  1. So if registering a new address on a CRA means it will get passed on to DCAs, I guess it also means that if someone else does a credit check on you with your new address, the same thing will happen?
  2. So it looks like I either pay or ignore them...They call every day..what would happen if I kept on ignoring them? They don't know my new address but I'm guessing they can somehow find it eventually.
  3. I've sent them letters similar to the one I found on that link, didn't get anywhwere. I also raised a complaint to the Financial Ombudsman mentioning BCOBS and they aren't going to do anything about it.
  4. January to May 2013 it started going overdrawn, they closed the account June 2013.
  5. It was a current account and I was using it kind of as a savings account. I thought I had more money in there than I did, and made a card payment which took it into overdraft. I had a direct debit on it, which further took it into overdraft. I owe the amount from the card payment and DD, but have an issue with the charges they slapped on there. I didn't realise it had gone into overdraft for a few months as I had changed address and wasn't getting their letters.
  6. Dx, the £58 is from a few direct debits that went out that took me into overdraft. I haven't payed this back yet. What would you suggest that I do now?
  7. Brigadier, I don't know why I get calls from Ruthbridge now as well. They leave a recorded message on my mobile every day asking me to call them back. The number calling my landline is Cabot. I presumed they were just connected, like the same company or something. Interesting that you think if Ruthbridge is involved that there's a problem with the account...is that usually why they get involved? As I still owe £58 from my overdraft and £108 in fees, do you think I should try and pay the £58 on the Cabot website..I don't want to speak to them on the phone. The £58 is what I actually owe, but the £108 is charges I want to claim back but now I'm not sure if I'm going to be able to do that successfully.
  8. I have just been ignoring the Cabot calls but have had messages left on my phone from Ruthbridge. The Financial Ombudsman recently said they aren't going to do anything about it. Now getting calls on my landline and when I looked up the number found it's Cabot. I 'm not sure if I should pay off the overdraft debt I owe on the Cabot site, and not pay the charges. Or I don't know whether I should just pay the charges as well and have done with it. I'm worried they are going to add a load of interest on it.
  9. Can someone give a bit more information on what to actually to when making a BCOBs claim? I've read the links and although they are informative about what BCOBS is, what do you actually do, apart from writing the bank letters? I read on there you need to sue them, so how would you go about doing that? Do the banks sometimes drop the charges without needing to sue them?
  10. Ok I've attached another letter I have wrote. I've basically boiled it down to them making unfair overdraft charges against me. I still owe £58, but the fees are £108. Cabot has the debt so not sure if they can try and put a load of extra charges on top. Anyway, hope I can get some feedback on the letter, and if there is anything else I should write. Thanks.

  12. Ok I've sent a couple letters to Halifax about the charges against my account claiming BCOBs. They've sent another letter fobbing me off, so not really sure what to do next. Do I send another letter, threatening court action? I have closed my account with Halifax. The debts has been passed to Cabot, who have been calling me for the past few months. I haven't been answering them. Halifax have also said the account conduct is going to reflect on my credit file. It's getting a bit frustrating and depressing having to go through all this, and I don't know if I'm realistically going to get anything back. I'm not sure I'm writing the right kind of things. I looked at the template letter about BCOBS and wrote about my own situation, quoting a few paragraphs of the BCOB regulations. Also..don't know if there's any address which is better to send to, at the moment I am sending to customer services. So, I guess the only thing now is take court action?

  14. I wanted to change to BT, saw a better deal and I can get sport with it. Don't really want another contract with Virgin.
  15. I wanted to cancel my broadband / phone line service with Virgin. I phoned up to cancel a few months ago but was told of the cancellation fees so I didn't bother. I have recently found that I could cancel without charge because they are putting the prices up in February. But apparently you can only cancel a month after they first tell you about the price increase. The problem is they emailed me about it in November, so now the month has passed. I was wondering if there is any way that I could still cancel without any charge?

  17. The charges are from January to May 2013. That's the first time I (unknowingly) went into overdraft. The debt is £58.89 and the penalties are £108.
  18. I would like to claim back the overdraft charges, but some of the amount owed is DDs that I technically haven't payed back, and now my account is closed. Would I have to offer to pay back the amount of the DDs to them? Cabot now has the debt. Really not sure what the right way to go about it is.
  19. Dx, it was just a few months before, think I set up the account in the summer of 2009 sometime. So that means I couldn't use that argument? I want to claim the charges back, there are other issues. They have closed the account and passed the debt to Cabot. I still owe the amount taken for the DDs and the charges...so I guess that would mean I'd only be able to claim back the charges.
  20. When I set up a reward current account with Halifax, I remember them asking if I wanted an overdraft facility, and I said that I didn't want one. A few months after, I realised on a statement that they had given me an authorised overdraft of £200. I didn't really think much about it. But now, a few years later and my account has gone into overdraft paying direct debits, and i have ended up with a load of overdraft charges. I am just wondering if I have a case of claiming this back by telling them I didn't want an overdaft, and that they have more or less forced me into lending money from them, before giving me unfair charges for it. I didn't realise my account had gone into overdraft and I'd rather the DD just didn't get payed, rather than the bank taking money out of my account I didn't have. Can I use this with a BCOBS complaint?

  22. Ok thanks Nystagmite. I have emailed Atos and asked about it but obviously won't hear back till after the weekend...so not sure if I should just send the form now, and write on there that the medical evidence is to follow. I guess I'd just send it to the same address.
  23. I have kept putting off filling in my ESA 50 form, I had a month to do it and now it's near the time I need to send it. But over the past few days I've been looking up things and a lot of people are saying you need to send medical evidence with the ESA50 form, even though they say it isn't mandatory. It has to be there by the 5th December, so I need to send it soon. I phoned my doctor and the secretary said that ATOS / DWP would get in touch with them if they needed evidence, but I said that sometimes they don't seem to do this. She said she would see my gp about writing me a letter, and that she would phone back today...which she hasn't done yet so seems unlikely. I'm not sure if I should send the form off now to make sure it gets there, or wait to try and get a letter. Or would it be possible to arrange with ATOS to send the medical evidence after I have sent the ESA50? And would I need to state that on the form? Getting a bit stressed over this and really would like to avoid having to go to an assessment.
  24. Wish I thought of that when I was claiming JSA. I allowed my adviser to see my universal job match, and even though I applied for jobs on it, it took me to another site so it didn't seem to log that I had applied on it. So he was basically accusing me of lying that I had applied on there.
