  1. Can't believe they can get away with things like that. Its ridiculous!! As if life isn't stressful enough to be dealing with things like this!!
  2. I phne the TEC and ask them that when I was filling out my out of time declaration form (PE7) and she told me that the warrant was reissued in February this year. It was shortly after that I received the first ever leter about this incident and that letter was the warrant. The baliff firm in question is a company called Equita. I haven't had any visits from them yet. I haven't paid them anything and I'm not planning to. My vehicle hasn't been clamped yet. I was under the impression that they was on hold whilst this process was pending?? Or am I wrong to think that?? Thank you for the reply. I shall have a read of the link you posted
  3. I have just received a letter in the rejecting my out of time declaration appeal for a PCN issued by Lambeth council last year for me turning down a road I wasn't allowed. I am guilty of the offence as they have the photo and video evidence of me doing it, and I am willing to pay the original fine. The only thing is I have never received any correspondence as I moved house just after the time of the offence so I expect that all letters have been sent to my old address. When I moved I changed all my vehicle details over with the DVLA but still for a year all the letters have never been sent to me at my new address until I now. I have to fill in a N244 form and go for the hearing. The N244 form is asking for evidence but how can I give evidence of letters I've never received?? They have given me a Notice of Objection account which states: -The respondant claims they dis not receive a Notice to The owner. The address was received from the DVLA on 2/5/12. -The London Bourough of Lambeth sent a PCN to the respondent on 2/5/12. Records show that no response was made and no payment received -The London borough of Lambeth sent a Charge certificate to the respondent on 15/11/12. No response was received from the respondent and no payment made -The charge was registered as a debt with Northampton county court on 21/12/2012. At that time, no Statutory declaration was filed, no payment was mad and no correspondence was received. -Subsequently a warant was issued to recover the debt on 8/2/12 - Finally the London borough of Lambeth received a notification on 27/3/13 that an out of time declaration had been filed with Northampton County court. I also got a statement of truth with the letter. In my out of time declaration i explained about me moving house and I suspected that they had been sending the letters to my old address as I have never received anything about it but they have completly ignored that!!! Surely if they have been sending these letters to my new address they must have some sort of evidence that they have actually sent them to the correct place!!!??? - The only letter i received about this was the warrant issued on 8/2/12 which was sent to my new address. I have never received any of the others!!! This is so unfair as I have already had to take time off of work to try to sort this out and it looks like I'm going to have to take more time off and pay 80 pound to have a court hearing!! It's ridiculous. I have done everything correctly by changing my details over with the DVLA and I've responded straight away to the only letter i received from the bailiffs!! Its them idiots that have been sending letters to the wrong address for over a year but now I'm the one having to pay the extra money for their mistake!!! So I just need to know if anyone has been in a similar situation and have suceeded in appealing against a situation like this at the N244 stage. Also How can I collect evidence about the situation if the only evidence I've got is me saying that I have never received a letter from them?? Surely its just my word against theirs?? Any help and advice would be appreciated Thanks
  4. Just phoned them and now have to go to a county court to get my signature witnesses but they said they are not putting the baliffs on hold whilst I sort it out. Nice!!

I yesterday recieved a letter from, 'Equita Certified Baliif's, ' saying that they had been instructed by the London Bourough of Lambeth in connection with the warrant of execution granted against you by the Traffic Enforcement Centre at Northampton County Court. I had no idea what this was about as I no longer live in London or have not worked in London for over a year. The letter did not state how much i owed nor did it state any details of the incident which they say I owe money for. I phoned, Equita and spoke to the person and gave them my reference number. He informed me that it was from an incident back in April 2012 where turned left down a street where a left turn was prohibited and now the amount to be paid was 215 pounds. I explained that this is the first I had of heard of it and had recieved no letters previously telling me of this. He gave me the reference number for the PCN and suggested that I take it up with the council. I have tried using the reference number he gave me on the councils online website to show photos/videos of the incident but it says that there is nothing found. After finishing the phone call i had a think and I do remember recieving a PCN to which I appealed but shortly after I moved house but notified the DVLA and got my vehicles address and details changed to my new address. I had a lot going o at the time and to be honest i completely forgot about the PCN until now (almost a year later). I assume that all of the letters and the warrant have all gone to my old address, which obviously I have never received and now I am getting a letter from the baliffs at my new address. Where do I stand on this because i have notified the DVLA of the change of address to my vehicle?? At the time of writing the appeal I was unsure of my new address and nothing about my move was finalised until after i had written the appeal letter, so I could not put my new address on it for them to send any letters to. I'm willing to pay the original fine but not pay all of the other fees as I did not know anything about it. I am going to phone the council later today but just wanted to know where i stand and if i have much chance of not paying these baliff fees? How can they expect me to pay this money if I have never heard anything about this?? Any help will be appreciated Thanks
