  2. Everything I have read both on CAB and Gov/uk sites states that if you make a claim for PIP then your DLA will not stop if you do it when they ask. I quote "myth“I have been told that there will be a break in my benefit payments if I move from DLA to Personal Independence Payment.” FAQ: Will there be a break in my benefit payments if I move from DLA to Personal Independence Payment? "Fact" If you are awarded Personal Independence Payment we will ensure there are no gaps between benefit payments so long as you send us the information we need when we ask for it. I cannot find anywhere that states it will stop when changing over. from the CAB website If you're already getting DLA, PIP is being introduced gradually over several years and will eventually replace DLA. The Department for Work and Pensions (DWP) will write to you at some point between 28 October 2013 and September 2017 asking you to make a new claim for PIP instead of DLA. You don't have to do anything until they contact you. You won't get PIP automatically just because you qualify for DLA. You'll have to make a claim for it. If you don't claim when the DWP asks you to, your DLA payments will stop.
  3. Hi, 45002, I understand that I must make a claim for PIP, and there is no automatic transfer over. Where the confusion is as I understand it is as follows. I am told to apply for PIP in Dec 2015. I apply and in Feb 2016 I am awarded PIP at the relevant rate. I would still be payed dla until Feb 2016 and then the PIP rate. It would only stop being payed DLA if I did not apply? Is this correct?

  5. AS he checked the land registry as the vast percentage of private properties from that time were never registered. From experience when I dealt with my uncles properties tracing original ownership from that period is a nightmare.
  6. Thanks I was not confused about PIP and being reassessed from 2015. I am just confused about which form MIKV has received. I am fairly sure now that this is a renewal form which is still valid until the end of october. I must really make myself clear when I make posts LOL
  7. I was hoping that one of the experts would advise on this. Due to the confusion I would do as planned in your previous post and fill it in and send all your additional information in as well.   8. Hi Mike I am getting confused .A few years ago I was given a life time award, I have since been told I would be assessed for PIP from 2015. Were you given an award for a set period of time and you are being reassessed.
  9. Sali, It is very true that words are cheap. When I worked within the NHS I admitted a number of patient onto the ward from care homes (two of which have now been closed) and it was obvious that these poor individuals had not been cared for. I could give a long list of what I would call neglect. I went to my manager about my concerns and he was fully supportive. There just seems to be a point were as it went further up the management level any action would be at at crawl. The whole system of regulation requires firm policing. What I mean by that is that before they can even open a care home they must prove that good care will be given. All staff must be trained and independent supervision allowed 365 days a year. All inspections would be without warning and inspection reports available to the public. Any home where neglect was found, the owner and management would be criminally responsible and a mandatory minimum prison sentence given.

  14. What they did! I only have limited knowledge on disability law but your example fills me with great anger and I am sure when the legal advisors are on the forum they will give far better explanations on how these (i cannot use the word I want to) have acted.
  15. John I am here as long as you need me. You have completed your introduction and on the physical side wrote about walking and sitting/stand and matched them to descriptors. You now need to state the problems you have physically with your home environment. For example who shops for you/ Do you shop online? What problems do you have cooking? Do you live on ready meals or out of cans because you have difficulty preparing food. What problems do you have cleaning your home. When I am bad nothing above 2 feet high gets done and the wife takes over. If you live on your own and you struggle to keep the house clean then state that. There is no shame in admitting you have problems. Have a think about it and put notes down on the post and I will have a go at wording it for you.

  18. Hi Meg and Mog (like the name), I must agree no matter what the condition I believe any parent should fight for help that their children are entitled too. Both my children have dyslexia and dyspraxia and it is always a battle to get the help they need.

John states that he as difficulty walking 100m without pain. he as stated that he can walk further than this but it takes a great deal of time. I.E 15 minutes for a journey that would take a "normal" person 3 or 4 minutes. This would met © (ii) of the descriptors. These descriptors are relevant to the work place. Why should the tribunal take domestic arrangements into consideration when the assessment is fitness for the work place. I arrange my home to match my physical abilities. Something which I would not be able to do in the work place. edited, Sorry margaret i think you have already answered my question cross post. thankyou.

Hi margaret i believe this is the descriptor that john is relating to. © Cannot either: (i) mobilise more than 100 metres on level ground without stopping in order to avoid significant discomfort or exhaustion; or (ii) repeatedly mobilise 100 metres within a reasonable timescale because of significant discomfort or exhaustion. 9 You make some very interesting points. John needs to give us some details about domestic arrangements. If he is like the man I know it is microwave meals all the way.
