  1. Hi, I've received a letter from the county court business centre in regards to a supposed outstanding amount on a vodafone contract. The amount is for £1248.72. It says the defendant failed to maintain contractual payments under the rems of the account agreement. I haven't had a Vodafone account in over 11 years. What do I need to do?
  2. Hey, a new 'enemy'!!! Due to the same reasons I went after the Halifax, Morgan Stanley are the latest FI to feel the power of the consumer. Having gotten into arrears through the same reasons as with the Halifax, I was trying to tell them why I was in trouble and how I was going to get out of it. despite several requests to handle my situation by post they insisted on foning me, often several times a day, using their automated fone system which would call me and then ring off as soon as I answered. Well, I sent them a letter stating I was going to recover all my charges, totalling £565. They wrote to me offering a £224 'goodwill payment'. I wrote back thanking them for the gesture but informing them I would accept that as part payment but would continue the recovery process for the remainder. Yesterday I received a letter offering the whole amount. Didn't even have to go to court. They also told me that while they didn't consider their charging structure unfair or constituting a penalty that they were in the process of 'reviewing' their charges in light of the OFTs ongoing investigation of same. I also reported them to the OFT for harassment over the fone calls. No apology has been given, yet, but I fully intend to press them over this kind of treatment. Hopefully I will be posting similar regarding the Halifax and HBOS cards soon. So, if you are going through the same situation just keep on going. They will fold!

  4. Well, did the claim thing last week and got a notification of reciept yesterday. I can only hope they will pay up soon!
  5. The court may request the charge schedule, but if you've included your account details the bank should be able to work them out for themselves. You can't (as far as I'm aware) attach the sheet to the mcol form anyway. Some people who've used the N1 form and taken it to the court have included a schedule of charges! Good luck.
  6. My statement. Claimant has a contract with Halifax PLC opened in 1987 conducted on their standard terms and conditions. I am claiming the money taken by the defendant in charges for the last 6 years plus interest. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. The bank will not justify these charges. Charges:Unpaid penalty charges from April 2002,including unauthorised overdraft fees as a result of the charges £1,759. Claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 04-2004 to 31-8-06 of £170.08 and interest at 8% up to the date of judgment. Hope this helps.

K, and no problem about asking stuff, feel free to ask whatever you want, (I'm not saying I'll be able to answer everything tho') The money claim form has very limited space and formatting capabilities, so you have to edit the text carefully. I'll paste mine so you can see what I did with it. You really should include the added info if you are claiming interest, and you should. The interest rate is 8%, this is stated in the rider and on the template.xls sheet. By filling in the relevant info on the spreadsheet it should calculate your interest and total it, so you want your charges+interest as your claim figure. You can edit out the phrase "or earlier payment at a daily rate of {enter the daily rate of interest}".

Have had a threatening response from the Halifax stating they are about to default my account and includes a list of hyuuuge charges they will apply for communicating and stuff.
  9. Just put in the charges and any interest accrued. The court charges are on a sliding scale and when you recalc the fee will be calculated and added automatically in the last box.
  10. I used the templates.xls spreadsheet from the library here, it should work in works and the formatting is pretty much the same.
  11. Excel looks at what you enter and formats it to suit. Beginning a number entry with a zero automatically formats to numeric, and hides leading zeros. If you strt the entry with a single quote ' it will show the zero.
