1. The car has now been left at the Peugeot dealership where it had the diagnostics done. The 2nd hand car dealer told me that he had taken the car away after I told him the faults found during the diagnostics. Unfortunately he did not take it away and I was contacted yesterday by Peugeot to find out when I would be collecting my car!!! Phoned 2nd hand dealer, he is accepting no responsibility and refuses to get the car, stating it is mine as I have paid for it, he has a receipt and the registration document (DVLA) is in my name.... The peugeot dealer are going to start charging for storage as of Monday, or will put the car on the road... I have contacted the police who say to not drive the vehicle as I am not insured... I don't want to drive the vehicle as I am refusing it due to the main fact that it was not as described... No service history with the vehicle to prove the statement that the cambelt was done at 80,000miles..... what do i do now???? If the car gets stolen off the road what is the outcome? If it incurs storage costs, who pays? Starting a small claims court action against the garage, just downloading forms and hoping to speak to a legal advisor soon. anyone recommend a legal advisor???
2. Conniff, thanks for that information, but, to be honest, they are car dealers with lots of cars, they made out the grinding/knocking sound of the dual mass flywheel was a heat reflector under the engine. and as soon as I told them Peugeot's findings about the worn flywheel the guy knew how much a replacement was before he even took breath!!! I do not trust them and due to this I would not trust any work they carried out. Think I will give dealers a miss from now on and just buy privately (once I get my money back!). you think the letter is acceptable and should get the ball rolling in getting my money back???
3. right here is the letter I have written, please let me know if you think it is appropriate: Dear Car Supermarket, Complaint about faulty goods I bought Peugeot 307 Silver VO04CRV from you on 17th October 2013. I paid £2300. I now find the goods have the following fault: Grinding/knocking noise from engine when running and when turning the ignition off. Hard to get into/out of 1st and 2nd gears. Have to use lots of revs to pull away in 1st and 2nd gears. Bad clutch when using 1st and 2nd gears. Symptoms stated above and when described to other mechanics and looked up online, point to a faulty dual mass flywheel/clutch. Vehicle has since been given to Peugeot Hamble for diagnostics and the results are attached. I was told that the timing belt had been changed on the last service (80,000 miles) but when I asked to see the service history you could not provide it. You told me that you had the owners manual and service history, but you have not been able to provide these after repeated requests. Therefore the vehicle does not match the description you gave me regarding the service history. Under the Sale of Goods Act 1979 (as amended) goods you supply must be of satisfactory quality, be fit for purpose and match their description. As there was a problem with the goods when I bought them, I reject the vehicle and will not accept any offer to rectify the problems and I request that you provide a full refund. Please respond within 14 days of receiving this letter. Yours sincerely .......................... Also attached in the diagnostics report from the peugeot dealer....
4. Hi Thanks for the advice. Yes, I paid in full with cash. I will write a letter now and get it to them today. Currently the car is in a Peugeot main dealers having a diagnosis done on the grinding noise from the engine and the stiff gear change/jerky 1st and 2nd gear... Cheers
5. Just bought a 2004 307 2.0 Diesel HDI 89,500m from a 2nd hand dealer in Southampton (17/10/2013). Was told that the timing belt had been done at the vehicles last service (80,000). Stupidly paid outright for it and left it with them to get a new MOT. When returning to get car (19/10/2013) with MOT/Owner manual and service history I took the car for another test drive and noticed that it dragged in 1st and 2nd gear and needed higher revs to pull away. Also noticed a strange sound coming from the engine area when the bonnet was up. Mentioned this to the dealer and told him I wanted my money back as I was unhappy with the car. He said they had no obligation to return my money as the transaction had already taken place and persuaded me to let them look at the issues and to contact them after the weekend. Also no service history or owner manual given to me... 2 days later (21/10/2013) phoned them up to find out what was happening and was told that the noise was a loose engine cover and it had been fixed. Went to dealership today (23/10/2013), still no service history. Told them I was unhappy with no service history and was worried about the timing belt not being done. They agreed to get the timing belt done in the next couple of days and that I could pick up the car and the receipt for the timing belt replacement, this Saturday(26/10/2013) from the garage doing the work. Happened on a youtube clip of a 307 Dual Mass Flywheel going wrong and realised that it is the same issue as the vehicle I have just bought!!! I would like to know what I should do now. I am supposed to get the vehicle on Saturday but am pretty sure the flywheel is on its way out and would like a refund from the car dealer as I believe the vehicle is not fit for service... They have given me a 3 month warranty with the car, but I imagine they will say it is classed as wear and tear.... I want my money back as I think I have been sold a turkey.... I still have not taken the car from the 2nd hand car dealers, though I do now have the registration document slip.... Any advice on what I could/should do now would be much appreciated. I want my money back/not the headache of getting flywheel/clutch changed.... Wish I knew more about cars! Thanks in advance...
