Been awhile since I have had any input on this thread but, after 80days of the other party's insurance dragging their heels and my insurer failing to gain a copy of the CCTV before he 30day write over loop etc, etc, finally the other party's insurer has accepted liability after two independent witnesses confirmed my version of events. Have already had my car written off and payment received (still searching for replacement). Having failed to take legal cover with my insurance policy I have already spoken with my solicitor regarding this accident and he, advised me today that I no longer need him as my insurer SHOULD run with this now that liability has been established with third party. I then spoke with my insurance and they said no!!?? Is this normal? I need to claim back my excess already taken from my settlement and after speaking with a "friend" advised I should be claiming back the premium increase I will get at renewal as a result of this accident!? .... Is this true? Finally, my own insurance have told me that they have "Personal Injury" on their system for claim!?? So, should I now expect my insurer to now run with the baton as my solicitor suggested? .... Or should I go with my own solicitor? ..... Or dare I say it, do I go with one of those ambulance chasers as advertised on mass media?

  3. Am I being silly? As detailed above my car has been written off and sold by my insurer to Copart. I was told the payment/settlement for my car would be in my account Friday afternoon, today is Tuesday and the money is still not in my account and Coparts are getting somewhat impatient. I have told Copart that I will give them the car once I am in reciept of payment from my insurer. Am I being silly?

Thanks Ericsbrother and Uncle B, Ericsbrother I will call with the shopkeeper on Monday and see if I can get a copy of the cctv myself and if my own insurer continues to do nothing I will instruct my own solicitor as you advise. Crikey Uncle B, I thought my own insurer was treating me awful, I mean why do they get away with not doing their job? I found the two independent witnesses and cctv(fingers crossed) and they have failed to gather 66% of the evidence I spent time gathering!?? This hire care does worry me now that you mention it and I will speak again to my solicitor on tuesday. He previously told me that the fact they have both dragged their heels over liability and my own insurer over writing my car off is down to my insurer and the other party's insurer and not me. But your advice does concern me, so I will ask specifically.
  6. Just an update, and a thank you for advice and support offered thus far. After spending two weeks from the day I buried my father without a car, my insurance finally provided me with a hire car and I have had this car ever since, I believe its now four weeks just passed. After digging my heels in over liability and arranging two independent witnesses to provide statements and the CCTV to prove it was a nonfault accident? I have been told this morning that My insurer (Aviva) only bothered their backside to chase up one witness statement and didn't bother chasing up the other and nor did they chase up the CCTV!!!? I told them that it was on the basis of these two statements & CCTV that I had been provided with the hire car as they had on the basis of said statements, deemed it a nonfault accident and as a result provided me with a hirecar when I had opted out of hire car on my original policy! So, two weeks ago my car was assessed and has been written off, I haggled over the settlement price and eventually reached a reasonable settlement price. Copart now own my old car and will pick it up this tuesday coming. So, back to the call this morning, I speak to a fella I have previously spoken to and he was the fella who deemed in a previous conversation as nonfault. I was then told that the amount offered will be minus my excess, I said that I was previously told that my insurer had deemed my accident non-fault, to which he then stated that the other partys insurance had not admitted liability yet!!!?? I am at this point begining to get annoyed and told them that they had better chase up the other statement they didn't take and pray the cctv has not yet been taped over and then tell the other insurance to stop dragging their heels. I was then told that I would now lose my 17yrs NCB !!?????? A heated discussion then ensued, the close of which I have told is that my NCB will remain but my excess I will have to claim back from the other partys insurance!! I am at the stage where I can't believe a word my own insurer is telling me, and suspect that in the renewal time for my insurance I may discover a whole new can of worms? Any advice welcomed as always.

  9. Yes a SAR will give you a copy of every document they have, including deferments and you should study these documents carefully as there are often anomalys within. What you need to know is Eruido or whatever ? is just Josephs coat of many colours. It is the same company and once they get heat from the Ombudsman or FCA they send you a nonsense letter stating your debt (alleged) has been sold to another dca . If you investigate a little deeper you will quicly find its the same company. When you ring Eurido sometimes the people answer as being Arrows or one of the many other names, I used to laugh at them on the phone. Do not take their threats seriously as it is an intimidation attempt and no more to extract money from you, afterall they paid upto 5p in the pound for your debt (alleged) and they will blatantly lie, bully and extort money from you as is evidenced by their b.s. arrears claims. Do not be scared of them as they are bullies and bottom feeding parasites and they prey on innocent people.
