    Say hypothetically Barclays offer to pay up in full a few weeks before your court date.... but there is no mention of the court fees you have had to pay - would you call them and say that you are not willing to settle unless the court fees are included as well? They amount to £110 so it is no small amount...

     

    This is all just hypothetical of course ;)

    I had read on another thread that someone had sent Barclays a letter giving them one more chance to settle out of court and they did - I was just wondering if pillowatrick had too!

     

    I wrote one on Friday and sent it as my court date was set for 16th August and then to my utter joy I received a very nice letter on Saturday morning from Barclays if you catch my drift! So case closed!!

     

    Good luck to all still chasing and persevere as it will pay off :)

  4. I cannot remember exactly as I haven't looked at the letter for a while (pushed the whole scary thought to the back of my mind!) But I think it is the 16th of August. I am going to drag everything out tonight and start putting things together for D-Day!

    I am trying to draft a letter to them now so I will keep you posted if I get a reply!

     

    Everyone keeps saying it won't go to court so everyday I excitedly look through the post for a letter from them - and of course there is never anything there so I have to start preparing for fact that they could call my bluff!

  5. Gensurf2 - would it be possible for you to post on here the letter that you sent to Barclays asking if they wanted to settle out of court? My hearing is around the same date and I know everyone says that it will not go to court but panic is setting in!

     

    I wanted to send them a letter but really cannot think of what to out or how to put it! Your help would be greatly appreciated!

     

    You don't think it is too late to send one do you?

  6. Quick update -

     

    I have just sent a letter accepting the £225 as an interim payment towards the full amount of £520 but have made it clear I will still be pursuing the remainder - with court action if necessary and sticking to my schedule!! This is getting scary!!

     

    As I no longer hold an account with Barclays am I right to ask for a cheque for the amount or should I supply them with my new details for a transfer?

     

    I can change the letter if necessary it is sat in the out tray at work!

    Just thought I would let you know about my claim so far...

     

    Got all my statements through FOC which was a bonus! Found that I have had £520 of 'illegal' charges. So used your templates and sent my first letter requesting my money back to which I received the standard "we are sorry to hear you have complained and we are looking into the matter" letter.

     

    So 2 weeks later I sent the second letter in the chain and I received a letter from them yesterday saying that they are sorry I feel my charges are unfair, they are aware of the information I have drawn to their attention but they disagree with my view......However have offered me £225 - this is in their words "with the cost and inconvenience inherent in a further dispute in mind and intended as a gesture of goodwill"!!!

     

    Roll on next Tuesday so the next letter can go out!!

     

    Just want to say thanks for such a good site and bringing these charges to our attention - I will let you know my progress!!!
