Lowell entitled to add any charges at all? Will then follow the same strategy with the larger bill. Thanks in advance
  10. Hi Dx, Many thanks for your reply. There won't be any PPI charges unfortunately. It was the Halifax who took it to court, I'm still at the same address and still have a Halifax mortgage. I never signed any forms to take the loan out as it was all arranged by my ex wife who was an Halifax employee. Can the Halifax sell the debt to Lowell if there is a CCJ on it? I'm just worried about an attachment of earnings order really as I would have to leave my job if that were to happen. Many thanks
  11. Hello, This is a great site and unfortunately I need more advice. I had a spell of major problems/mortgage arrears, and unfortunately the Halifax were awarded a CCJ against me in September 2009 for £8362 in relation to a personal loan. I agreed to pay £5 per month, which I did for about four months, before I forgot about it and concentrated on mortgage arrears, (Halifax also). After missing two payments I phoned the Halifax to make the missed payments and they would not accept them as it had been transferred to another department. I have not heard from them since. The advice I require is, what should I do now, as I am now managing to live and have sorted my mortgage arrears and am now in a full-time job. Continue ignoring the debt, and risk it being sold on? or phone the Halifax and risk rocking the boat? I'm really after sorting my life out and have this hanging over me. I would be very grateful for some advice
  12. thanks for your reply, the amount in question was £1990 owed to the Halifax? possibly...... anyway will fire off a letter tomorrow, will the letter reset the statute barred time?
  13. Hi all, I am new to posting on this site so please bear with me regards any missing information etc.. I received a letter from Bryan Carter dated the 22nd of Nov regarding a debt that had been passed onto them from Lowell. They have given me until the 6th Dec to make payment/contact them or I will be going to court. Obviously I want to avoid this but have a couple of questions on what I should really be doing next. The debt in question (I believe) is an old overdraft, but I have no paperwork to try and track it down and if I have worked things out properly according to advice given on various forums, the debt was due to become statute barred in May. I was wondering if there are any specific letters I should be sending out or any key questions I should be asking so I am able to find out more about this debt. Thanks in advance