  10. Hi HB, That was my thinking too as regards her estate, but if I ask any questions I am immediately shut down. I know it is the three that were at the private will reading as the other three siblings of which I am one do not want to go anywhere near while they are there. In trying to speak to my mum she can't really speak and she can no longer write either, so each of the conflicting sides has their own version of events. My mother requires 24/7 care now and I have quckly inthe space oftwo years lose her driving licence to now being unable to go to the bathroom. She has all kinds of visitors daily as regards her health and needs but one sister makes the decisions for her, ie manipulates her. Its an awful situation and I try to keep out, but am drawn in by other siblings.
  11. Please bear with me and I will try to be as succinct as possible. My father recently passed, he was in conflict with half of his children and iif im honest the only reason I kept in contact was my mother. My father had been successful in his life and amassed considerable wealth from his businesses and property portfolio. My mother is in need of full time care due to a neurological condition that is rapidly taking her from her misery. My family is relatively large with six siblings, all very strong minded and in constant conflict and already the nonsense after death has begun. My father was buried on the friday and on the following Monday there was a private will reading among three family members and my mother and the other three siblings were excluded. I returned to work on monday, thankful to be away from the mess and being the youngest was not one of the chosen tree. I always told my father that money is not a motivating factor for me as I never saw him happy one day in my life. I have to deal with my other two siblings who are stating that my fathers office has been turned upside down and all kinds of paintings and antiques have disappeared. My brother who is not in the chosen group arrived to visit my mother yesterday evening to find the front door lock to the house changed and upon getting into mothers house found several rooms under new locks and key having never been locked before. After heated exchange the reason given was that apparently the Carer's who look after my mother are the reason why locks have been changed and the reason behind paintings etc, going missing!??t..thhen asked have the Police been contacted and was told that "It's being dealt with."!!?? So, now that I have given a background, I will ask a few questions seeking advice.My concern is my mother, her medical condition has a huge impact upon her speech to the extent that I cannot understand her.Some days she is good but since the funeral has been totally incomprehensible. My mother is on all kinds of medication and some just makes her a zombie which is how she comes across to me. My mother is very old school and rather than setting her up a pension, his businesses and investments see that she receives cash on a weekly basis and the house bills are seen to. It now transpires that her weekly payments are no longer given to her, one of my sisters takes the money and apparently does her shopping and she has no money when her carer takes her to get her hair appointment on a weekly basis(Treat). My mother developed a sweet tooth when she retired and is now denied even a chocolate biscuit with her tea which is rationed to three times a day. On the thursday after the funeral, my sister arrived at the house to see a woman standing over my mother with a form that one might argue my mum was being forced to sign. It now transpires that my mother has been signed into a nursing home in the near future. Thanks for taking the time to read and I apologise for washing my family's dirty laundry in public, but this is affecting my sleep and health and cannot think straight as to what I should do.

Ahh Eurido or whatever they call themselves now are just a Debt collection parasite, if you have a look on the student loans section there are literally hundreds of threads about eurido and their dirty tricks. DX will no doubt be along and set you straight, but I recommend you read a few of the Eurido threads in the mean time. PS: Do not stress and do not pay the nonsense arrears charge these bottom feeding parasites demand.
  13. If you are in "financial hardship" a letter stating so and a request that these charges be returned may get the result otherwise a letter to the ombudsman stating "financial hardship" should facilitate the repayment of such funds.
  14. Thanks guys, I have been on the phone to my insurance again this morning regarding a hire car and have been told that I had opted out of the hire car option and would have to hire my own car. They provided Enterprise discount code and then called them. There was a strange conversation as they told me this was an anomaly and they didn't recognise the code!?? Called back Aviva(My Insurer) and after an hr waiting to speak to someone, I finally got to speak with someone who said they would call Enterprise. Enterprise then called me back and told me that today to Fri would be £146 for an Astra!!? I asked what kind of discount the Aviva code got me and the fella became very flustered and started talking about picking me up!? Family flying back this afternoon and they want me to travel 60 miles diversion to pick up car so as to drive family to airport!!???
