  2. I received a cheque from Lloyds for £750 in full and final settlement. However i wrote back to them saying that I'd accept it only as partial settlement and would be filing a claim if I hadn't heard from them in 7 days and would be returning the cheque. Like the idiot i am i'd mis-remembered what i'd written in the letter (thinking I hadn't put in the bit about returning the cheque) and banked the cheque. Will this supersede my terms in the letter as they've obviously ignored it and have I inadvertently "accepted" their terms of the payment, i.e. in full and final settlement? Is there anyway I can get round this? am such a dunce. thanks in advance for any advice xx

    Am about to file an N1 at my local County Court. I'll fill in the spreadsheet to calculate the interest but Lloyds sent me a cheque for £750 but I wrote to them stating i would not accept it as full and final settlement but only as a partial settlement and that i would be filing a claim for the remaining £1,232.50. When calculating interest, how do I take off the £750... presumably I calculate the final total and then subtract the £750 - is that right? Many thanks Llou

  7. morning all i today received a cheque from lloyds for £750 in full and final settlement. i received the offer letter on 30 May and replied to them yesterday saying that i would accept it as an initial payment and will still be claiming for the remaining £1200 if I didn't receive it in 7 days. Obviously my letter crossed in the post with their cheque - should I wait for a response from them before banking it or will my letter cover me, i.e. that by banking it i'm only accepting it as part/initial payment and not under their conditions? Apologies if this question has been answered before, have checked FAQs and been looking on here yesterday and today but can't find a definitive answer! Thanks guys LLou
  8. yesterday i received a letter from Lloyds offering me £750 in full and final settlement. I am claiming nearly £2000 from them - am I able to accept this as a part settlement and still go after them for the rest or should I reject it completely? please can someone also point me in the right direction for the template letters to use as I can't find them (I know they exist as i've seen the thread before but can't remember where!) many many thanks Llou x

    Does anyone know where I can get a copy of Natwest T's & C's for current account during the period Oct 2001-Oct 2004? I have looked on the archive website but although the pages are there, there is no content. This is in preparation for hearing date on 20 June. Many thanks LLou
  11. Hi. I received my court date (20 June) a week or so ago. It asks the Defendant to submit explanations of all charges in the schedule that I provided but i've not been asked to submit anything. Do I need to submit a bundle by the same date (25 May) or do I just take it to court with me? Any advice would be appreciated thanks
  12. Having read the Lloyds TSB current account charges linked on this thread I have two questions: 1. Surely they have changed these over the past six years and therefore are we able to get a copy from them from the t's and c's that applied four, five, six years ago? Surely they should hold copies of old versions. 2. This is a very woolly point but on their current account charges page they state of the overdraft fee "We charge this when you go overdraft and don't have an overdraft facility, or if you go overdrawn above an agreed overdraft" - would "agreement" constitute a contract in this respect? Apologies if I'm just clutching at straws!! LLou
  13. Hi there. Can anyone help me with a small query? I've filed a claim against NatWest which Cobbetts defended and I now have a court date for 20 June. For idiotic reasons I didn't add the 8% interest onto the amount claimed when I filed through MCOL. If the case did get to court and the judge ruled in my favour, is s/he likely to order that the interest is added or is it not a statutory thing (i.e. do you have to request it?) Many thanks! Llou
  14. Hi there. I sent the letter at the beginning of this thread to both Cobbets and the Court. I heard nothing further from them but the court was moved to one near to me and I have now received a hearing date (20 June). The court have also ordered Cobbetts to file by 25 May their counter-schedule explaining why I was charged each individual charge on my account. Don't give into their scare tactics as this is all it is. I would still send them a shcedule of the charges, directly as advised earlier in this thread and mentioned in the draft letter - good luck!