  15. Thanks guys, I almost started crying when the shop keeper and his assistant said that they saw everything and would provide statements. My insurance guy was lovely too and said he would play his cards close to his chest and wait and see if the two other parties confirm each others story and then he would show them the picture of his car crashed into mine and see what he says then. If he continues to dig then the cctv will be presented.
  16. Friday past has got to be my'vae diei', in the morning I buried my father and upon returning from the cemetery I was crashed into on my passenger side. I was on a one-way system as is common in most towns today, I was driving in the right hand lane and the other party was in the left hand lane. As I travelled through my town centre, I noticed the person driving the car that eveuntally crashed into me shouting out his window and clearly irrate. I continued on my journey and then he pulled straight across the front of me and we collided. Immediately he jumped from his car and sprinted around to my drivers side and started punching my window and attempting to get into my car and his language was that of a guttersnipe. I was afraid to get out of my car and then I noticed a woman get out of the passenger seat and order him away. At this point bemused I got out of my car and asked what was going on? The woman then said that I had been antantagonising him!?? .... I said what exactly was it I was doing and apparently I had raised my left arm and gesticulated towards this man!??? My head was already fried, so I said can we both get photographs of the cars in situation and then pull into roadside before calling the Police and exchanging insurance. Before I had the chance to take a breath he immediately jumped into the car and moved his to kerb before I could photograph. I left my car and took photographs off my car as it was and then pulled to kerb side. At this point, I asked why he had moved his car and he launched into another foul mouthed abuse, "I have two effing kids in that car"...... "You effing c--t"! Again he was ordered away by the woman who was decent, I said we both call the Police again and as usual the first question was "Is anyone injured?" ..... "No" ...." Then just exchange insurance and photograph other parties and their cars." So, after going home I thought and wasn't happy with the Police response as this individual had threatened to "kick the eff out of me". I remembered that the accident had happened outside some business premises and decided to call in and see if anyone had witnessed the event. The first business recognised me straight away and asked if I was OK? He then said I have CCTV outside that filmed the whole event and on my mobile I have a photograph clearly showing his car pulled across me. He then stated the member of his staff had filmed him attacking my car, punching the window several times, kicking my door and attempting to gain entry to my car! They both stated that they would be delighted to give statements and provide their photographs, video phone footage and cctv to the Police or insurance. So, with restored faith in mankind I returned to the Police station and asked if I could make a complaint against this driver and the same Constable I had spoken to earlier arrived at front desk and he immediately said I thought we had resolved this? He then said that the lady whose insurance policy he was driving under had told him that I had pulled across them backing his story and I was saying the opposite!! I told him about the business and the photographs, camera phone & cctv footage and he got annoyed!!##???? Stating "You are not hurt, none of them are hurt so let the insurance handle it!!". Thanks, for taking the time to read and if anyone has any advice it would be welcomed. Mainly, I just wanted to get the experience written down while it is still fresh in my mind.
  17. Each policing district have different policies on different laws, I am afraid that as far as I am concerned, my phone is switched off when I am driving, I unfortunately for you agree with Sgtbush.
  18. Crikey, I used Enterprise just before Christmas and highly recommend them, this was in the UK, they did push me to take out the excess cover but I said no thanks. As regards the scrape, I have had a close look and at least 80-90% is a lacquer scratch and five mins with some compound paste and a damp cloth would make it almost disappear and fall within their golf ball damage. I would email their customer service dept direct and state that you could remove the largest part of said scrape with compounding paste and for a company with such fantastic customer service reputation you feel let down and taken advantage off. Apart, from that I believe they have you over the proverbial barrel.
  19. It is not your debt Phil, plain & simple! If they remove your posessions, it would be theft! Are you on the electoral register at this address yet!? PS: Stop unduly stressing yourself as they will be in a lot of problems if they remove your posessions.
